KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nKHARE, J.\n<\/p>\n<p>     By the  present appeals  the appellant,  State of U.P.,<br \/>\nquestions the  correctness of  the judgment  dated 27.2.1990<br \/>\nrendered by  the High  Court  of  Judicature  at  Allahabad,<br \/>\nacquitting the\trespondents herein  by allowing\t the appeals<br \/>\npreferred  by\tthe  respondents   and\tsetting\t  aside\t the<br \/>\nconvictions recorded against them by the Additional Sessions<br \/>\nJudge, Mainpuri.  Before we take up the arguments of learned<br \/>\ncounsel for  the appellant,  it is  necessary to set out the<br \/>\nprosecution case.\n<\/p>\n<p>     In short, the prosecution story is that on 22.2.1985 at<br \/>\nabout 2.30  p.m., in  village Nagla  pati,   Police  Station<br \/>\nBhongaon, District  Mainpuri, the  deceased  Kalicharan\t was<br \/>\nreturning from\tthe court  of SDM, Bhongaon, after attending<br \/>\nthe proceedings\t in his\t case.\tWhen Kalicharan reached near<br \/>\nthe house  of Ganga  Ram, the  accused Malkhan\ts\/o. Bhagwan<br \/>\nSingh armed  with country  made pistol,\t Sher Singh  son  of<br \/>\nBhagwan Singh armed with rifle, Bhagwan Singh son of Dhanpat<br \/>\narmed with  country made  pistol, Murari  son of  Ram Narain<br \/>\n(Murari died  during sessions  trial) armed  with gun,\tShri<br \/>\nKrishan son  of Bhola  Nath armed  with country\t made pistol<br \/>\n(Katta), Indrapal;  son of  Ram Bharose\t armed with  country<br \/>\nmade pistol,  Bhim Sen\tson  of\t Lakhan\t Singh,\t armed\twith<br \/>\ncountry made pistol and Netra Pal son of Bhagwan Singh armed<br \/>\nwith country  made pistol,  emerged behind  the fodder grass<br \/>\nand hut of Dampat Lal and on exhortation of Bhagwan Singh to<br \/>\nkill the  deceased, Kali  Charan, Sher Singh, Malkhan Singh,<br \/>\nShri Krishna  and Indrapal  fired at  Kalicharan with  their<br \/>\nkattas and  guns with  intention  of  killing  him.    After<br \/>\nhearing the  gun shots\tand hue\t and cry Bhopal son of Natho<br \/>\nRam, Ram  Chandar son of Parsadi.  Puttu son of Kalyan Singh<br \/>\nand the\t wife of  Kalicharan. Smt.  Laungshri came  rushing.<br \/>\nTika Ram  who was following Kalicharan from t he house, came<br \/>\nforward with  exhortation.  In order to save Kalicharan, his<br \/>\nwife Smt.  Laungshri  fell  upon  the  body  of\t Kalicharan,<br \/>\nBhagwan Singh  again exhorted  the accused  persons to\tkill<br \/>\nSmt. Laungshri.\t  On  such exhortation, Netra Pal and Murari<br \/>\nfired shots from their respective weapons on Smt. Laungshri.<br \/>\nKali Charan  and his  wife, Smt. Laungshri died at the spot.<br \/>\nThereafter, the\t accused dragged  the dead  bodies from\t the<br \/>\npace of\t occurrence towards  the direction of West and after<br \/>\ncrossing the  road, took  the bodies  to the Bitaura of Deva<br \/>\nJeet, where  they were attempting to burn the dead-bodies by<br \/>\nsprinkling kerosene  oil thereon.   Tika Ram, brother of the<br \/>\ndeceased, Kali Charan, orally lodged the F.I.R. on 22.2.1985<br \/>\nat about  3.15 p.m. at P.s. Bhongaon, District Manipuri.  On<br \/>\nthe basis  of the  report lodged  by Tika  Ram, a  case\t was<br \/>\nregistered at  General Diary  No.28 under Sections 147, 148,<br \/>\n307\/149, 302\/149  and 201  IPC, against the accused Malkhan,<br \/>\nSher Singh,  Bhagwan Singh, Murari, Shri Krishan, Indra Pal,<br \/>\nBhim Sen  and Netra  Pal.   