Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/03\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ------------------------------------------\n            CRL.M.C.NO.774 OF 2010\n           ------------------------------------------\n            Dated 29th March 2010\n\n\n                         O R D E R\n<\/pre>\n<p>         Petitioner was the accused No.8 in<\/p>\n<p>C.C.280\/1992 on the file of Judicial First<\/p>\n<p>Class Magistrate-I, Pathanamthitta. As he<\/p>\n<p>was absconding, case as against him was<\/p>\n<p>split up and re-filed as                   C.C.728\/1995 and<\/p>\n<p>the remaining eight accused were tried by<\/p>\n<p>the     learned        Magistrate.                   As     per<\/p>\n<p>Annexure-A3    judgment               dated          24\/11\/1995,<\/p>\n<p>after   examination             of         the       de   facto<\/p>\n<p>complainant, the           two injured who turned<\/p>\n<p>hostile,  remaining              witnesses            were  not<\/p>\n<p>examined  and       all         those            accused    were<\/p>\n<p>acquitted. Case as against the petitioner<\/p>\n<p>is now pending as L.P.30\/1997. Petition is<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Crmc 774\/10<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>Procedure     to quash the case as against the<\/p>\n<p>petitioner contending that in view of the order<\/p>\n<p>of acquittal against the other alleged members<\/p>\n<p>of the unlawful assembly and settlement of the<\/p>\n<p>disputes with respondents 1 to 3, it is not in<\/p>\n<p>the     interest  of  justice  to   continue  the<\/p>\n<p>prosecution. It is submitted that    as evidenced<\/p>\n<p>by    Annexure-A4  death  certificate, the  other<\/p>\n<p>injured Yasodharan, S\/o.Chathan died in 1995<\/p>\n<p>and hence, even if petitioner is      to be tried<\/p>\n<p>there      is no   likelihood  of   a  successful<\/p>\n<p>prosecution.\n<\/p>\n<p>           2. Respondents 1 to 3 appeared through<\/p>\n<p>a counsel and filed separate affidavits stating<\/p>\n<p>that entire disputes were settled and they are<\/p>\n<p>now living as friends with the petitioner and<\/p>\n<p>in such circumstances, case is to be quashed.<\/p>\n<p>           3.  Learned  counsel appearing for the<\/p>\n<p>Crmc 774\/10<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>petitioner,    respondents  1  to  3  and  learned<\/p>\n<p>Public Prosecutor were heard.\n<\/p>\n<p>           4. Annexure-A2    final   report   and<\/p>\n<p>Annexure-A3     judgment in C.C.280\/1992 show that<\/p>\n<p>prosecution case is that nine accused belong to<\/p>\n<p>RSS and de facto complainant, the      injured is<\/p>\n<p>member of INTUC and out of political animosity,<\/p>\n<p>accused     formed  themselves  into  an  unlawful<\/p>\n<p>assembly with the common object of causing hurt<\/p>\n<p>to respondents 1 to 3 and deceased Yasodharan,<\/p>\n<p>on 23\/6\/1992      at about   5.30 p.m armed with<\/p>\n<p>deadly weapons, like iron       pipes, sticks and<\/p>\n<p>swords, in furtherance of the common object<\/p>\n<p>caused     hurt  to   respondents  1   to  3   and<\/p>\n<p>Yasodharan by inflicting     injuries with sticks<\/p>\n<p>and swords after committing riot and thereby<\/p>\n<p>committed offences under Sections 143, 147, 148<\/p>\n<p>and 324     read with Section 149 of Indian Penal<\/p>\n<p>Crmc 774\/10<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>Code.       Annexure-A3   judgment    shows  that<\/p>\n<p>consequent to the       hostility shown by the de<\/p>\n<p>facto      complainant  and  the   injured, other<\/p>\n<p>prosecution     witnesses  were  not examined and<\/p>\n<p>learned Magistrate has acquitted eight of the<\/p>\n<p>alleged members of unlawful assembly. The only<\/p>\n<p>case       against  the   petitioner,   the  then<\/p>\n<p>absconding      accused,    in   the  light    of<\/p>\n<p>Annexure-A3 judgment, as there is no specific<\/p>\n<p>case of any over act as against the petitioner,<\/p>\n<p>there is no likelihood of a conviction, even if<\/p>\n<p>petitioner      is   to  be   tried.  More  over,<\/p>\n<p>affidavits filed by the respondents 1 to 3<\/p>\n<p>establish      that   they  have   settled  entire<\/p>\n<p>disputes with the petitioner and consequently,<\/p>\n<p>even if they are to be examined they will not<\/p>\n<p>give any evidence against the petitioner. The<\/p>\n<p>remaining injured is no more as is clear from<\/p>\n<p>Crmc 774\/10<br \/>\n<span class=\"hidden_text\">                        5<\/span><\/p>\n<p>Annexure-A4     death  certificates.   In   such<\/p>\n<p>circumstances,     even if petitioner is to be<\/p>\n<p>tried,     it would only result  in  unnecessary<\/p>\n<p>waste of valuable time of the court. Hence, it<\/p>\n<p>is not in the interest of justice to continue<\/p>\n<p>the prosecution.\n<\/p>\n<p>             Petition is allowed.
