Gandhi for the appellant and Mr.<br \/>\nJ.V. Japee for the respondents.\n<\/p>\n<p>\tThe<br \/>\ncase of the appellants-original plaintiffs is that they were<br \/>\ncultivating land bearing survey Nos. 231\/4, 235\/2, 233\/1, 234 and<br \/>\n232\/5 under the bonafide belief that the lands were their own lands.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the appellant fairly conceded that the appellants are<br \/>\nnot claiming adverse possession. As regards the ownership of the land<br \/>\nby the appellants,  on perusal of the judgments of the lower  courts,<br \/>\nit clearly transpires that inspite of granting ample opportunities,<br \/>\nthe appellants failed to produce any proof.  On the contrary, there<br \/>\nis ample evidence on record that the lands belong to the Panchayat.\n<\/p>\n<p>\tThis<br \/>\nappeal challenges the concurrent finding of facts both of the learned<br \/>\nTrial Judge as also the first appellate court recorded by the lower<br \/>\ncourts. Having gone through the judgment and order passed by the<br \/>\nlower courts, there is no infirmity with the said judgments. That<br \/>\napart, no substantial question of law is involved in the present<br \/>\nappeal. Having gone through the judgment of the lower courts, it<br \/>\ncannot be said that :\n<\/p>\n<p>(i).\tthe<br \/>\nCourts below have ignored material evidence or acted on no evidence;\n<\/p>\n<p>(ii).\tthe<br \/>\nCourts have drawn wrong inferences from proved facts by applying the<br \/>\nlaw erroneously; or<\/p>\n<p>(iii)<br \/>\n\tthe Courts have wrongly cast the burden of proof or there is a total<br \/>\ndearth of evidence where the evidence, taken as a whole, is not<br \/>\nreasonably capable of supporting the finding. [AIR 2008 SUPREME COURT<br \/>\n1749 &#8220;<a href=\"\/doc\/1239692\/\">Kashmir Singh v. Harnam Singh<\/a>]<\/p>\n<p>\tMoreover,<br \/>\nthe tenor of the arguments of the learned advocate for the appellant<br \/>\nis that this Court should re-appreciate the evidence in this  second<br \/>\nappeal. The same is not permissible in a Second Appeal.\n<\/p>\n<p>\tFor<br \/>\nthe foregoing reasons, there is no merit in this second appeal, and<br \/>\nthe same is dismissed.