Senior Sub\tInspector of  Police<br \/>\nSukhvir Singh, who started investigation of the incident, on<br \/>\nreaching the  spot, saw\t the dead  bodies which\t were  still<br \/>\nduring.\t    The\t Investigating\tOfficer\t with  the  help  of<br \/>\nvillagers who  were  collected\tat  the\t place,\t managed  to<br \/>\nextinguish the fire by pouring water on it and the bodies of<br \/>\nKali Charan  and his  wife Smt.\t Laungshri  were  recovered.<br \/>\nThereafter, the\t inquest report\t and plan  were prepared and<br \/>\nthe dead-bodies\t were sent  for post-mortem, by Shri Sukhbir<br \/>\nSingh.\t At this  stage, Senior\t Inspector (Police)  Bhogaon<br \/>\nundertook the  investigation of the cane in his hand.  Since<br \/>\nthe age\t and time  of death  of the  deceased could  not  be<br \/>\nascertained  by\t  Dr.  Gulecha,\t  Medical  Officer,   S.N.M.<br \/>\nHospital, Firozabad, who conducted the post mortem, the case<br \/>\nwas referred  to the  State  Medico-Legal  Expert,  for\t his<br \/>\nopinion. Dr. B.K. Saxena, Superintendent Balrampur Hospital,<br \/>\nLucknow, conducted  the second\tpost mortem  examination  of<br \/>\nboth the  bodies on  28.2.1985.\t  According to him, cause of<br \/>\ndeath was  due to  the injuries\t caused\t by  fire  arm\tante<br \/>\nmortem, and  the time  of death\t was  around  2.30  p.m.  on<br \/>\n22.2.1985.\n<\/p>\n<p>     The  learned   Sessions  Judge,   after  recording\t the<br \/>\ntestimony of  the witnesses,  held that\t the accused persons<br \/>\nare guilty  under sections  302\/147, 201\/149,  307\/143\tIPC.<br \/>\nThe accused  Bhagwan and  Netra Pal  were sentenced to dealt<br \/>\nunder Section  302 IPC\tand all other accused were sentenced<br \/>\nfor life  imprisonment.\t  Aggrieved by\tthe judgment  of the<br \/>\nlearned Sessions  Judge, Bhagwan  and  Netra  Pa;  preferred<br \/>\nCriminal  Appeal   No.2060\/88  while   Malkhan\tand   others<br \/>\npreferred Criminal  Appeal No.2048\/88 before the High Court.<br \/>\nThe High  Court allowed\t both  the  appeals  by\t its  common<br \/>\njudgment dated\t27.2.1990, which  is under  challenge in the<br \/>\npresent appeals.\n<\/p>\n<p>     Learned counsel for the appellant urged that there were<br \/>\nminor  discrepancies   in  the\t statements  of\t prosecution<br \/>\nwitnesses and  as such\ttheir testimony\t could not have been<br \/>\ndiscarded by  the High\tCourt.\t Counsel also urged that the<br \/>\ntestimony of the eye witnesses could not have been discarded<br \/>\nby the\tHigh Court merely because all the eye-witnesses were<br \/>\nfound to  be from  the same  family and\t had enmity with the<br \/>\naccused persons.   Since  these\t two  arguments\t are  inter-<br \/>\nlinked, we propose to deal with both the arguments together.<br \/>\nBefore we  proceed to  consider the arguments, we would like<br \/>\nto observe  here that,\tit is true that testimony of an eye-<br \/>\nwitness having minor discrepancies has to be given weightage<br \/>\nunless discrepancies  are such which demolish the basic case<br \/>\nof the\tprosecution.   