(oral)<\/p>\n<p>             This regular second appeal is directed against the judgment and<\/p>\n<p>decree dated 17.7.1990 passed by the learned Additional District Judge,<\/p>\n<p>Jalandhar allowing an appeal filed by the plaintiff-respondent against the<\/p>\n<p>judgment and decree passed by the learned Sub Judge First Class, Jalandhar<\/p>\n<p>dismissing the suit filed by the plaintiff-respondent.<\/p>\n<p>             The respondent\/plaintiff was appointed as constable in Punjab<\/p>\n<p>Armed Police and he joined his duties on 10.9.1981 at Jalandhar. He<\/p>\n<p>successfully completed his training\/recruitment course and worked as<br \/>\n<span class=\"hidden_text\"> RSA No.173 of 1991                                              2<\/span><\/p>\n<p>constable at various places to the entire satisfaction of his superiors. He did<\/p>\n<p>not earn any adverse report. His services were terminated on 21.3.1983 by<\/p>\n<p>the Commandant. The appellant challenged the order of termination by<\/p>\n<p>claiming it to be     illegal, ultra-vires, arbitrary, without jurisdiction and<\/p>\n<p>against the principles of natural justice.\n<\/p>\n<p>             The order was passed under Rule 12.21 of the Punjab Police<\/p>\n<p>Rules (for short the Rules). It was claimed that it was not passed by the<\/p>\n<p>competent authority and further the provisions of Rule 12.21 of the Rules<\/p>\n<p>were not complied with in this case.\n<\/p>\n<p>             The plaintiff\/respondent claimed that several representations<\/p>\n<p>were made for reviewing the order but no steps were taken to review the<\/p>\n<p>same and thus, the suit was filed.\n<\/p>\n<p>             Suit was contested on the ground that the appellant was not<\/p>\n<p>found likely, to be a good and efficient police officer as such he was<\/p>\n<p>discharged from service under Rule 12.21 of the Rules.<\/p>\n<p>             Other allegations were denied.\n<\/p>\n<p>             On the pleadings of the parties the following issues were<\/p>\n<p>framed:-\n<\/p>\n<blockquote><p>             1.     Whether the order dated 21.3.1983 by virtue of which<\/p>\n<p>                    the plaintiff was discharged from the service is illegal,<\/p>\n<p>                    null and void? OPP<\/p>\n<blockquote><p>             2.     Whether the suit is not maintainable in the present<\/p>\n<p>                    form?OPD<\/p>\n<\/blockquote>\n<blockquote><p>             3.     Relief.\n<\/p><\/blockquote>\n<blockquote><p>             The suit was dismissed.<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> RSA No.173 of 1991                                             3<\/span><\/p>\n<p>             In appeal a plea was taken that no material was placed on<\/p>\n<p>record to prove that the appellant was not likely to prove to be a good police<\/p>\n<p>officer as periodical reports at the intervals of six months by the Sub<\/p>\n<p>Inspector or Inspector of Police under whom the respondent\/plaintiff<\/p>\n<p>worked were not produced and considered. Thus, it was claimed that the<\/p>\n<p>discharge of the appellant under Rule 12.21 of the Rules was illegal.<\/p>\n<p>             Learned counsel appearing on behalf of the appellant<\/p>\n<p>vehemently contends that the judgment and decree passed by the learned<\/p>\n<p>lower appellate court cannot be sustained as under Rule 12.21 of the Rules<\/p>\n<p>constable can be discharged from service on the subjective satisfaction of<\/p>\n<p>the competent authority. It is also the contention of the learned counsel for<\/p>\n<p>the appellant\/State that the Superintendent of Police was competent to pass<\/p>\n<p>order under Rule 12.21 of the Rules which could not be the subject-matter<\/p>\n<p>of judicial scrutiny.\n<\/p>\n<p>             Learned counsel appearing on behalf of the respondent\/<\/p>\n<p>plaintiff, however, contends that order under Rule 12.21 can be by way of<\/p>\n<p>punishment. The court can see whether order is of simple discharge or<\/p>\n<p>passed on other material. In support of this contention respondent has<\/p>\n<p>placed reliance on the judgment of Hon&#8217;ble Supreme Court in the case of<\/p>\n<p>Smt.Rajinder Kaur Vs. Punjab State and another AIR 1986 SC 1790<\/p>\n<p>(1), wherein Hon&#8217;ble Supreme Court has been pleased to lay down as<\/p>\n<p>under:-\n<\/p>\n<blockquote><p>             &#8220;13. On a conspectus of all these decisions mentioned<\/p>\n<p>             hereinbefore, the irresistible conclusion follows that the<\/p>\n<p>             impugned order of discharge though couched in innocuous<br \/>\n<span class=\"hidden_text\"> RSA No.173 of 1991                                             4<\/span><\/p>\n<p>            terms, is merely a comouflage for an order of dismissal from<\/p>\n<p>            service on the ground of misconduct. This order has been made<\/p>\n<p>            without serving the appellant any charge-sheet, without asking<\/p>\n<p>            for any explanation from her and without giving any<\/p>\n<p>            opportunity to show cause against the purported