Koshy,J.\n<\/p>\n<\/p>\n
     The appellant – claimant sustained injuries in a motor<\/p>\n
accident on 9.7.1998.      The Tribunal found that the accident<\/p>\n
occurred due to the negligence of the first respondent, the driver<\/p>\n
of the bus insured by the second respondent. But against a claim<\/p>\n
of Rs.1,50,000\/-, the Tribunal awarded only Rs.45,750\/-. The<\/p>\n
only dispute is regarding the quantum of compensation.<\/p>\n
     2.   The Tribunal did not award any compensation for<\/p>\n
permanent disability and consequential loss of earning power.<\/p>\n
The injuries as found by the Tribunal are as follows:<\/p>\n
           “The petitioner sustained the following injuries<\/p>\n
     as revealed from Ext.A6 wound certificate issued<\/p>\n
     from Medical Trust Hospital:\n<\/p><\/blockquote>\n
           “1. Black eye right.\n<\/p><\/blockquote>\n
           2. Bleeding from the left ear.<\/p>\n<\/blockquote>\n
           3. Fracture of right clavicle and left clavicle.<\/p>\n
MACA 955\/06                      -: 2 :-<\/span><\/p>\n<\/blockquote>\n
            4. Fracture of right second toe.<\/p>\n<\/blockquote>\n
            5. Lacerated wound of right wrist 1×0.5 cm x<\/p>\n
               0.5 cm.<\/p><\/blockquote>\n
<\/blockquote>\n
            6. Small lacerated wound 0.5 x 0.5 cm on the<\/p>\n
      right side of chest and right arm.<\/p>\n<\/blockquote>\n
            7. Abrasion on the right forearm.<\/p>\n<\/blockquote>\n
            8. Fracture of right zygoma.\n<\/p><\/blockquote>\n
            Orthopaedic consultation was done for the<\/p>\n
      fracture of both clavicle and right 2nd metatarsal<\/p>\n
      bone.\n<\/p><\/blockquote>\n
            X-ray chest – Fracture of left and right clavicles.<\/p>\n
            X-ray right foot – Dislocation of proximal<\/p>\n
                       interphalangeal joint of 2nd toe.<\/p>\n
                       Fracture of proximal phalanx of 4th<\/p>\n
                       toe shaft.”\n<\/p><\/blockquote>\n
      Petitioner was in the hospital for 17 days. Ext.A7 is<\/p>\n
      the discharge summary. Petitioner suffered bilateral<\/p>\n
      clavicle fracture, dislocation of PIP joint and fracture<\/p>\n
      of proximal phalang of 4th toe (R). The treatment<\/p>\n
      was conservative. Ext.A8 is the certificate issued by<\/p>\n
      the hospital stating that petitioner had also suffered<\/p>\n
      mild head injury. There was fracture to left temporal<\/p>\n
      bone.”<\/p>\n
      3. According to the claimant, he is unable to drive long<\/p>\n
trips.  According to the Tribunal, since he is able to drive, it<\/p>\n

cannot be said that he has permanent disability. But for the loss<\/p>\n
of amenities of life, Rs,12,000\/- was awarded. Considering the<\/p>\n
injuries mentioned in the medical certificate we have referred the<\/p>\n
matter to the Medical Board, Medical College Hospital, Kottayam<\/p>\n
for assessing the permanent disability if any. The Doctor certified<\/p>\n
that permanent disability suffered by the appellant is 5%. So,<\/p>\n
the compensation can be calculated for 5% disability.     He was<\/p>\n
aged 31 at the time of the accident. The accident occurred in<\/p>\n
1998. Taking the guidance from the 2nd Schedule, 17 can be<\/p>\n
fixed as multiplier.   He was a driver by profession. He was<\/p>\n
maintaining a family. Even if he was getting only Rs.100\/- per<\/p>\n
day, Rs.2,500\/- can be fixed as monthly income for 25 days work<\/p>\n
in a month. So, we fix Rs.2,500\/- as monthly income. If that be<\/p>\n
so, the compensation payable for 5% disability will be<\/p>\n
Rs.25,500\/- (2500x12x5\/100×17). The Tribunal has awarded<\/p>\n
Rs.12,000\/- for loss of amenities. Considering the fact that no<\/p>\n
compensation was awarded for permanent disability, loss of<\/p>\n
earning power and loss of amenities, etc., he is entitled to<\/p>\n
Rs.13,500\/-. The claimant had three fractures. According to the<\/p>\n
claimant he was advised to take best rest for six months.<\/p>\n
MACA 955\/06                    -: 4 :-<\/span><\/p>\n
Considering the above facts we are of the opinion that he was not<\/p>\n
able to do the work for at least four months. Therefore, for loss<\/p>\n
of actual earnings for four months he is entitled to Rs.10,000\/-.<\/p>\n
The Tribunal has granted Rs.3,000\/- for actual loss of earnings.<\/p>\n
So, the additional amount he is entitled to for the actual loss of<\/p>\n
earning is Rs.7,000\/-. Thus, the total additional amount payable<\/p>\n
is  Rs.20,500\/-.   We    are  of     the opinion  that  sufficient<\/p>\n
compensation has been granted under other heads.<\/p>\n
     4. The additional amount of Rs.20,500\/- should be<\/p>\n
deposited by the second respondent – Insurance Company with<\/p>\n
7.5% interest from the date of application till its deposit. On<\/p>\n
deposit of the amount, the appellant is allowed to withdraw the<\/p>\n
same.\n<\/p>\n
     The appeal is partly allowed.\n<\/p>\n<\/p>\n
