DAVE\n\t\t\n\t\n\n \n\nDate\n: 11\/05\/2011 ORAL ORDER<\/pre>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 19.1.2011<br \/>\n\tpassed by respondent No.2, in exercise of powers conferred<br \/>\n\tunder Section 3(1) of the Gujarat Prevention of Anti Social<br \/>\n\tActivities Act, 1985 (in short&#8221; the Act) by detaining the<br \/>\n\tdetenue as a &#8220;cruel person&#8221; as defined under Section<br \/>\n\t2(bbb) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the detenue submits that the registered case\/s under<br \/>\n\tthe Prevention of Cruelty to Animals Act, 1960, would not indicate<br \/>\n\tanything to support disturbance to public order nor have the<br \/>\n\tactivities of the detenue affected adversely the maintenance of<br \/>\n\tpublic order  and, therefore, the order of detention  passed by the<br \/>\n\tdetaining authority cannot be sustained in law and is required to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p>Learned<br \/>\n\tAGP has opposed the petition and supported the order of detention in<br \/>\n\tletter and spirit.\n<\/p>\n<p>Having<br \/>\n\theard the learned counsel for the parties, on perusal of record,<br \/>\n\tconsidering the definition of &#8216;cruel person&#8217; &#8220;means<br \/>\n\ta person who either by himself or as member or leader of a gang<br \/>\n\thabitually commits or attempts<br \/>\n\tto commit, abets the commission of an offence punishable under<br \/>\n\tSection 8 of the Bombay Animal Preservation Act, 1954&#8221;<br \/>\n\tcontained in Section 2(bbb) of the PASA Act and the law laid down by<br \/>\n\tthe Apex Court in the case of <a href=\"\/doc\/1604276\/\">Gopalanachari vs. State of Kerala,<\/a><br \/>\n\treported in AIR 1981 SC 674, where the Apex Court considered and<br \/>\n\treiterated the law on personal liberty vis-a-vis rule of law and<br \/>\n\tprocedure contemplated in Article 21 of the Constitution of India<br \/>\n\twhich means fair and not formal procedure and Article 22 which<br \/>\n\tspecifically spells out the procedural safeguards for preventive and<br \/>\n\tpunitive detentions and a law providing for such detention should<br \/>\n\tconform to Article 22 of the Constitution of India, while referring<br \/>\n\tto the decisions of the Apex Court in the case of Maneka Gandhi<br \/>\n\treported in [1978] 1 SCC 248 and in the case of Hoskot reported in<br \/>\n\t(1978) 3 SCC 544, and as held by the learned Single Judge of this<br \/>\n\tCourt vide Oral Judgment dated 21.2.2005, in Special Civil<br \/>\n\tApplication No.15105 of 2004 [Iliyas Mohammad hi vs. Commissioner of<br \/>\n\tPolice],  and keeping in mind the object of detention law being<br \/>\n\tprevention and not punishment, this Court is of the opinion that the<br \/>\n\tactivities of the detenue cannot be said to be adversely affecting<br \/>\n\tthe maintenance of public order and at the most fall under the<br \/>\n\tmaintenance of &#8220;law and order&#8221;. Hence, the subjective<br \/>\n\tsatisfaction  arrived at by the detaining authority is vitiated.\n<\/p>\n<p>In<br \/>\n\tthe result, the petition is allowed. The order of detention dated<br \/>\n\t19.1.2011 passed by the respondent<br \/>\n\tNo.2  is quashed and set aside. The<br \/>\n\tdetenue is ordered to be set at liberty forthwith if not  required<br \/>\n\tin connection with any other case. Rule is made absolute<br \/>\n\taccordingly.
