\n                through\u00a0Apex\u00a0Medical\u00a0Board\u00a0in\u00a0strict\u00a0compliance\u00a0to\u00a0Medical\u00a0
\n               jurisprudence \u00a0 and \u00a0 the \u00a0 decision \u00a0 of \u00a0 the \u00a0 said \u00a0 board\u00a0 should \u00a0 be\u00a0
\n               binding\u00a0on\u00a0both\u00a0sides.\u00a0\u00a0Management\u00a0is\u00a0directed\u00a0to\u00a0arrange\u00a0for\u00a0
\n               the\u00a0said\u00a0Medical\u00a0Board\u00a0within\u00a0the\u00a0three\u00a0months\u00a0from\u00a0the\u00a0date\u00a0
\n               of\u00a0publication\u00a0of\u00a0this\u00a0award\u00a0in\u00a0the\u00a0Gazette\u00a0of\u00a0India.\n<\/p>\n

respondents\u00a0and\u00a0the\u00a0respondents\u00a0have\u00a0written\u00a0a\u00a0letter\u00a0dated\u00a023rd\u00a0February,\u00a0<\/p>\n
2007,\u00a0which\u00a0is\u00a0at\u00a0Annexure\u00ad4\u00a0to\u00a0the\u00a0memo\u00a0of\u00a0petition,\u00a0that\u00a0the\u00a0medical\u00a0<\/p>\n
board\u00a0has\u00a0examined\u00a0the\u00a0petitioner\u00a0and\u00a0the\u00a0age\u00a0of\u00a0the\u00a0petitioner\u00a0has\u00a0been\u00a0<\/p>\n
found\u00a0within\u00a0the\u00a0range\u00a0of\u00a053\u00a0to\u00a063\u00a0years\u00a0as\u00a0on\u00a0date\u00a0of\u00a0superannuation\u00a0i.e.\u00a0<\/p>\n
27th\u00a0October,\u00a01999.\u00a0\u00a0The\u00a0last\u00a0paragraph\u00a0of\u00a0the\u00a0said\u00a0letter\u00a0reads\u00a0as\u00a0under:\u00ad<\/p>\n
                     “Taking \u00a0 into \u00a0 account \u00a0 of \u00a0 range \u00a0 of \u00a0 age \u00a0 as \u00a0 per\u00a0
\n               findings\/opinion \u00a0 of \u00a0 the \u00a0 Apex \u00a0 Medical \u00a0 Board, \u00a0 your \u00a0 age \u00a0 was\u00a0
\n               determined\u00a0to\u00a0have\u00a0been\u00a0in\u00a0the\u00a0range\u00a0of\u00a053\u00a0to\u00a063\u00a0years\u00a0on\u00a0the\u00a0
\n               date \u00a0 of \u00a0 your \u00a0 superannuation \u00a0 (i.e. \u00a0 on \u00a0 27.10.1999).\u00a0
\n               Accordingly,\u00a0the\u00a0date\u00a0of\u00a0retirement\u00a0from\u00a0the\u00a0services\u00a0of\u00a0the\u00a0
\n               Company \u00a0 on \u00a0 attaining \u00a0 the \u00a0 age \u00a0 of \u00a0 superannuation, \u00a0 i.e.\u00a0
\n               27.10.2006 \u00a0 which \u00a0 has \u00a0 already \u00a0 been \u00a0 accepted \u00a0 and \u00a0 further\u00a0
\n               confirmed\u00a0by\u00a0the\u00a0findings\u00a0of\u00a0the\u00a0said\u00a0Apex\u00a0Medical\u00a0Board.\n<\/p>\n

