Asthana\n\n            Hon'ble Shri Narayan Shukla,J.\n<\/pre>\n<p>Petitioners claim the disobedience of order dated 8.8.2000 passed by<br \/>\nthis Court in writ petition 803 (M\/S) of 1997 along with other connected<br \/>\nwrit petition no. 804 (M\/S) of 1997, the operative portion of the order is<br \/>\nreproduced hereinunder:-\n<\/p>\n<p>&#8220;Normally the matter should have been remanded to the Labour Court<br \/>\nafter setting aside the same for the purpose of granting relief in view of<br \/>\nobservations made above, but since the matter is quite old and the<br \/>\nworkmen after their retrenchment in the year 1979 approached the<br \/>\nLabour Court after a delay of eleven years and five years were taken in<br \/>\ndeciding the matter by the Labour Court, I deem it proper that a<br \/>\ndirection be issued to the petitioner and the award shall stand modified<br \/>\nto that extent. The workmen shall not be entitled to the wages as<br \/>\nawarded by the Labour Court.\n<\/p>\n<p>The petitioner is directed to consider the case of such employees who<br \/>\nhave been held to be retrenched employee by the impugned order of<br \/>\nthe Labour Court, Faizabad, in accordance with the provisions of<br \/>\nsection 6-A of the U.P. Industrial disputes Act, on any existing<br \/>\nvacancies or the vacancies which may occur in the future within a<br \/>\nperiod of four months from the date the certified copy of this order is<br \/>\nproduced before the authority concerned. Both the writ petitions are<br \/>\ndisposed of accordingly.&#8221;\n<\/p>\n<p>The petitioners claim that after the order passed by the writ court the<br \/>\nopposite parties have proceeded to absorb the retrenched employees<br \/>\nexcluding the petitioners, whereas the stand of Mr. Jaideep Narain<br \/>\n Mathur, learned Senior Advocate assisted by Mr. Sanchit Asthana,<br \/>\nlearned counsel for the Corporation is that the Corporation has<br \/>\nproceeded to make absorption of only the reserved category<br \/>\ncandidates; whereas the petitioners belong to general category<br \/>\ncandidate and for general category candidates he submits that as per<br \/>\nterms of the order passed by the writ court as and when the opposite<br \/>\nparties proceed to appoint, they shall consider the case of the<br \/>\nretrenched employees under the provisions of Section 6-Q of the U.P.<br \/>\nIndustrial Disputes Act, without keeping any reservation.<br \/>\nThough by pointing out the list as well as the names of the candidates,<br \/>\nthe learned counsel for the petitioners tried very much to establish the<br \/>\nabsorption of the candidates in violation of order passed by the writ<br \/>\ncourt, but this Court at this stage does not appreciate the same as<br \/>\nupon perusal of the record I find a clear stand of the Corporation that<br \/>\nnobody of the general category has been absorbed. On asking as to<br \/>\nhow the opposite parties shall implement the order passed by the writ<br \/>\ncourt and whether they have any clear stand of absorption of the<br \/>\npetitioners or not, it is submitted by Mr. Mathur, learned Senior<br \/>\nAdvocate in the form of undertaking that when the Corporation<br \/>\nproceeds for extending the employment to any person, the petitioners<br \/>\nwho are the retrenched employee shall be considered for providing<br \/>\nemployment under their respective categories without any excuse in<br \/>\nterms of the order passed by the writ court. I hope that the Corporation<br \/>\nshall follow its undertaking.\n<\/p>\n<p>Keeping in view the submissions of the learned counsel for the<br \/>\npetitioners that there may be hide and seek on the part of the<br \/>\nCorporation in the proceeding adopted by the Corporation for<br \/>\nemployment, it is stated by Mr. Mathur that vacancies shall be<br \/>\nadvertised to public at large through leading two daily newspapers- one<br \/>\nin Hindi and other in English by inviting the applications from eligible<br \/>\n candidates including the petitioners, in which the petitioners shall have<br \/>\nchance to apply and if they apply, they shall be considered for<br \/>\nappointment.\n<\/p>\n<p>In the light of the aforesaid submissions made by the learned counsels<br \/>\nfor the parties I do not find disobedience of the order passed by writ<br \/>\ncourt on the part of the opposite parties.
