Justice R.BASANT\n\n Dated :26\/02\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                            Tr.P(Crl).No.34 of 2007\n\n                         -------------------------------------\n\n                  Dated this the 26th  day of February, 2007\n\n\n                                        ORDER\n<\/pre>\n<p>       The   petitioner   is   an   advocate   who   faces   allegations,   inter   alia,<\/p>\n<p>under Section 447  I.P.C in a  criminal case, in which cognizance was<\/p>\n<p>taken   on   the   basis   of   a   final   report   submitted   by   the   police.     The<\/p>\n<p>petitioner wanted the case to be transferred to any  court other than<\/p>\n<p>the   courts   at   Manjeri.     The   learned   Sessions   Judge   by   Annexure-A<\/p>\n<p>order   rejected   the   application   showing     reasons.     Later,   the   learned<\/p>\n<p>Sessions   Judge   observed   that   the   petitioner-advocate   was   found<\/p>\n<p>practising   before   that   court   only   during   the   trial   of   the   case   in<\/p>\n<p>question.     It   is,   in   these   circumstances,   that   the   learned     Sessions<\/p>\n<p>Judge  proceeded  to  reject  the prayer for transfer.     Of  course, it  was<\/p>\n<p>also noted that the prayer for transfer had already been dismissed by<\/p>\n<p>the learned Chief Judicial Magistrate.   That may not ip so facto be a<\/p>\n<p>valid reason for rejection of an application for transfer.  But evidently<\/p>\n<p>the learned Sessions Judge had not refused to consider the prayer for<\/p>\n<p>transfer   on   merits   of   that   ground.     There   was   only   an   incidental<\/p>\n<p>reference   to   that   event   also   which   had   taken   place   prior   to   the<\/p>\n<p>impugned order.\n<\/p>\n<\/p>\n<p>       2.     The  learned  counsel  for  the   petitioner   fairly   submits   that<\/p>\n<p>trial  has  already   commenced  and   some  witnesses  have  already  been<\/p>\n<p><span class=\"hidden_text\">Tr.P(Crl).No.34 of 2007                   2<\/span><\/p>\n<p>examined.    I   am   not   satisfied,   in  the  facts   and   circumstances  of  this<\/p>\n<p>case,   that   any   transfer   should   be   directed   at   this   stage   of   the<\/p>\n<p>proceedings.\n<\/p>\n<\/p>\n<p>         3.