4.    Thus, \u00a0 petitioner’s \u00a0 date \u00a0 of \u00a0 superannuation \u00a0 was \u00a0 finalised \u00a0 by \u00a0 the\u00a0<\/p>\n
respondents \u00a0 as \u00a0 27th\u00a0 October, \u00a0 2006. \u00a0 \u00a0 In \u00a0 fact, \u00a0 the \u00a0 petitioner \u00a0 was \u00a0 wrongly\u00a0<\/p>\n
superannuated \u00a0 on \u00a0 27th\u00a0 October, \u00a0 1999. \u00a0 \u00a0 It \u00a0 is \u00a0 further \u00a0 submitted \u00a0 by \u00a0 the\u00a0<\/p>\n
counsel\u00a0for\u00a0the\u00a0petitioner\u00a0that\u00a0thereafter\u00a0the\u00a0respondents\u00a0issued\u00a0a\u00a0letter\u00a0<\/p>\n
dated \u00a0 4th\u00a0 August, \u00a0 2007 \u00a0 (Annexure\u00ad5) \u00a0 that \u00a0 in \u00a0 earlier \u00a0 letter \u00a0 dated \u00a0 23rd\u00a0<\/p>\n
February,\u00a02007\u00a0there\u00a0is\u00a0some\u00a0error,\u00a0therefore,\u00a0corrigendum\u00a0was\u00a0issued\u00a0in\u00a0a\u00a0
\n partial \u00a0 modification \u00a0 and \u00a0 instead \u00a0 of \u00a0 27th\u00a0 October, \u00a0 2006 \u00a0 the \u00a0 date \u00a0 of\u00a0<\/p>\n
superannuation\u00a0will\u00a0now\u00a0read\u00a0as\u00a027th\u00a0October,\u00a01999.\u00a0\u00a0Thus,\u00a0it\u00a0is\u00a0submitted\u00a0<\/p>\n
by\u00a0the\u00a0counsel\u00a0for\u00a0the\u00a0petitioner\u00a0that\u00a0the\u00a0date\u00a0of\u00a0superannuation\u00a0even\u00a0after\u00a0<\/p>\n
medical\u00a0examination\u00a0is\u00a0refixed\u00a0as\u00a0the\u00a0same\u00a0i.e.\u00a027th\u00a0October,\u00a01999\u00a0and\u00a0the\u00a0<\/p>\n
Industrial\u00a0Tribunal\u00a0has\u00a0also\u00a0not\u00a0finally\u00a0decided\u00a0the\u00a0reference\u00a0and\u00a0therefore,\u00a0<\/p>\n
the \u00a0 matter \u00a0 be \u00a0 remanded \u00a0 for \u00a0 its \u00a0 final \u00a0 decision \u00a0 upon \u00a0 the \u00a0 terms \u00a0 of \u00a0 the\u00a0<\/p>\n
reference \u00a0 and \u00a0 also \u00a0 keeping \u00a0 in \u00a0 view \u00a0 the \u00a0 further \u00a0 development \u00a0 about \u00a0 the\u00a0<\/p>\n

