Justice V.GIRI\n\n Dated :26\/05\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                   W.P.(C).15055\/2008\n                      --------------------\n           Dated this the 26th day of May, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>      While continuing as a Tutor in Anatomy in Medical<\/p>\n<p>College, Alappuzha, petitioner joined the Department of<\/p>\n<p>Health Services in 1987 as Assistant Surgeon.         While<\/p>\n<p>continuing in the Primary Health Centre at Perambra,<\/p>\n<p>petitioner applied for Half Pay Leave for a period from<\/p>\n<p>30.9.1999 to 16.4.2000, which was sanctioned under<\/p>\n<p>Ext.P1.   While on leave,       petitioner applied for leave<\/p>\n<p>without allowance for a period of five years for taking up<\/p>\n<p>alternate employment, as per Ext.P2. Apparently, though<\/p>\n<p>the District Medical Officer of Health had recommended<\/p>\n<p>the sanction of leave, second respondent, the Director of<\/p>\n<p>Health Services, as evidenced by Ext.P5 dated 22.5.2000,<\/p>\n<p>declined to recommend the petitioner&#8217;s application for<\/p>\n<p>leave. Therefore, petitioner was not granted the same.<\/p>\n<p>Petitioner filed Ext.P6 representation dated 24.6.2000<\/p>\n<p>before the Director. But thereafter, he did not pursue<\/p>\n<p>the same. Petitioner did not join duty and he was not<\/p>\n<p>sanctioned leave as sought for under Ext.P2.<\/p>\n<p>W.P.(C).15055\/2008<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>2.    Learned counsel for the petitioner refers to Ext.P8<\/p>\n<p>which is a communication received from the second<\/p>\n<p>respondent requiring the petitioner       to intimate the<\/p>\n<p>Institution where he intends to work. By Ext.P9,<\/p>\n<p>Petitioner replied that he only intended to take up self<\/p>\n<p>employment at Perambra.         Ext.P5 dated 22.5.2000 is<\/p>\n<p>subsequent to Exts.P8 and P9.\n<\/p>\n<\/p>\n<p>3.    Writ petition has now been filed eight years later<\/p>\n<p>taking note of the fact that the petitioner is due to retire<\/p>\n<p>on 31.5.2008, seeking a direction to the respondents to<\/p>\n<p>permit the petitioner to re-join duty. Learned counsel for<\/p>\n<p>the petitioner submits that no disciplinary proceedings<\/p>\n<p>have been initiated against the petitioner              for<\/p>\n<p>unauthorized absence. Therefore petitioner has a right<\/p>\n<p>to re-join duty, it is contended.\n<\/p>\n<\/p>\n<p>4.    I heard learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader. Ext.P7 dated 3.4.2008 is<\/p>\n<p>W.P.(C).15055\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>an application filed by the petitioner before the Director<\/p>\n<p>of Health Services seeking permission to re-join duty as<\/p>\n<p>Assistant Surgeon.\n<\/p>\n<\/p>\n<p>5.    In my view, petitioner is not entitled to a direction<\/p>\n<p>as such. After all it is admitted that the petitioner was<\/p>\n<p>not granted leave without allowance for taking up<\/p>\n<p>alternate employment.       Government servant is not<\/p>\n<p>entitled to assume that leave will be granted and is not<\/p>\n<p>entitled to remain out of service either for           self<\/p>\n<p>employment or taking up alternate employment unless<\/p>\n<p>leave has been sanctioned in terms of appendix 12A of<\/p>\n<p>Part-III of the KSR. In the present case, petitioner was<\/p>\n<p>served with Ext.P5 wherein the Director of Health<\/p>\n<p>Services     had   expressly    declined   permission    to<\/p>\n<p>recommend the petitioner&#8217;s application for leave. In the<\/p>\n<p>circumstances,       petitioner&#8217;s  leave  has   not   been<\/p>\n<p>sanctioned. But he nevertheless did not either re-join<\/p>\n<p>duty or pursue the matter further within a reasonable<\/p>\n<p>time.    Petitioner is  now not entitled to re-join duty<\/p>\n<p>W.P.(C).15055\/2008<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>ignoring the absence for a period of more than eight<\/p>\n<p>years.\n<\/p>\n<\/p>\n<p>6.    For all these reasons, I do not find my way to issue<\/p>\n<p>any    direction at this stage to the respondent.