similarly, the  testimony of  a\teye-<br \/>\nwitnesses who is partisan by itself is also not a ground for<br \/>\ndiscarding  the\t evidence  as  testimony  of  such  partisan<br \/>\nwitness\t necessarily   is  not\t false\tevidence,  but\tsuch<br \/>\ntestimony requires  thorough and careful scrutiny.  in light<br \/>\nof such legal position, we proceed to consider the arguments<br \/>\nadvanced on  behalf of\tthe appellant  in order to establish<br \/>\nthe case,  the prosecution  has examined  Tika\tRam  (PW.1),<br \/>\nBhopal(PW-2) and  Putta Lal  (PW-3), who  are eye witnesses.<br \/>\nFrom the  evidence on  record, as  well as the statements of<br \/>\nthese three eye witnesses, it is almost established that the<br \/>\neye-witnesses are  partisan witnesses  and had\tenmity\talso<br \/>\nwith some  of the accused directly.  The finding of the High<br \/>\nCourt that  these three witnesses are partisan witnesses and<br \/>\nhad enmity  with the  accused persons is consistent with the<br \/>\nevidence on  record.   The testimony  of such  eye-witnesses<br \/>\ncannot be  discarded on\t the ground  that they\tare partisan<br \/>\nwitnesses, but\ttheir testimony\t has to\t be judged with more<br \/>\ncircumspection.\t  The case  of the  prosecution as stated in<br \/>\nthe FIR\t was that  the incident\t in which Kalicharan and his<br \/>\nwife Laungshri\twas shot  dead, occurred  near the  house of<br \/>\nGangaram and the accused bad emerged at that time out of the<br \/>\nbut of Dammi Lal from behind the Kharpatwar.  In the present<br \/>\ncase,  the   investigating  officer  after  spot  inspection<br \/>\nprepared a  map of the place of occurrence shown as spot &#8216;A&#8217;<br \/>\nand &#8216;B&#8217;\t Spot &#8216;B&#8217;  is a place where Kalicharan, the deceased<br \/>\nwas first  shot at  and spot &#8216;A&#8217; is place where the deceased<br \/>\nKalicharan fell down.  The distance between the two spots is<br \/>\n40 paces.  Spot B  is situate  towards the eastern corner of<br \/>\nthe eastern  chabootra of  Ganga  Ram&#8217;s\t house.\t Spot  A  is<br \/>\nsituate at  north western corner of Lakhan&#8217;s house. Tika Ram<br \/>\n(PW-1) who is the brother of the deceased Kalicharan, in his<br \/>\ncross-examination has  stated that  Kalicharan was  fired at<br \/>\nnear the house of Lakhan and at that time he was at the gate<br \/>\nof   Lakhan and\t Gangaram. He further stated that Kalicharan<br \/>\nafter walking  one or  two paces  fell down Smt. Laungi-shri<br \/>\narrived and  fell upon\tthe body  of the deceased Kalicharan<br \/>\nand she\t too was shot and then both were murdered. According<br \/>\nto his\ttestimony, Kalicharan fell down after running one or<br \/>\ntwo paces after he was fired. The place of occurrence as set<br \/>\nout in the FIR becomes doubtful because the distance between<br \/>\nthe spots  A and  B is about 40 paces. It is also noticeable<br \/>\nthat no\t blood was  found at spot B where it is alleged that<br \/>\nKalicharan &#8211; the deceased was first fired. Similarly, Bhopal<br \/>\n(PW-2) stated  that Kalicharan received gun shot in front of<br \/>\nGangaram&#8217;s house and the deceased after walking 2 or 3 paces<br \/>\nhe fell\t down.