      Appellant    has     preferred     this      appeal    under
\nSection 374(2) of the Code of Criminal Procedure,
\nbeing aggrieved by the judgment dated 28\/2\/2008
\npassed in Special Case No. 74\/2007 by Special Judge,
\nAtrocity, Panna, whereby the appellant has been
\nconvicted under Section 3(1)(xi) of the Scheduled
\nCastes & Scheduled Tribes (Prevention of Atrocities)
\nAct (hereinafter referred to as ‘the Act’) and sentenced
\nto undergo rigorous imprisonment for 6 months and
\nfine of Rs. 2,000\/-, with default stipulations.\n<\/p>\n
2.          Prosecution case in short was that                  on
\n8.10.2007    at    about    7       O’clock   in    the     evening
\ncomplainant Phoolabai (PW2) went to the flour mill of
\nthe appellant to fetch flour. It is alleged that when
\ncomplainant entered into the room to took her flour,
\n                           2<\/span><\/p>\n
appellant caught hold of her and told her that he
\nwants to intercourse with her. On this, complainant
\nabused the appellant and told him that she informed
\nher husband about the misdeed. The appellant told
\nher that she is free to say this fact to anyone he did
\nnot care for it. Complainant narrated the story to her
\nhusband, Chhanulal (PW3). Thereafter her husband
\nwent to the house of Sarpanch but he was not at
\nhome. On the next day when Sarpanch came, she and
\nher husband narrated the story to him and then
\nlodged a report on 9\/10\/2007 at 9.15 at Police
\nStation, Simariya.\n<\/p>\n
3.        After usual investigation, the appellant was
\ncharge sheeted before the Chief Judicial Magistrate,
\nPanna, who committed the case for trial to the Special
\nJudge, Atrocity. Learned Special Judge framed the
\ncharges against the appellant under Section 354 of
\nIPC and Section 3(1)(xi) of the Act. Appellant abjured
\nthe guilt and pleaded false implication and further
\npleaded that he only asked the money for grinding the
\nsaid flour. He examined Ramesh Lodhi (DW1) and
\nChhabirani (DW2) as his defence witnesses in his
\nfavour.\n<\/p>\n
4.        On appraisal of evidence on record, trial
\nCourt convicted and sentenced the appellant as
\nmentioned hereinabove. Hence this appeal.\n<\/p>\n
5.        Learned    counsel    for   the   appellant
\nsubmitted that the trial Court committed illegality in
\n                             3<\/span><\/p>\n
not appreciating the evidence on record in its proper
\nperspective. He further submitted that statement of
\nPhoolabai (PW2) has not corroborated by the medical
\nevidence, therefore he prays for setting aside the
\nimpugned judgment and conviction and sentence
\nrecorded against the appellant by the trial Court and
\nfurther prays for acquittal of the appellant.\n<\/p>\n
6.         On the other hand, learned counsel for the
\nState has supported and justified the impugned
\njudgment and finding of the Trial Court.\n<\/p>\n
7.         I have perused the impugned judgment,
\nevidence and other material on record.\n<\/p>\n
8.         Complainant Phoolabai (PW2) deposed that
\nat 7 O’clock in the evening     when she went to flour
\nmill of appellant to fetch the flour, the appellant was
\nstanding at the door of his flour mill. She further
\ndeposed that when she entered into the room to take
\nher flour, appellant followed her and caught hold of
\nher as well as told her that he wants to intercourse
\nwith her. She further deposed that it is shameful on
\nthe part of the appellant. She further deposed that the
\nappellant told her that she is free to narrate the fact to
\nanyone, then she narrated the incident to her
\nhusband. According to her, her husband went to
\nSarpanch but he was not available on the very day
\nthen next day her husband met with Sarpanch and
\nthen went for lodging the report alongwith Sarpanch
\nand lodged the report Ex.P\/3.\n<\/p>\n
                                 4<\/span><\/p>\n
9.           Her version was supported by her husband
\nChhanulal (PW3) and Sarpanch Ramlagan (PW6).\n<\/p>\n
10.          Chhanulal (PW3) admitted that he had
\nmoney    transaction     with       the   appellant   and   still
