Desai for the<br \/>\n\tpetitioner, it appears that it is an admitted position that the<br \/>\n\tissues which arises in the present petitions for consideration are<br \/>\n\tthe same as they were considered by this Court in Special Civil<br \/>\n\tApplication No. 10205 of 2010 and allied mater decided on 30.08.2010<br \/>\n\tand subsequent applications for review being Misc. Civil Application<br \/>\n\tNo. 2563 of 2010 and allied matters decided on 26.10.2010.\n<\/p>\n<p>We<br \/>\n\tmay record that this Court (Coram: D.H. Waghela &amp; S.R.<br \/>\n\tBrahmbhatt, JJ..) vide order dated 30.08.2010 in Special Civil<br \/>\n\tApplication No. 10205 of 2010 and allied matters had observed thus:\n<\/p>\n<p> All<br \/>\n\t\tthe petitions are filed by a group of petitioners challenging the<br \/>\n\t\tconsent awards of Special Land Acquisition Officer, Bharuch, on the<br \/>\n\t\tgrounds that the petitioners were illiterate and poor landholders,<br \/>\n\t\twho were carried away by misrepresentation of respondent nos.2 and\n<\/p>\n<p>\t\t3.  It was vehemently argued by Mr.Bukhari for Mr.B.B.Desai,<br \/>\n\t\tlearned counsel for the petitioners that the lands are acquired for<br \/>\n\t\tmining lignite  which is a valuable mineral and the petitioners<br \/>\n\t\twere deprived of real value of the land lost by them due to<br \/>\n\t\tacquisition.  It was fairly conceded that all the petitioners were<br \/>\n\t\tnot Adivasi, poor or illiterate and the proceedings for acquisition<br \/>\n\t\tof the land had started in the year 2003 and were concluded by the<br \/>\n\t\tawards in early 2008.  No legal provision was even alleged to have<br \/>\n\t\tbeen violated.  Under the circumstances, the petitions clearly<br \/>\n\t\tappear to be a belated attempt at reneging on the consent award for<br \/>\n\t\textracting some additional amount by way of compensation.  It being<br \/>\n\t\tnot permissible under the law, the petitions are summarily<br \/>\n\t\tdismissed.\n<\/p>\n<p>Further,<br \/>\n\tin the Review Application being Misc. Civil Application No. 2563 of<br \/>\n\t2010 and allied matters, vide order dated 26.10.2010, it was<br \/>\n\tobserved as under :\n<\/p>\n<p>\t\t 1.\tLearned<br \/>\n\t\tcounsel Mr. B.B.Desai straightaway requested to grant prayer at<br \/>\n\t\tparagraph 8(C) and submitted that if even that prayer cannot be<br \/>\n\t\tgranted, the applicants may be permitted to make a representation<br \/>\n\t\tdirectly to the State Government to voice their grievances. He<br \/>\n\t\tfairly conceded that the other contentions contained in the<br \/>\n\t\tapplications for review could not legally be entertained, as<br \/>\n\t\tentertainment of those contentions would amount to hearing an<br \/>\n\t\tappeal from the order sought to be reviewed.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel was also candid in admitting that he could not hear any of<br \/>\nthe queries of the Court and hence could not reply to them. It<br \/>\nappears from the record that the Court has consciously and with<br \/>\nnecessary observations dismissed the petitions on the basis that the<br \/>\noriginal petitioners had admittedly obtained consent award in the<br \/>\nyear 2008. It clearly appears from the present prayer of the<br \/>\npetition, which has been pressed that the applicants are desperately<br \/>\ntrying to open a new vista for reagitating their untenable claims on<br \/>\nthe basis of some observations which are invited in the present<br \/>\norder.\n<\/p>\n<p>3.\tWe<br \/>\ndo not approve the practice of moving the government with<br \/>\nrepresentations after a decision is rendered on judicial side.<br \/>\nTherefore, the applications restricted to prayer 8(C) are dismissed<br \/>\nwith the observations that the averments and allegations made in the<br \/>\nrest of the applications are improper and not expected from an<br \/>\nadvocate of the standing of learned counsel Mr. B.B.Desai.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioner is not in a position to show any<br \/>\n\tdistinguishing circumstances for not applying aforesaid decision in<br \/>\n\tthe present case.\n<\/p>\n<p>When<br \/>\n\tthe similar matters are already decided by the another Bench of this<br \/>\n\tCourt, wherein, one of us was a Party, it is not open for us to take<br \/>\n\ta different view than the view taken by the earlier Bench as per the<br \/>\n\tabove referred decision.\n<\/p>\n<p>Hence<br \/>\n\tall the petitions deserve to be dismissed.
