No.423 of 2008\n           ------------------------------------------------\n           Dated this the 23rd day of October, 2008\n\n                         JUDGMENT\n<\/pre>\n<p>Koshy, J<\/p>\n<p>      The respondent\/writ petitioner and one<\/p>\n<p>Vijayakumaran      Nair        joined          the        service of<\/p>\n<p>Electricity Board as Electricity Worker in<\/p>\n<p>June, 1983. Both were promoted on the same<\/p>\n<p>date i.e. 01\/01\/1987 as Junior Line Assistant.<\/p>\n<p>On 30\/09\/1992, the respondent\/petitioner was<\/p>\n<p>promoted   as       Meter          Reader            skipping    the<\/p>\n<p>intermediary     cadre         of       Line        Assistant.    On<\/p>\n<p>17\/03\/1994     only          Vijayakumaran                 Nair  was<\/p>\n<p>promoted as Line Assistant and within five<\/p>\n<p>months, on 31\/08\/1994 he was further promoted<\/p>\n<p>as Meter Reader. Here, writ petitioner was<\/p>\n<p>promoted as Meter Reader on 30\/09\/1992 whereas<\/p>\n<p><span class=\"hidden_text\">W. A. No.423 of 2008          -2-<\/span><\/p>\n<p>      Vijayakumaran     Nair was     promoted       as   Meter<\/p>\n<p>      Reader only after two years i.e. on 31\/08\/1994.<\/p>\n<p>      Vijayakumaran Nair has salary in a higher pay<\/p>\n<p>      scale than the respondent\/petitioner because<\/p>\n<p>      in the lower category of Junior Line Assistant<\/p>\n<p>      he worked more years than the writ petitioner<\/p>\n<p>      and earned more increments. Therefore, the<\/p>\n<p>      learned Single Judge found that it is an<\/p>\n<p>      anomaly and the Writ Petitioner also should be<\/p>\n<p>      paid        as the same as    Vijayakumaran        Nair.<\/p>\n<p>      Respondent\/petitioner got promotion as Meter<\/p>\n<p>      Reader on 30\/09\/92. Vijayakumaran Nair got<\/p>\n<p>      promotion in August, 1994, after two years.<\/p>\n<p>      Merely because respondent\/petitioner got early<\/p>\n<p>      promotion, his salary cannot be less than the<\/p>\n<p>      salary of Vijayakumaran Nair. On the basis of<\/p>\n<p>      the decision in <a href=\"\/doc\/1259098\/\">Union of India v. O.P.Saxena<\/a> [(1997) 6 SCC<\/p>\n<p><span class=\"hidden_text\">W. A. No.423 of 2008           -3-<\/span><\/p>\n<p>      360] it was argued that this is not an anomaly<\/p>\n<p>      to be rectified in the pay revision order. We<\/p>\n<p>      are of the view that since Vijayakumaran Nair<\/p>\n<p>      and respondent\/Writ Petitioner were appointed<\/p>\n<p>      in the same month and promoted as Junior Line<\/p>\n<p>      Assistant       on the same  day  and   the  writ<\/p>\n<p>      petitioner was promoted in the cadre of Meter<\/p>\n<p>      Reader two years prior to Vijayakumaran Nair,<\/p>\n<p>      certainly this will be an anomaly and this has<\/p>\n<p>      to be rectified. Merely because for more years<\/p>\n<p>      Vijayakumaran      Nair  has   worked  than   the<\/p>\n<p>      respondent\/petitioner as    Junior Line Assistant,<\/p>\n<p>      respondent\/petitioner will not be denied the<\/p>\n<p>      right of stepping up his pay to that of his<\/p>\n<p>      junior.        In the  post  of   Meter   Reader,<\/p>\n<p>      Vijayakumaran Nair was junior to respondent\/<\/p>\n<p>      petitioner. We fully agree with the views of<\/p>\n<p><span class=\"hidden_text\">W. A. No.423 of 2008         -4-<\/span><\/p>\n<p>      the learned Single Judge.\n<\/p>\n<pre>               Appeal  fails   and  is      dismissed\n\n      accordingly.\n\n\n\n\n                                            J.