\nRs.700\/- is unpaid but he denied the suggestion that
\nhe has been falsely implicated to the appellant to
\navoid the payment of Rs.700\/-.\n<\/p>\n
11.          Though defence witnesses Ramesh Lodhi
\n(DW1) and Chhabirani (DW2) have stated that there
\nwas a dispute between the appellant and Chhanulal,
\nwhen Chhanulal came to take his flour but this fact
\nwas not put to the prosecutrix Phoolabai and her
\nhusband Chhanulal.        In this way defence witnesses
\nhave narrated different story then the prosecution
\nstory.   In these      circumstances, defence         has   not
\nappeared to be probable and consistent and rightly
\ndisbelieved by the trial Court. It is also not believable
\nthat a husband will stake reputation of his wife for
\navoiding the payment of only Rs. 700\/-, to the
\nappellant.\n<\/p>\n
12.          Learned     counsel          for   the   appellant
\nsubmitted that mere caught hold by accused to the
\nprosecutrix does not amount to an offence under
\nSection 354 of IPC. He placed reliance on 2008 (1)
\nMPWN 27, Ramratan Vs. State of M.P.. The fact of
\nthis case is different then the case relied on by the
\ncounsel for the appellant. In that case parties were
\ntensed relationship with each other as well as
\n                                5<\/span><\/p>\n
according to the prosecution story there was two eye
\nwitnesses who have not supported the version of
\nprosecution but in this case the incident was took
\nplace in the evening and according to the prosecution
\nstory itself there was no eye witness. In this case
\nprosecutrix not only deposed that appellant caught
\nhold of her but she further deposed that appellant told
\nher for intercourse. This fact is amount to use a
\ncriminal force with intention to outrage her modesty.
\nThe   version    of   the     prosecutrix   is   consistently
\nsupported      by her husband Chhanulal (PW3) and
\nsame is supported by FIR Ex.P\/3 and Ex.P\/4.\n<\/p>\n
13.         On perusal of the statement of prosecutrix
\nPhoolabai (PW2) and Chhanulal (PW3), husband of the
\nprosecutrix, I do not find anything in regard to their
\ncaste. Sarpanch Ramlagan (PW6) only stated that he
\nhad issued the caste certificate Ex.P\/6. On perusal of
\nEx.P\/6, it reveals that Phoolabai is Kumhar and
\nbelonging to Harijan caste, I am of the view that the
\ntrial Court committed illegality in believing the mere
\nthis certificate because prosecution is duty bound to
\nprove each and every ingredient of offence and
\nparticularly    the   caste    to   which    prosecutrix    \/
\ncomplainant belongs and same comes under the list of
\nScheduled Caste. Word ‘Harijan’ is not a caste, as
\nmentioned hereinabove, prosecutrix and her husband
\nhad not deposed regarding their caste. In these
\ncircumstances     prosecutrix       is   belonging   to    the
\nScheduled Caste is not proved on record.\n<\/p>\n
                                   6<\/span><\/p>\n
       14.         In the result, appeal is partly allowed and
\n       his conviction and sentence recorded under Section
\n       3(1)(xi) is hereby set aside and appellant is acquitted
\n       to the aforesaid charge.   But at the same time trial
\n       Court rightly found proved the basic offence under
\n       Section 354 of IPC. Same is hereby affirmed and
\n       looking to the facts and circumstances of the case,
\n       ends of justice would be met, if appellant be convicted
\n       for jail sentence already undergone two days and fine
\n       amount be      enhanced    from   Rs.   2,000\/-   to   Rs.
\n       10,000\/-.    Thus    the   sentence     is   altered    to
\n       aforementioned extent. Rs. 5,000\/- be paid to the
\n       prosecutrix as compensation under Section 357 of
\n       Code of Criminal Procedure.\n<\/p>\n
       15.         Appellant is on bail. His bail bond and
\n       surety bond stand cancelled. Appellant is directed to
\n       deposit enhanced fine amount within two months.\n<\/p>\n
       16.         Record of the trial Court be sent back
\n       alongwith copy of this judgment immediately for
\n       compliance and necessary action.\n<\/p>\n