\tAll  these  three  eye\twitnesses  in  their<br \/>\nrespective testimony  stated that kalicharan was first fired<br \/>\nat on  the spot\t &#8216;B&#8217; shown  in\tthe  map,  prepared  by\t the<br \/>\ninvestigating officer  which was  towards the  east side  in<br \/>\nfront of  the house of Gangaram. Kalicharan, thus, according<br \/>\nto these  eye witnesses,  thereupon ran\t towards  the  place<br \/>\nwhere the  accused were present and where he fell down after<br \/>\nwalking 2\/3  paces. The testimony of these eye witnesses are<br \/>\ntotally different  than the story set out in the FIR and the<br \/>\nstatement of  the eye  witnesses, as  recorded under Section<br \/>\n161 Cr.\t P.  C.\t For  these  reasons,  commencement  of\t the<br \/>\noccurrence at  the point &#8216;B&#8217; or firing at Kalicharan for the<br \/>\nfirst time becomes doubtful.\n<\/p>\n<p>     The further case, as set out in the FIR is that, on the<br \/>\nexhortation Sher  Singh, Malkhan  Singh,  Shri\tKrishna\t and<br \/>\nInder Pal  who were  armed with\t Kattas and  guns, fired  at<br \/>\nKalicharan when his wife Laungi Shri also fell upon his body<br \/>\nto save him. At this stage, Bhagwan Singh again exhorted and<br \/>\nthen Netra  Pal and Murari fired at Smt. Langshri with katta<br \/>\nand gun,  whereas Tika\tRam (PW\t 1) is\this testimony stated<br \/>\nthat on\t the  exhortation  of  Bhagwan\tSingh,\tSher  Singh,<br \/>\nMalkhan Singh,\tShri Krishna  and Indra\t Pal Kalicharan\t was<br \/>\nfired whereupon\t Smt. Langshri fell upon Kalicharan&#8217;s person<br \/>\nin order  to save  him. At  that stage\tBhagwan Singh  again<br \/>\nexhorted to  kill Smt.\tLaungshri, as she has become an eye-<br \/>\nwitness, Murari\t and Netra  Pal and  Bhagwan fired  at\tSmt.<br \/>\nLaungshri. Curiously  enough, Tika Ram (PW 1), in his cross-<br \/>\nexamination stated that Kalicharan was first fired at by Sri<br \/>\nKrishna, Sher  Singh Malkhan  Singh, Netra Pal and Bheem Sen<br \/>\ntogether at  the gate  of Ganga\t Ram. However,\tthis witness<br \/>\nalso added  the name  of Bhimsen  as well amongst the person<br \/>\nwho alleged  to have fired for the first time at Kalicharan,<br \/>\nwhich was  not the  case of the prosecution. Similarly, Tika<br \/>\nRam mentioned  the names  of Netra Pal among those who fired<br \/>\nfor the\t first time and also Bhagwan Singh along with Murari<br \/>\nand Netra  Pal as  co-murderers, which\twas at variance with<br \/>\nthe case  in F.I.R.  Bhopal (PW\t 2), in his testimony stated<br \/>\nthat Murari, Bheem Sen and Netra Pal fired at Smt. Laungshri<br \/>\nwhich is not the case in the FIR. According to Puttu Lal (PW\n<\/p>\n<p>3), he after having heard the noise, arrived at the place of<br \/>\noccurrence. According  to him, Sher Singh shot at Kalicharan<br \/>\nin his\tpresence. On  exhortation of  Bhagwan Singh  to kill<br \/>\nSmt. Laungshri\tas she\thas become  an eye-witness,  Murari,<br \/>\nNetra Pal  and Bheem  Sen fired\t at Smt. Laungshri, Tika Ram<br \/>\nwas the\t real brother  of the deceased Kalicharan and Bhopal<br \/>\n(PW 2)\twas an\taccused in  the case of murder of the son of<br \/>\naccused Bhawan\tSingh and  if the  cause of  murder of\tSmt.<br \/>\nLaungshri was her becoming an eye witness, then it that case<br \/>\nTika Ram  (PW 1)  and  Bhopal  (PW  2)\twho  were  following<br \/>\nKalicharan ought  to have  been shot  at. Thus reasoning for<br \/>\nkilling\t Smt.\tLaungshri  renders  the\t testimony  of\teye-<br \/>\nwitnesses as  unreliable. Further, Tika Ram (PW 1) stated in<br \/>\nthe FIR\t that the accused fired at him when he was 7\/8 paces<br \/>\nbehind Kalicharan  the deceased.  