Justice R.BASANT\n\n Dated :01\/02\/2007\n\n O R D E R\n                                R.BASANT, J\n\n                             ----------------------\n\n                         W.P.C.No.8790  of 2005\n\n                       ----------------------------------------\n\n               Dated this the 1st day of February  2007\n\n\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The   petitioners   are   the   accused   in   a   prosecution   under<\/p>\n<p>Section     138   of   the   Negotiable   Instruments   Act   and   that<\/p>\n<p>prosecution   is   pending   before   the   Metropolitan   Magistrate<\/p>\n<p>Court-12, Bandra, Mumbai, Maharashtra.   Cognizance has been<\/p>\n<p>taken   by   the   learned   Magistrate.     Processes   have   been   issued<\/p>\n<p>against the petitioners.\n<\/p>\n<p>      2.     That   court   functions   within   the   jurisdiction   of   the<\/p>\n<p>High   Court   of  Maharashtra.     The   petitioners  have   come  to  this<\/p>\n<p>court with the prayer that the proceedings initiated against him<\/p>\n<p>before   that   court   may   be   quashed   invoking   the   powers   under<\/p>\n<p>Article 226 of the Constitution.\n<\/p>\n<p>      3.     What   is   the   ground?     The   short   contention   raised   is<\/p>\n<p>that prosecution in respect of four cheques cannot be the subject<\/p>\n<p>matter   of   one   prosecution   as  the   same   violates   the   mandate   of<\/p>\n<p>Section 219 Cr.P.C.  This, in short, is the contention raised.\n<\/p>\n<p>      4.     That   alleged   irregularity   committed   by   a   court   in<\/p>\n<p>Mumbai   cannot,   obviously,   confer   jurisdiction   of   this   court   to<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.8790\/05                         2<\/span><\/p>\n<p>invoke the powers under Article 226 of the Constitution.   There<\/p>\n<p>is no dispute that powers under Section  227 of the Constitution<\/p>\n<p>or Section 482 Cr.P.C cannot be invoked but the learned counsel<\/p>\n<p>contends   that   in   as   much   as   the   petitioners   have   come   before<\/p>\n<p>this court by calling his petition as one under Article 226 of the<\/p>\n<p>Constitution, such jurisdiction would be available.\n<\/p>\n<p>      5.     I   am   unable   to   agree.     At   the   first   instance,   I   must<\/p>\n<p>note   that   though   the   petition   has   come   with   the   label   &#8216;petition<\/p>\n<p>under Article 226  of the  Constitution&#8217;, it is virtually and truly a<\/p>\n<p>petition   under   Article   227   of   the   Constitution\/Section   482<\/p>\n<p>Cr.P.C.     Cognizance   has   already   been   taken   by   the   learned<\/p>\n<p>Magistrate.     In   these   circumstances,   the   decision   in    <a href=\"\/doc\/1293509\/\">Musaraf<\/p>\n<p>Hussain v. Bhageeratha Engg.Ltd.<\/a> [2006(2)KLT 525 SC] becomes<\/p>\n<p>relevant.   Powers under Article 227 and Section 482 Cr.P.C are<\/p>\n<p>not available to this court. Merely  because the petitioners have<\/p>\n<p>chosen   to  seek  the   relief   under  Article  226  of  the   Constitution,<\/p>\n<p>this court cannot assume jurisdiction.\n<\/p>\n<p>      6.     Moreover,   even   if   that   court   were   within   the<\/p>\n<p>territorial jurisdiction of this court, I find no reason whatsoever<\/p>\n<p>to   invoke   the   powers   under   Article   226,   227   or   Section   482<\/p>\n<p>Cr.P.C.\n<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.8790\/05                        3<\/span><\/p>\n<p>       7.    At   worst   if   the   objections   were   found   to   be<\/p>\n<p>sustainable, the court will have to register two separate cases to<\/p>\n<p>satisfy   the   objection   raised.     Merely   because   such   an   alleged<\/p>\n<p>irregularity has been committed by the court, I find no reason to<\/p>\n<p>invoke the powers under any of the above three provisions.\n<\/p>\n<p>       8.    There  cannot  possibly   be   a  contention   that  the   court<\/p>\n<p>at   Maharashtra   has   no   territorial   jurisdiction   to   entertain   the<\/p>\n<p>complaint.     The   decision   in  <a href=\"\/doc\/181597\/\">K.Bhaskaran   v.   Sankaran   Vaidhyan<\/p>\n<p>Balan<\/a>  [2006(1)  KLT   552]  makes the  position  crystal  clear.   The<\/p>\n<p>courts   within   the   jurisdiction   of   which   any   of   the   five   events<\/p>\n<p>which,   according   to   the   above   decision   constitute   a   punishable<\/p>\n<p>offence,   occur   can   entertain   territorial   jurisdiction.     The<\/p>\n<p>contention   that   the   courts   at   Maharashtra   do   not   have<\/p>\n<p>jurisdiction cannot also, in these circumstances, succeed.\n<\/p>\n<p>       9.
