NO. 5129 OF 2002\n\n                                     ---------------------\n\n\n                       Dated this the 11th day of December, 2006\n\n\n                                     J U D G M E N T\n<\/pre>\n<p>       The writ petition is filed with the following prayers:-<\/p>\n<p>        &#8220;(i)   To   issue   writ   of   mandamus   order   or   direction<\/p>\n<p>        commanding the respondents to fix the pay of the petitioner in<\/p>\n<p>        the  scale   of   Rs.2,610-3,540   with   D.A.,  H.R.A.,   C.C.A.,   and<\/p>\n<p>        increments in the scale of Rs.2,610-3,540\/- as being granted<\/p>\n<p>        to group &#8216;D&#8217; officials and disburse the same with effect from<\/p>\n<p>        1.1.1996.\n<\/p>\n<\/p>\n<p>        (ii)     To   issue   a   writ   of   mandamus   order   or   direction<\/p>\n<p>        commanding the respondent to pay Rs.19,479\/- being arrears<\/p>\n<p>        of pay from 1.5.1996 to 1.4.1998 based on the fixation of pay<\/p>\n<p>        pursuant to Ext.P3.\n<\/p>\n<\/p>\n<p>        (iii)     To   issue   a   writ   of   mandamus   order   or   direction<\/p>\n<p>        commanding   the   respondent   to   regularise   the   service   of   the<\/p>\n<p>        petitioner   as   Driver   in   SPORTS   with   all   consequential<\/p>\n<p>        benefits.&#8221;\n<\/p>\n<p>       There will be a direction to the 1st respondent to take appropriate action on<\/p>\n<p>Ext.P5, with notice to the petitioner, if not already taken, within a period of three<\/p>\n<p>months from the date of production of a copy of this judgment by the petitioner.  In<\/p>\n<p>the event of the petitioner filing a statement showing any eligible amounts that has<\/p>\n<p>not been disbursed, steps will be taken to disburse the same in the meanwhile.
