NO. 274 OF 2009\n             = = = = = = = = = = = = = = =\n         Dated this the 2nd day of March, 2010.\n\n                      J U D G M E N T\n<\/pre>\n<p>      This is an appeal preferred against the order of the<\/p>\n<p>Workmen&#8217;s     Compensation    Commissioner,   Thrissur     in<\/p>\n<p>W.C.C.167\/03. The applicant in the case has sustained some<\/p>\n<p>injuries on account of an accident while he was driving an<\/p>\n<p>auto rickshaw. The case projected by the claimant is that he<\/p>\n<p>was an employee under the first respondent in the case and<\/p>\n<p>the 2nd respondent was the previous owner and R3 is the<\/p>\n<p>insurance company. So the case of the claimant itself is that<\/p>\n<p>he is an employee under the first respondent in the case.<\/p>\n<p>The finding of the Compensation Commissioner is that there<\/p>\n<p>is a relationship of an employee-employer between the 2nd<\/p>\n<p>respondent and the claimant. It is fundamentally wrong. It<\/p>\n<p>cuts at the root of the case. Therefore that requires<\/p>\n<p>reconsideration.\n<\/p>\n<p>M.F.A.. 274 OF 2009<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>      2.   The learned counsel for the respondent would<\/p>\n<p>contend before me that the vehicle was transferred by the 2nd<\/p>\n<p>respondent in favour of the first respondent and the<\/p>\n<p>registration was also changed but before the change of<\/p>\n<p>insurance the accident took place and therefore by virtue of<\/p>\n<p>the deeming provisions u\/s 157(1) of the M.V.Act it has to be<\/p>\n<p>considered as a valid policy. If factually it is correct then<\/p>\n<p>certainly the insurance company will have the obligation to<\/p>\n<p>pay the amount. But if the policy is taken in the name of the<\/p>\n<p>previous owner after the change of registration in the name<\/p>\n<p>of the first opposite party then so many defences may be<\/p>\n<p>available to the insurance company which cannot be shut<\/p>\n<p>out.    Therefore on that point the award is liable to be<\/p>\n<p>interfered with.\n<\/p>\n<p>      3.   Secondly the question of disability or in other<\/p>\n<p>words loss of earning capacity. Loss of earning capacity is to<\/p>\n<p>be assessed as per the full Bench ruling of this Court<\/p>\n<p>reported in <a href=\"\/doc\/1848699\/\">Vanajakshan v. Joseph<\/a> (2003 (2) KLT 462<\/p>\n<p>(FB) which says that loss of earning capacity is to be<\/p>\n<p>M.F.A.. 274 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>assessed taking into consideration the inability to do all the<\/p>\n<p>work which one is capable of doing and not in relation to a<\/p>\n<p>particular work which a person was doing. It is in that angle<\/p>\n<p>the disability has to be assessed and compensation has to be<\/p>\n<p>worked out. If the materials are available that also may be<\/p>\n<p>considered or otherwise loss of earning capacity in the light<\/p>\n<p>of the Full Bench decision may be obtained and the matter be<\/p>\n<p>decided.\n<\/p>\n<p>      4.    Thirdly on the question of interest.    Since the<\/p>\n<p>matter is going back let that question be reconsidered in the<\/p>\n<p>light of the available decisions on the date of decision of the<\/p>\n<p>case. I say so because at present this Court had taken the<\/p>\n<p>view that in the light of the Constitution Bench ruling<\/p>\n<p>reported in     <a href=\"\/doc\/1640530\/\">Pratap Narain Singh Deo v. Shrinivas<\/p>\n<p>Sabata (AIR<\/a> 1976 SC 222) which holds that interest is due<\/p>\n<p>from the date of accident. So the award under challenge is<\/p>\n<p>set aside and the matter is remitted back to the Court for<\/p>\n<p>fresh consideration and all concerned are permitted to<\/p>\n<p>produce documentary as well as oral evidence in support of<\/p>\n<p>M.F.A.. 274 OF 2009<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>their respective contentions and let the matter be disposed of<\/p>\n<p>in accordance with law.     The Compensation Commissioner<\/p>\n<p>shall fix a date of appearance and issue notice to the parties<\/p>\n<p>for further proceeding in the matter.       Let there be an<\/p>\n<p>expeditious disposal of the case.\n<\/p>\n<\/p>\n<p>                           M.N.
