Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :05\/08\/2010\n\n O R D E R\n<\/pre>\n<p>          THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>            W.P.(C).No.37575 of 2009-N<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>      Dated this the 5th day of August, 2010.<\/p>\n<p>                     Judgment<\/p>\n<p>1.The third  respondent   co-operative  society  is<\/p>\n<p> provided   with  certain   funds  by   the   State<\/p>\n<p> Government.   Such  funds   lie  in   an   account<\/p>\n<p> maintained  by  the  third  respondent   with  the<\/p>\n<p> Alappuzha District Co-operative Bank of which,<\/p>\n<p> the petitioner is the Branch Manager. The third<\/p>\n<p> respondent society can utilise such funds by<\/p>\n<p> withdrawing it from the District Co-operative<\/p>\n<p> Bank only with the counter signature of the<\/p>\n<p> competent authority in the Coir Board. Obviously,<\/p>\n<p> therefore,   the  money  cannot   be  treated   as<\/p>\n<p> belonging to the third respondent since it is<\/p>\n<p> only part of the funds under the control of the<\/p>\n<p> Government,   for  being   utilised  through   the<\/p>\n<p> controlling authorities, namely, the Government<\/p>\n<p> and the Coir Board.\n<\/p>\n<\/p>\n<p>2.On the allegation that the third respondent is a<\/p>\n<p> defaulter of dues under the E.P.F.&amp; M.P.Act,<\/p>\n<p><span class=\"hidden_text\">WPC37575\/09            -: 2 :-<\/span><\/p>\n<p> 1952, orders were issued essentially requiring<\/p>\n<p> the    District  Co-operative    Bank  to  pay such<\/p>\n<p> amounts from the account of the third respondent<\/p>\n<p> society to the E.P.F.Organisation. Though the<\/p>\n<p> Branch Manager replied to that request, she now<\/p>\n<p> faces personal action by attachment of her salary<\/p>\n<p> as if she is a deemed employer and defaulter. On<\/p>\n<p> the afore-noted facts, the said action by the<\/p>\n<p> authorities under the E.P.F. &amp; M.P.Act are wholly<\/p>\n<p> misplaced and without jurisdiction.<\/p>\n<p>3.For    the   aforesaid     reasons,  the   impugned<\/p>\n<p> proceedings    as   against    the   petitioner  are<\/p>\n<p> quashed.\n<\/p>\n<\/p>\n<p>4.However, this judgment will not preclude the<\/p>\n<p> E.P.F.Organisation from taking appropriate action<\/p>\n<p> against    the   third   respondent   society.