But, curiously  enough, he<br \/>\nstated that  he did not receive any injury as he hid himself<br \/>\ninto the  trench of kachcha road. The place where he alleged<br \/>\nto have\t hid himself  from where he witnessed the occurrence<br \/>\nwas not\t exhibited in  the map. The fact that Kalicharan had<br \/>\nnot received  any injury  coupled with other facts as stated<br \/>\nabove, makes  his presence doubtful as an eye witness at the<br \/>\nplace of  occurrence. Putta  Lal (PW  3)  in  his  testimony<br \/>\nstated that when gun shot was fired, he took his own gun and<br \/>\narrived at near\t Mathia which is 16 paces towards south east<br \/>\nfrom  the   point  `B&#8217;\tand  from  there  he  witnessed\t the<br \/>\noccurrence. This  witness stated that he has shown the place<br \/>\nof hiding  to the  Investigating Officer, but such place has<br \/>\nnot been  exhibited in\tthe map.  The FIR  further discloses<br \/>\nthat the  accused    persons  dragged  the  dead  bodies  of<br \/>\nKalicharan and Smt. Lungshri from the place of occurrence to<br \/>\nbitaura of  Deojeet and\t sprinkled kerosene  oil thereon and<br \/>\nwere going  to ignite  the fire.  This part  of\t the  F.I.R.<br \/>\nsuggests that  PWs-1 and  2, after  witnessing the sprinkled<br \/>\nkerosene oil  on the  dead  bodies,  rushed  to\t the  police<br \/>\nstation. Tika  Ram (PW\t1), in\this statement stated that as<br \/>\nsoon as\t the accused  persons commenced\t dragging   the dead<br \/>\nbodies of  the deceased persons, he fled away from there. He<br \/>\ncould not  be see sprinkling of kerosene oil and also he did<br \/>\nnot get\t the facts  ascribed in\t the FIR.  Similarly,  PW  2<br \/>\n(Bhopal) stated that he remained in hiding till the time the<br \/>\ndead bodies  were taken\t to Pitaura  and the  accused person<br \/>\nwere going  to ignite the fire having sprinkled kerosene oil<br \/>\non the\tdead bodies  and as soon as the accused persons were<br \/>\nabout to  ignite fire  he left for the police station. Here,<br \/>\nwere find  contradiction in  testimony of  PW 2\t and  PW  1,<br \/>\nBhopal and  Tika Ram  &#8211; respectively, and such contradiction<br \/>\nbecomes very relevant when the investigating officer did not<br \/>\nrecord the  statement of  any of  the eye witnesses named in<br \/>\nthe FIR on the first day although he arrived at the place of<br \/>\noccurrence at  about  3.30  P.M.  Non-recording\t of  such  a<br \/>\nstatement  on  the  day\t of  occurrence\t despite  sufficient<br \/>\nopportunity  to\t  record   it\traises\t doubt\t about\t the<br \/>\nauthentically of  the contents\tof  the\t FIR  and  also\t the<br \/>\ntestimony of  the eye  witnesses. There are many other vital<br \/>\ndiscrepancies in the testimony of the eye witnesses inasmuch<br \/>\nas the\ttestimony of  the witnesses are at variance with the<br \/>\ncase set  out in  the First  Information Report and as such,<br \/>\nthe High  Court was justified in discarding the testimony of<br \/>\nthe witnesses.\tThe High Court has correctly appreciated the<br \/>\nevidence and  at no  stretch of\t imagination it\t can be said<br \/>\nthat the  findings recorded  by the High Court are perverse.<br \/>\nFor these  reasons there  is no\t merit in these appeals.