order of<\/p>\n<p>            dismissal from service and without giving any opportunity to<\/p>\n<p>            cross-examine the witnesses examined, that is, in other words<\/p>\n<p>            the order has been made in total contravention of the provisions<\/p>\n<p>            of Art. 311(2) of the Constitution. The impugned order is,<\/p>\n<p>            therefore liable to be quashed and set aside. A writ of certiorari<\/p>\n<p>            be issued on the respondents to quash and set aside the<\/p>\n<p>            impugned order dated 9.9.1980 of her dismissal from service. A<\/p>\n<p>            writ in the nature of mandamus and appropriate directions be<\/p>\n<p>            issued to allow the appellant to be reinstated in the post from<\/p>\n<p>            which she has been discharged The appeal is thus allowed with<\/p>\n<p>            costs. The authorities concerned will pay all her emoluments to<\/p>\n<p>            which she is entitled to in accordance with the extant rules as<\/p>\n<p>            early as possible in any case not later than eight weeks from the<\/p>\n<p>            date of this judgment.&#8221;\n<\/p><\/blockquote>\n<p>.           Learned counsel for the respondent also placed reliance on the<\/p>\n<p>judgment of this court in RSA No.1224 of 1986 titled Sat Paul, Ex-<\/p>\n<p>Constable Vs. Punjab State decided on 27.5.1988.<\/p>\n<p>            Learned counsel for the respondent further placed reliance on<\/p>\n<p>the judgment of this court in the case of Punjab State Vs. Joginder Singh,<\/p>\n<p>Ex-Constable 1989 (3) SLR 665          to contend that in the absence of<br \/>\n<span class=\"hidden_text\"> RSA No.173 of 1991                                            5<\/span><\/p>\n<p>periodical reports of the Sub Inspector under whom the constable is working<\/p>\n<p>the order under Rule 12.21 of the Rules cannot be sustained. This court has<\/p>\n<p>been pleased to lay down as under:-\n<\/p>\n<blockquote><p>            &#8220;6.   There is absolutely no material on the record to prove<\/p>\n<p>            that the plaintiff was not likely to prove a good police officer<\/p>\n<p>            for which he could be discharged from service under Rule<\/p>\n<p>            12.21 of the Rules. Rule 19.5(1) of the Rules,provides as<\/p>\n<p>            follows:-\n<\/p><\/blockquote>\n<blockquote><p>                  &#8220;The fact that a recruit has been passed into the ranks<\/p>\n<p>                  under rule 19.3 shall not be taken to mean that he is a<\/p>\n<p>                  fully trained constable. A constable under three years&#8217;<\/p>\n<p>                  service is at any time liable to discharge under rule<\/p>\n<p>                  12.21. During the whole of this period he shall be kept<\/p>\n<p>                  under close supervision and reported on at intervals of<\/p>\n<p>                  six months in Form 19.5 (1) by the Sub Inspector or<\/p>\n<p>                  Inspector under whom he is working through his<\/p>\n<p>                  gazetted officer to the Superintendent of Police.<\/p>\n<\/blockquote>\n<blockquote><p>                         The orderly head-constable shall maintain a list of<\/p>\n<p>                  constables under three years&#8217; service. He shall submit the<\/p>\n<p>                  name of each man a month before he is due from<\/p>\n<p>                  confirmation to the Superintendent together with his<\/p>\n<p>                  personal file which shall contain the form 19.5(1)<\/p>\n<p>                  referred to in this rule.\n<\/p><\/blockquote>\n<blockquote><p>                         Gazetted officers are expected to make themselves<\/p>\n<p>                  acquainted as far as possible with the character and<br \/>\n<span class=\"hidden_text\"> RSA No.173 of 1991                                               6<\/span><\/p>\n<p>                   career of all constables under three years&#8217; service and<\/p>\n<p>                   shall be responsible that the name of men unlikely to<\/p>\n<p>                   make efficient police officers are brought to the notice of<\/p>\n<p>                   the Superintendent.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                   It is evident from the said rule that the constable shall be<\/p>\n<p>             kept under close supervision and reported on at intervals of six<\/p>\n<p>             months in Form 19.5(1) by the Sub Inspector or Inspector under<\/p>\n<p>             whom he is working through his gazetted officer to the<\/p>\n<p>             Superintendent of Police. No such six-monthly report has been<\/p>\n<p>             brought on the record      on behalf of the defendants In the<\/p>\n<p>             circumstances, there is no illegality in the concurrent findings<\/p>\n<p>             of the two Courts below as to be interfered with in second<\/p>\n<p>             appeal.&#8221;<\/p><\/blockquote>\n<p>             The case in hand is squarely covered by the decision of this<\/p>\n<p>court in the case of Punjab State Vs.
