Plaintiff filed Regular Civil Suit No.<br \/>\n1418 of 1972 for permanent injunction against the defendants<br \/>\nrestraining them from obstructing his right of way from eastern side<br \/>\nof Survey No. 522 for going to his Survey No. 518 which is of his<br \/>\nownership and possession. The said suit was decided by  3rd<br \/>\nJoint Civil Judge [Junior Division], Vadodara, who, after recording<br \/>\noral depositions and considering documentary evidence decreed the<br \/>\nsuit and restrained the defendants from disturbing possession of the<br \/>\nplaintiff and from causing any hindrance from using the way from the<br \/>\neastern Shedha of Survey No. 522 for going to his Survey No. 518.<br \/>\nBeing aggrieved by the said judgment and decree, the respondent<br \/>\nno.1-defendant no.1 preferred Civil Appeal No. 50 of 1978  before the<br \/>\nAssistant Judge, Vadodara, who, vide judgment and order dated 15th<br \/>\nSeptember 1979 allowed the appeal and set aside the judgment and<br \/>\ndecree passed by the trial court.\n<\/p>\n<p>3.<br \/>\n\tMr Jitendra M Patel, learned advocate appearing for the appellant<br \/>\nsubmitted that the judgment and order passed by the  lower appellate<br \/>\ncourt is contrary to law and against the evidence on record of the<br \/>\ncase.  Learned lower appellate court held that the plaintiff has duly<br \/>\nproved that he is in possession of Survey No. 518 and has right of<br \/>\nway through Survey No. 522, but committed egregious error in allowing<br \/>\nthe appeal of defendant no.1. Thus, there was total non-application<br \/>\nof mind by the learned appellate Judge while allowing the appeal by<br \/>\nwriting cryptic judgment without assigning adequate reasons. The<br \/>\nlearned appellate Judge, while allowing the appeal, has not<br \/>\nconsidered the evidence on record which was produced by the appellant<br \/>\nand thus, the order passed by the learned appellate Judge suffers<br \/>\nfrom infirmity and therefore, it deserves to be quashed and set<br \/>\naside. Learned advocate further placed reliance on the documentary<br \/>\nevidence such as Hakka Patrak at Exh.30, auction proceedings at<br \/>\nExh.33, Khata of plaintiff at Exh.31 and land revenue receipts at<br \/>\nExhs. 36 to 48 in support of the contention that the plaintiff had<br \/>\nright of way as claimed in the plaint. The appellate Judge has, thus,<br \/>\ncommitted an error in appreciating the evidence on the record of the<br \/>\ncase and as he has not assigned reasons while allowing the appeal,<br \/>\nthe appeal deserves consideration and the judgment and order passed<br \/>\nby the appellate Judge requires to be quashed and set aside and the<br \/>\njudgment and decree dated 21.11.1977 passed by the  learned 3rd<br \/>\nJoint Civil Judge [Junior Division], Vadodara in Civil Suit No. 1418<br \/>\nof 1972 requires to be restored.\n<\/p>\n<p>4.<br \/>\n\tMr Mehta for Nanavati Associates, learned advocate for the<br \/>\nrespondents submitted that considering the reasons assigned by the<br \/>\nlearned appellate Judge, no interference is called for in the appeal.<br \/>\nLearned appellate Judge has appreciated the evidence on record of the<br \/>\ncase in its true perspective and as no substantial question of law is<br \/>\ninvolved in the appeal, the appeal deserves to be dismissed. Learned<br \/>\nadvocate also placed reliance on the reasoning given by the learned<br \/>\ntrial Judge and submitted that as the trial court has committed gross<br \/>\nerror in allowing the suit and passing consequential order of decree<br \/>\nwithout appreciating the evidence on the record of the case, the same<br \/>\nwas set aside in  appeal by the learned appellate Judge by assigning<br \/>\nadequate reasons and, therefore, no interference is called for in the<br \/>\nappeal and it deserves to be dismissed.\n<\/p>\n<p>5.<br \/>\n\tI have heard the learned advocate Mr J.M. Patel, for the  appellant<br \/>\nand Mr Mehta, learned advocate for the respondents at length and in<br \/>\ngreat detail. Record and proceedings which are produced in the<br \/>\npresent case are carefully taken into consideration by me. I have<br \/>\nalso perused the reasons assigned by the appellate court in Civil<br \/>\nAppeal No. 50 of 1978 as well as the reasons given by the trial court<br \/>\nwhile deciding Regular Civil Suit No. 1418 of 1972. Documentary<br \/>\nevidence which has been placed on the record of the case is taken<br \/>\ninto consideration by me.  