5.     Learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 respondents \u00a0 submitted \u00a0 that \u00a0 the \u00a0 petitioner\u00a0<\/p>\n
was\u00a0examined\u00a0\u00a0by\u00a0the\u00a0Apex\u00a0Medical\u00a0Board\u00a0constituted\u00a0by\u00a0the\u00a0respondents,\u00a0<\/p>\n
as\u00a0 directed \u00a0 by \u00a0 the \u00a0Central \u00a0 Industrial \u00a0 Tribunal \u00a0No.2, \u00a0 Dhanbad \u00a0 and \u00a0 upon\u00a0<\/p>\n
examination\u00a0of\u00a0petitioner,\u00a0it\u00a0is\u00a0true\u00a0that\u00a0initially\u00a0a\u00a0letter\u00a0was\u00a0written\u00a0by\u00a0the\u00a0<\/p>\n
respondent \u00a0 dated \u00a0 23rd\u00a0 February, \u00a0 2007 \u00a0 wherein \u00a0 a \u00a0 new \u00a0 date \u00a0 of\u00a0<\/p>\n
superannuation\u00a0was\u00a0finalised\u00a0as\u00a027th\u00a0October,\u00a02006\u00a0which\u00a0was\u00a0found\u00a0to\u00a0be\u00a0<\/p>\n
erroneous\u00a0and\u00a0therefore,\u00a0again\u00a0a\u00a0letter\u00a0was\u00a0written\u00a0dated\u00a04th\u00a0August,\u00a02007\u00a0<\/p>\n
(Annexure\u00ad5)\u00a0and\u00a0a\u00a0corrigendum\u00a0was\u00a0issued\u00a0to\u00a0the\u00a0effect\u00a0that\u00a0instead\u00a0of\u00a0<\/p>\n
27th\u00a0 October, \u00a0 2006 \u00a0 a \u00a0 new \u00a0 date \u00a0 27th\u00a0 October, \u00a0 1999 \u00a0 will \u00a0 be \u00a0 read \u00a0 and\u00a0<\/p>\n
moreover,\u00a0it\u00a0is\u00a0submitted\u00a0by\u00a0the\u00a0counsel\u00a0for\u00a0the\u00a0respondents\u00a0that\u00a0there\u00a0was\u00a0<\/p>\n
no \u00a0 clear \u00a0 cut \u00a0 decision \u00a0 upon \u00a0 the \u00a0 terms \u00a0 of \u00a0 the \u00a0 reference \u00a0 by \u00a0 the \u00a0 Central\u00a0<\/p>\n
Government\u00a0Industrial\u00a0Tribunal\u00a0No.2,\u00a0Dhanbad.\u00a0\u00a0The\u00a0duty\u00a0of\u00a0the\u00a0tribunal\u00a0<\/p>\n
was\u00a0to\u00a0decide\u00a0in\u00a0the\u00a0reference\u00a0which\u00a0has\u00a0been\u00a0 \u00a0shifted\u00a0upon\u00a0the\u00a0Medical\u00a0<\/p>\n
Board\u00a0by\u00a0the\u00a0Tribunal\u00a0and\u00a0therefore,\u00a0let\u00a0the\u00a0matter\u00a0be\u00a0remanded\u00a0so\u00a0that\u00a0<\/p>\n
the\u00a0terms\u00a0of\u00a0the\u00a0reference\u00a0may\u00a0be\u00a0finally\u00a0decided\u00a0by\u00a0the\u00a0tribunal\u00a0on\u00a0the\u00a0<\/p>\n
basis\u00a0of\u00a0the\u00a0further\u00a0development\u00a0also.\n<\/p>\n
6.     In \u00a0 view \u00a0 of \u00a0 this \u00a0 limited \u00a0 submission \u00a0 and \u00a0 looking \u00a0 to \u00a0 the \u00a0 facts \u00a0 and\u00a0<\/p>\n
circumstances\u00a0of\u00a0the\u00a0case,\u00a0it\u00a0appears\u00a0that\u00a0the\u00a0terms\u00a0of\u00a0reference\u00a0ought\u00a0to\u00a0<\/p>\n
have \u00a0 been \u00a0 decided \u00a0 by \u00a0 the \u00a0 Central \u00a0 Government \u00a0 Industrial \u00a0 Tribunal \u00a0 No.2,\u00a0<\/p>\n
Dhanbad.\u00a0\u00a0The\u00a0duty\u00a0of\u00a0the\u00a0tribunal\u00a0can\u00a0never\u00a0be\u00a0shifted\u00a0to\u00a0the\u00a0Apex\u00a0Medical\u00a0

7.     I,\u00a0hereby,\u00a0restore\u00a0the\u00a0Reference\u00a0No.107\u00a0of\u00a02001\u00a0to\u00a0its\u00a0original\u00a0file\u00a0and\u00a0<\/p>\n
remand \u00a0 the \u00a0 matter \u00a0 to \u00a0 the \u00a0 Central \u00a0 Government \u00a0 Industrial \u00a0 Tribunal \u00a0 No.2,\u00a0<\/p>\n
Dhanbad\u00a0to\u00a0the\u00a0decide\u00a0reference\u00a0No.107\u00a0of\u00a02001.\u00a0 \u00a0The\u00a0tribunal\u00a0will\u00a0also\u00a0<\/p>\n

practicably\u00a0and\u00a0preferably\u00a0within\u00a0the\u00a0period\u00a0of\u00a016\u00a0weeks\u00a0from\u00a0the\u00a0date\u00a0of\u00a0<\/p>\n
receipt\u00a0of\u00a0a\u00a0copy\u00a0of\u00a0this\u00a0order.\u00a0\u00a0Learned\u00a0counsel\u00a0for\u00a0both\u00a0sides\u00a0assured\u00a0this\u00a0<\/p>\n
