Commissioner of Police (DCP) Nand Nagari\n\n\n                               Decision announced: 19.8.2009\nFacts<\/pre>\n<p>:\n<\/p>\n<p>         By an application of 20.9.07 Shri Ram Niwas Jindal of Baghpat (UP)<br \/>\napplied to the DCP Nand Nagari seeking the following information:\n<\/p>\n<blockquote><p>         &#8220;1.   Please clarify, why and on what grounds you are not giving a<br \/>\n               hearing on the above referred case and not dealing with the<br \/>\n               case.<\/p>\n<blockquote><p>         2.    Please clarify, why there is extremely minute number of<br \/>\n               female employees, and maximum number is of male<br \/>\n               employees, when this office is related to Crime Against<br \/>\n               Women.\n<\/p><\/blockquote>\n<blockquote><p>         3.    Please clarify whether there is a stipulation in law of your<br \/>\n               office that your employees can threaten or warn any party?<br \/>\n               If yes, Please explain the relevant rule portion where under<br \/>\n               your employees have been empowered to threaten or warn<br \/>\n               any party.\n<\/p><\/blockquote>\n<blockquote><p>         4.    That whether respondents are unaware of any legal action in<br \/>\n               the above referred case? That the respondents take me<br \/>\n               alongwith them, in the above case, to assist them and keep<br \/>\n               me with them, yet in spite of this they misbehave with me.<br \/>\n               Please clarify under what rules they misbehave with me.\n<\/p><\/blockquote>\n<blockquote><p>         5.    Is there any objection to any party bringing any person with<br \/>\n               him for assisting him? If yes, then I may be provided<br \/>\n               information regarding that rule.\n<\/p><\/blockquote>\n<blockquote><p>         6.    Is there any rule prevalent in your office that instead of<br \/>\n               hearing the cases, registered in your office, personally, these<br \/>\n               will not be heard by you and just passed on to your<br \/>\n               subordinates?\n<\/p><\/blockquote>\n<blockquote><p>         7.    Are you aware that we cannot obtain information \/<br \/>\n               documents from your office under the RTI Act. If yes, then<br \/>\n               please clarify that under the RTI Act what type of information<br \/>\n               \/ documents cannot be obtained by us.\n<\/p><\/blockquote>\n<blockquote><p>         8.    Please clarify what action is taken against your employees,<br \/>\n               against whom a complaint is lodged either with your good<br \/>\n               self or with the Commissioner of Police.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                             1<\/span><\/p>\n<p>        On not receiving a reply within 48 hours, Shri Ram Niwas Jindal moved an<br \/>\nappeal before Sh. Y. S. Dadwal, Commissioner of Police specifically with the<br \/>\nfollowing plea:\n<\/p>\n<blockquote><p>       &#8220;a)    That respondents be given extremely strict orders to provide<br \/>\n              complete information sought by the appellant in his<br \/>\n              application dated 20.9.2007.\n<\/p><\/blockquote>\n<blockquote><p>       b)     That based on the above facts, action u\/s 20 sub sec. (1) be<br \/>\n              taken against all concerned respondents and respondents<br \/>\n              be ordered to provided to the appellant relief @ Rs. 250\/- per<br \/>\n              day from the date of receipt of letter dated 20.9.07 till date of<br \/>\n              providing complete information.\n<\/p><\/blockquote>\n<blockquote><p>       c)     That the appellant has filed the present appeal before this<br \/>\n              Commission due to the dictatorial attitude of the<br \/>\n              respondents. It is further requested that the appellant be<br \/>\n              ordered to be provided with a compensation of Rs. 50,000\/-<br \/>\n              by the Delhi Police so that in future they do not exhibit such<br \/>\n              a dictatorial attitude to a citizen who files a request for<br \/>\n              seeking information under RTI Act, 2005&#8243;<\/p><\/blockquote>\n<p>       By his order of 5.11.07 Shri Ajay Kashyap, Jt. Commissioner of Police and<br \/>\nAppellate Authority dismissed the appeal on the following grounds:\n<\/p>\n<blockquote><p>       &#8220;I have examined the relevant records available in the file. After<br \/>\n       going through all the relevant records I find that the appellant had<br \/>\n       submitted an application dated 20.9.07 addressed to Dy. Police<br \/>\n       Commissioner. Old Police Station, Nand Nagri, Delhi for seeking<br \/>\n       information within 48 hours related to complaint filed by Smt.<br \/>\n       Shikha Gupta under RTI Act 2005, PIO\/North East District has<br \/>\n       clarified that since there is no specific threat to the life and liberty,<br \/>\n       therefore, Section 7 (1) of the RTI Act is not attracted. Moreover,<br \/>\n       PIO\/North-East District has given tee ply vide letter No.