I have also perused  Hakka Patrak at<br \/>\nExh.30, auction proceedings at Exh.33, Khata of plaintiff at Exh.31,<br \/>\nFasal Patrak at Exh.32 and land revenue receipts at Exhs. 36 to 48 as<br \/>\nwell as oral depositions adduced by both the parties in the suit.<br \/>\nEven the defendant has admitted in his cross-examination that<br \/>\nplaintiff had right of way as claimed by him in the suit plaint.<br \/>\nConsidering the aforesaid fact and overwhelming documentary evidence<br \/>\nwhich is produced in the present case, the learned appellate court,<br \/>\nin my view, has committed an error in allowing the Appeal and in<br \/>\nsetting aside the judgment and decree of he trial court. The learned<br \/>\nappellate court has not only committed an error in appreciating the<br \/>\nevidence on the record of the case, but has also committed an error<br \/>\nin framing points which are as under:-\n<\/p>\n<p>[1]\tWhether<br \/>\nthe plaintiff has duly proved that he was in possession of S.No. 518<br \/>\nand that he had a right of way through S.No. 522?\n<\/p>\n<p>[2]\tWhether<br \/>\nthe omission of issue with regard to the adverse possession has<br \/>\ncaused any injuries and if so whether the matter should be sent back<br \/>\nto the trial court for deciding such an issue?\n<\/p>\n<p>[3]\tWhat<br \/>\norder?\n<\/p>\n<p>\tThen the<br \/>\nlearned appellate court has recorded findings to the said points<br \/>\nwhich are as under:-\n<\/p>\n<p>[1]\tIn<br \/>\nthe affirmative.\n<\/p>\n<p>[2]\tFirst<br \/>\npart in the negative and second part not necessary.\n<\/p>\n<p>[3]\tAs<br \/>\nper order below.\n<\/p>\n<p>\t\tAfter<br \/>\nconsidering the rival submissions, it has been observed in para-12 of<br \/>\nthe judgment as under:-\n<\/p>\n<p> In<br \/>\nlight of the findings it is not necessary to send back the matter to<br \/>\nthe trial court for deciding the adverse possession of the<br \/>\ndefendants. In the result I find no merit in this appeal and the same<br \/>\nrequires to be allowed with costs.\n<\/p>\n<p>\t\tThereafter,<br \/>\nthe appeal was allowed with cost. Thus, the learned appellate court,<br \/>\non one hand, while framing  point no.1 with regard to possession of<br \/>\nthe plaintiff and  his right of way through Survey No. 522 held in<br \/>\nthe affirmative and thereafter in final para, he has observed that<br \/>\nthere is no merit in the appeal, and therefore, instead of dismissing<br \/>\nthe appeal, he allowed the appeal with cost. This observation by the<br \/>\nlearned appellate court, as stated herein above, speaks volumes about<br \/>\nthe perfunctory and casual manner in which the appeal is heard and<br \/>\ndecided by him. Be that as it may. In view of the overwhelming<br \/>\ndocumentary evidence and oral depositions adduced by the respective<br \/>\nparties, the appeal, in my view, requires to be allowed.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the Second Appeal is allowed. Judgment and<br \/>\norder dated 15th<br \/>\nSeptember 1979 passed by the learned Assistant Judge, Vadodara, in<br \/>\nCivil Appeal No. 50 of 1978 is hereby  quashed and set aside and the<br \/>\njudgment and decree dated 21st<br \/>\nNovember, 1977, passed by 3rd<br \/>\nJoint Civil Judge [Junior Division], Vadodara, in Regular Civil Suit<br \/>\nNo. 1418 of 1972 by which the trial court, after going through the<br \/>\nentire evidence in its true perspective has allowed the suit of the<br \/>\noriginal plaintiff and decreed the same against the defendant,<br \/>\nis confirmed and the said<br \/>\norder restraining the defendants from disturbing the plaintiff from<br \/>\nusing his way on the eastern side of Shedha of Survey No. 522 for<br \/>\ngoing to his Survey No. 518, is restored.\n<\/p>\n<p>[H.B.\n<\/p>\n<p>ANTANI, J.]<\/p>\n<p>pirzada\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vipinbhai vs Parshotambhai on 15 July, 2010 Author: H.B.Antani,&amp;Nbsp;
