(4) 113\n JT 1995 (6)   144\t  1995 SCALE  (4)586\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t       O R D E R<br \/>\n     This is  an appeal\t by Certificate\t granted by the High<br \/>\nCourt by  order dated  December 14,  1978 with a question as<br \/>\nunder :\n<\/p>\n<blockquote><p>     &#8220;Whether the  only right  of the grantee<br \/>\n     is to claim compensation and whether the<br \/>\n     Government can  take possession  at  any<br \/>\n     time after\t expiry of  one month in view<br \/>\n     of Governor General&#8217;s Order No.179 dated<br \/>\n     12th September, 1836?&#8221;<\/p><\/blockquote>\n<p>     In view  of the  Certificate granted  by the High Court<br \/>\nunder Art.133(1)  of the  Constitution, the  question arises<br \/>\nwhether the  State is  entitled to resume land granted under<br \/>\ns.3  of\t  Government   Grant   Act,   1895   without   prior<br \/>\ndetermination of  the amount  for the  structure. Though the<br \/>\nrespondent has\tbeen served,  he has not appeared, either in<br \/>\nperson or  through counsel.  We have taken the assistance of<br \/>\ncounsel for  the appellant  and we have perused the judgment<br \/>\nof the\tDelhi High  Court reported in Sh. Raj Singh v. Union<br \/>\nof India,  (AIR 1973  Delhi  169)  and\tthe  Division  Bench<br \/>\njudgment of the High Court of Allahabad reported in Bhagwati<br \/>\nDevi  v.  President  of\t India,\t (1974\t(72)  Allahabad\t Law<br \/>\nJournal, 43)  which  was  relied  on  and  followed  by\t the<br \/>\nDivision Bench\tin this\t case to hold that it is a condition<br \/>\nprecedent  that\t  the  State   should  give  notice  to\t the<br \/>\nrespondent, determine  the compensation\t and then resume the<br \/>\nproperty granted to the respondent. The question, therefore,<br \/>\nis whether it is a condition precedent for the Government to<br \/>\nresume the land only after determination of the compensation<br \/>\nand payment  thereof or\t on the\t issuance of  the notice  as<br \/>\nrequired  under\t  the  Grant   and  on\texpiry\tthereof.  To<br \/>\nappreciate the\tcontention, it\tis necessary  to look to the<br \/>\nprovisions of  the Grant  itself. Under\t s.3 of the Act, the<br \/>\nGovernor General  in Council exercised the power and granted<br \/>\nlicence to  the respondent  to erect  the structure  on\t the<br \/>\nGovernment land. The conditions of the Grant are :\n<\/p>\n<blockquote><p>\t  &#8220;No ground  will be  granted except<br \/>\n     on the  following conditions,  which are<br \/>\n     to be  subscribed by  every  grantee  as<br \/>\n     well as  by those\tto whom his grant may<br \/>\n     subsequently be transferred:-<br \/>\n\t  1st :\t The Government to retain the<br \/>\n     power  of\tresumption  at\tany  time  on<br \/>\n     giving one month&#8217;s notice and payment of<br \/>\n     the value\tof such buildings as may have<br \/>\n     been authorised to be erected.&#8221;<\/p><\/blockquote>\n<p>     The other\tclauses are  not relevant for the purpose of<br \/>\nthis case. Hence they are omitted.\n<\/p>\n<p>     In the  Order No.179  of 1836,  the Governor General in<br \/>\nCouncil had  issued the\t regulation empowering\tthe Governor<br \/>\nGeneral to  rescind authorised orders in force till then and<br \/>\nto substitute  for them\t by regulations.  The regulations in<br \/>\norder No.  179 of 1836 are statutory regulations made by the<br \/>\nGovernor General  in Council  in exercise  of his  statutory<br \/>\npower. The  covenants for  the\tGrant  clearly\tempower\t the<br \/>\nGovernment retaining  its power\t of resumption\tat any time.<br \/>\nThe conditions\tprecedent are  : to issue one month&#8217;s notice<br \/>\nand payment  of the  value of such building as may have been<br \/>\nauthorised to be erected.\n<\/p>\n<p>     The Division  Bench of  the Delhi\tHigh Court  has left<br \/>\nopen the  question of  mode of determination of the value of<br \/>\nthe  building  to  be  determined  in  accordance  with\t the<br \/>\nrelevant provisions  of the  law. The  Division Bench of the<br \/>\nAllahabad High\tCourt in  Bhagwati Devi&#8217;s  case, (supra)  in<br \/>\nparagraph 7, had held that though the Government is entitled<br \/>\nto resume  the land,  the grantee  is entitled\tto  a  prior<br \/>\nopportunity to\trepresent  his\tcase  before  the  competent<br \/>\nauthority in  determination of the value of the building and<br \/>\nfor payment  of the  value of  such building  resumed by the<br \/>\nState.\n<\/p>\n<p>     It would  appear that  detailed  instructions  in\tthat<br \/>\nbehalf were  made in  the Standing  Order No.241  which\t was<br \/>\nproduced before\t the Division  Bench of\t the High  Court  of<br \/>\nAllahabad in  which  Military  Engineer\t was  instructed  to<br \/>\nevaluate the  value of the building which was resumed by the<br \/>\nGovernment for\tpayment\t of  the  amount  to  the  erstwhile<br \/>\nlicencee. We  are not  concerned in  this appeal  as to\t the<br \/>\nmethod of  valuation. Suffice  it to  state that  the  Order<br \/>\nNo.241 though  does not\t contemplate of issuing prior notice<br \/>\nto erstwhile  licencee whose  licence  has  been  determined<br \/>\nunder Clause  I of  the Grant,\tbefore determination  of the<br \/>\nactual amount,\tthe  erstwhile\tgrantee\t is  entitled  to  a<br \/>\nnotice, so  that the  grantee would  be at  liberty to place<br \/>\nbefore the  competent authority\t all relevant  material\t for<br \/>\ndetermining the value of the building and for payment of the<br \/>\namount thereof.\t It is\tseen that  it  is  not\ta  condition<br \/>\nprecedent  to\tdetermine,  at\t the  first   instance,\t the<br \/>\ncompensation  after  giving  an\t opportunity;  make  payment<br \/>\nthereof and then to resume the property. What is a condition<br \/>\nprecedent is  issuance of  one month&#8217;s\tnotice and on expiry<br \/>\nthereof the  Government is  entitled to resume the land. The<br \/>\namount is  to be  determined as\t required under the relevant<br \/>\nprovisions after  giving opportunity and which could be done<br \/>\nthereafter. After  all, the  property would  be resumed\t for<br \/>\npublic use  and\t determination\tof  value  of  the  building<br \/>\nerrected is  a ministerial  act and  payment thereof  is the<br \/>\nresultant consequence. This process would take some time and<br \/>\nif the\treasoning of  the High\tCourt of  Allahabad is given<br \/>\neffect to,  it would  defeat the public purpose. The view of<br \/>\nthe Delhi  High Court  is consistent  with  the\t scheme\t and<br \/>\nappears to  be pragmatic  and  realistic.  The\tHigh  Court,<br \/>\ntherefore, was\tnot right  in its  conclusion that  it is  a<br \/>\ncondition precedent  to determine the amount of the value of<br \/>\nthe building  in the  first  instance  and  payment  thereof<br \/>\nbefore resumption of the property.\n<\/p>\n<p>     The  appeal  is  accordingly  allowed,  but  since\t the<br \/>\nrespondent is not present, without costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India And Ors vs Harish Chand Anand on 26 July, 1995 Equivalent citations: 1996 AIR 203, 1995 SCC Supl.
