Dave for the applicant-accused submitted that the<br \/>\n\tapplicant is the Mamlatdar, who is alleged to have passed an order<br \/>\n\tin connivance with other co-accused on the basis of the record<br \/>\n\tproduced in the tenancy case. Learned counsel, Dave submitted that<br \/>\n\tthe documents are produced by the Advocate for the concerned party<br \/>\n\ti.e. other co-accused and on the basis thereof, the order has been<br \/>\n\tpassed by the applicant. Learned counsel, Mr.Dave submitted that the<br \/>\n\tapplicant has retired with effect from 30.09.2010 as a Deputy<br \/>\n\tCollector, Valsad and the documents are already with the<br \/>\n\tInvestigating Agency. He, therefore, submitted that the present<br \/>\n\tapplication may be allowed. He further submitted that the lawyer,<br \/>\n\twho had presented the documents in the tenancy case, is also granted<br \/>\n\tanticipatory bail and, therefore, the present application may be<br \/>\n\tallowed.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Ms.Nair for the respondent-State submitted that the Power of<br \/>\n\tAttorney, which has been forged, was produced and that was also<br \/>\n\tproduced at later stage and without any such verification, the<br \/>\n\tproceedings were conducted, which has resulted into the alleged<br \/>\n\toffence. Therefore, the present application may not be entertained.<br \/>\n\tLearned A.P.P. submitted that exercise of discretion under Section<br \/>\n\t438 of the Criminal Procedure Code is required to be used with care<br \/>\n\tand circumspection and, therefore, considering the gravity of the<br \/>\n\toffence as well as prima-facie case, the Court may not exercise the<br \/>\n\tdiscretion.\n<\/p>\n<p>In<br \/>\n\tview of the rival submissions, it is required to be considered<br \/>\n\twhether the present application can be entertained or not.\n<\/p>\n<p>Having<br \/>\n\tperused the material and evidence and also considering the nature of<br \/>\n\toffence, manner in which it is alleged to have been committed, role<br \/>\n\tattributed and having considered the guidelines with regard to<br \/>\n\texercise of discretion under Section 438 of the Criminal<br \/>\n\tProcedure Code as<br \/>\n\tobserved by the Hon&#8217;ble Apex Court (1980)2<br \/>\n\tSCC 565<br \/>\n\tin case of Shri Gurbaksh<br \/>\n\tSingh Sibbia &amp; Ors. V\/s State of Punjab<br \/>\n\tas well as the judgment of this Court reported in 1992(1)<br \/>\n\tGLR 631<br \/>\n\tin case of Solanki Ravibhai<br \/>\n\tDipubhai &amp; Ors. V\/s State of Gujarat &amp; Anr.,<br \/>\n\tthe present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is allowed. The applicant is ordered to be<br \/>\n\treleased on bail in the event of his arrest in connection with<br \/>\n\tI-C.R.No.110\/2009 registered with Katargam Police Station, Surat in<br \/>\n\trespect of the offence alleged against him on his executing bond of<br \/>\n\tRs.5,000\/- (Rupees Five thousand only) with one solvent surety of<br \/>\n\tthe like amount, by him, by the concerned Police Officer and on<br \/>\n\tconditions that he shall;\n<\/p>\n<p> a)\tremain present before the trial Court regularly as \tand when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the concerned Police Station on 12.10.2010 between 11.00 a.m. and 2.00 p.m;\n<\/p>\n<p>c)\tmake himself available for interrogation by Police Officer, whenever and wherever required;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the \tCourt or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation \tand not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, \tand shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the applicant is arrested at any time within<br \/>\n\t90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of his arrest,<br \/>\n\tduring which it will be open to the applicant to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