<br \/>\n       2323\/R\/ACP\/OPS\/NE dated 15.10.07 to the appellant on his<br \/>\n       application dated 20.9.2007 well within the time limit prescribed<br \/>\n       under RTI Act, 2005. The appellant may request for a copy if the<br \/>\n       same has not been received, from concerned office.&#8221;<\/p><\/blockquote>\n<p>       This has brought Shri Jindal in second appeal before us with the following<br \/>\nprayer:\n<\/p>\n<blockquote><p>       &#8220;a)    That Order dated 4.11.07 issued by First Appellate<br \/>\n              Authority may be set aside and respondents may be<br \/>\n              strictly directed to provide urgently the information<br \/>\n              sought by the appellant vide his appeal dated 20.9.2007<br \/>\n              within the time limited mandated and it may also be<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><br \/>\n               ordered that respondent be provided photo copies of<br \/>\n              the documents demanded by him without any further<br \/>\n              delay.\n<\/p><\/blockquote>\n<blockquote><p>       b)     That the respondent has failed to provide the<br \/>\n              information \/ documents within the time frame mandated<br \/>\n              under sec. 20 of RTI Act 2005. Therefore, action under<br \/>\n              relevant section be taken against the respondent and<br \/>\n              appellant be granted relief @ Rs. 250\/- per day w.e.f. the<br \/>\n              date of application i.e. 20.9.07 till the date the<br \/>\n              documents are provided, after recovering the same from<br \/>\n              the respondent or in the alternative a lump sum amount<br \/>\n              of Rs. 25000\/- be ordered to be provided to the<br \/>\n              appellant.&#8221;<\/p><\/blockquote>\n<p>       The appeal was heard by videoconference on 19.8.09. The following are<br \/>\npresent:\n<\/p>\n<blockquote><p>       Respondents<br \/>\n            Sh. Lala Ram Meena, A.C.P.\n<\/p><\/blockquote>\n<blockquote><p>            Sh. Arun Kumar, S.I.<\/p><\/blockquote>\n<p>       Although arrangement has been made to hear the appeal through video<br \/>\nconference at NIC Studio Baghpat and appellant Sh. Ram Niwas Jindal had been<br \/>\ninformed by Notice dated 7.8.2009 regarding the hearing, he has opted not to be<br \/>\npresent.\n<\/p>\n<p>       Shri Lala Ram Meena ACP submitted that a similar request by the same<br \/>\nappellant Sh. Jindal has been heard by us in appeal No. CIC\/WB\/A\/2007\/01516<br \/>\nand dismissed on 24.4.09. He also submitted a copy of a reply dated 15.10.07<br \/>\nsent to Shri Jindal in the present case. This letter informs Shri Jindal as follows:\n<\/p>\n<blockquote><p>       &#8220;In this connection it is intimated that Complainant Smt. Shikha<br \/>\n       Gupta r\/o F-394, Gali No. 7, Ganga Vihar, Delhi-94 has given in<br \/>\n       writing under Right to Information Act 2005 that no<br \/>\n       information\/document concerning her complaint filed with the Crime<br \/>\n       Against Women Cell, be provided to any one. Accordingly, no copy<br \/>\n       of any document can be provided to you under Sec. 11 of Right to<br \/>\n       Information Act, 2005.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                                DECISION NOTICE<\/p>\n<p><span class=\"hidden_text\">                                          3<\/span><br \/>\n        We agree with respondents that no case of life &amp; liberty is made out in the<br \/>\npresent case, since what appellant is asking for is information to be used through<br \/>\nthe normal judicial process of which he would obtain a copy, if required, at the<br \/>\nappropriate time. Besides, in our decision on File No. CIC\/WB\/A\/2007\/01516,<br \/>\nwe had concluded as follows:\n<\/p><\/blockquote>\n<blockquote><p>       We find that the order of JCP Shri Ajay Kashyap of 29.10.07 is<br \/>\n       defective in that it simply dismisses the appeal on the ground that<br \/>\n       the original application had not been received, without caring to<br \/>\n       ensure that a response was given, even if that of refusal under the<br \/>\n       law. Now, however, we find that the question raised in the original<br \/>\n       application stands answered as per the Act and there is no second<br \/>\n       appeal before us on the orders of JCP in regard to that. Moreover,<br \/>\n       in light of the third party Ms Shikha Gupta&#8217;s objection to disclosure<br \/>\n       u\/s 11 (1) the information sought is clearly exempt from disclosure<br \/>\n       u\/s 8 sub-section (1) (g). Under the circumstances, there is no<br \/>\n       further need for this Commission to intervene in this matter. The<br \/>\n       appeal stands dismissed.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>       We cannot find any fresh reason for intervention in this matter and this<br \/>\nappeal is also, therefore, dismissed.<\/p><\/blockquote>\n<p>       Announced in the hearing.
