The
\n\tpresent acquittal Appeal has been filed by the appellant – Food
\n\tInspector, Ahmedabad Municipal Corporation, under Section 378(4) Cr.
\n\tP.C., against the Judgment and order dated 18.05.2010, rendered in
\n\tCriminal Case No. 11194 of 2006 by the learned Metropolitan
\n\tMagistrate, Court No.8, Ahmedbad. The said case was registered
\n\tagainst the present respondent No.2 – original accused for the
\n\toffence under section 16(1)A(i) of the Prevention of Food
\n\tAdulteration Act (for short “PFA Act”), for committing
\n\tthe breach of Section 7(i) of the Act, in the Court of learned
\n\tMetropolitan Magistrate, Ahmedabad. The said Judgment of the trial
\n\tCourt has been challenged by the Food Inspector on the ground that
\n\tthe Judgment and order passed by learned Magistrate is against the
\n\tlaw and evidence on record.\n<\/p>\n
According
\n\tto the prosecution case, the complainant – Food Inspector,
\n\talong with his Peon, visited the business premise of respondent No.2\n<\/p>\n
\t– accused on 18.04.2006 at 09.30 O’clock in the night and, in
\n\tpresence of panch,  took sample of “cow milk” for the
\n\tpurpose of analysis.  The panchnama was also prepared. Thereafter,
\n\tafter completing the necessary procedure, the complainant sent the
\n\tsaid samples to the Public Analyst for analysis. The Public Analyst
\n\tsubmitted the report in which it has been found that the sample was
\n\tadulterated.  Upon receipt of the report the complainant, after
\n\tobtaining sanction, filed complaint against the respondent No.2 –
\n\toriginal accused for the offences under Sections  16(1)(a)(i) of the
\n\tAct in the Court of learned Metropolitan Magistrate, Ahmedabad,
\n\tbeing Criminal Case No. 11194 of 2006.\n<\/p>\n
At
\n\tthe conclusion of trial and after appreciating the oral as well as
\n\tdocumentary evidence, the learned Magistrate vide impugned Judgment,
\n\tacquitted the respondent – accused.\n<\/p>\n
Learned
\n\tAdvocate Mr. Bhatt, appearing on behalf of the appellant –
\n\tFood Inspector has contended that the Judgment and order of
\n\tacquittal is contrary to law and evidence on record and is not
\n\tproper. He has contended that the complainant has followed the
\n\tprocedure as prescribed under the law while taking the sample. He
\n\thas contended that the prosecution witnesses have fully supported
\n\tthe case of prosecution and their evidence get corrobortion with the
\n\tevidence of each other. He has contended that the present case is
\n\tclear case of adulteration attracting the provisions of the Act and
\n\tby selling such adulterated food product, the accused has committed
\n\toffence under the provisions of the Act. He has also contended that
\n\tthe offence punishable under the Act are directly connected with the
\n\thealth of public at large.\n<\/p>\n
I
\n\thave gone through the papers produced in the Case. I have also gone
\n\tthrough the evidence led before the trial Court as well as the
\n\tExpert Opinion. I have also gone through the Judgment of the trial
\n\tCourt. Looking to the papers and the Judgment of the trial Court, it
\n\tappears that the complainant has not followed the proper procedure
\n\twhile taking the sample. The trial Court has also clearly found that
\n\tthe sanctioning Authority has not followed the proper procedure
\n\twhile according the sanction and the sanction was given
\n\tmechanically.  The learned Magistrate has clearly observed that
\n\tthere is clear breach of the provisions of the Act and the Rules.
\n\tLearned Counsel for the appellant is unable to convince this Court
\n\tas to whether the prosecution has followed the mandatory provision
\n\tof Rules. In the facts of the case I am in complete agreement with
\n\tthe reasons assigned by the trial Court.\n<\/p>\n
It
\n\tis settled legal position that in acquittal Appeal, the Appellate
\n\tCourt is not required to re-write the Judgment or to give fresh
\n\treasonings when the Appellate Court is in agreement with the reasons
\n\tassigned by the trial Court acquitting the accused. In the instant
\n\tcase, this Court is in full agreement with the reasons given and
\n\tfindings recorded by the trial Court while acquitting the
\n\trespondents – accused and adopting the said reasons and for
\n\tthe reasons aforesaid, in my view, the impugned Judgment is just,
\n\tlegal and proper and requires no interference by this Court at this
\n\tstage. Hence, this Appeal requires to be dismissed.\n<\/p>\n
In
\n\tthe result, the Appeal is hereby dismissed. The impugned Judgment
\n\tand order dated 18.05.2010 passed by the learned Metropolitan
\n\tMagistrate, Court No.8, Ahmedabad, in Criminal Case No. 11194 of
\n\t2005, acquitting the respondent No.2 – accused, is hereby
\n\tconfirmed.\n<\/p>\n
