RESPONDENTS<\/pre>\n<p>E   S\ufb01,&#8217;N\u00a7.K.S0udagar, Adv. for R2,<br \/>\n &#8220;med;\n<\/p>\n<p>E &#8221;  This appeal is med 11\/3 173 (1) of MV Act against the<\/p>\n<p>Ix.)<\/p>\n<p>judgment and award dated 19.09.2006 passed in MVC<br \/>\nNo.238-4\/2003 on the file of H1 Additional Civil Judge, Sr&#8217;.l3n. 82;<br \/>\nAdditional MACT, Belgaum, partly allowing the clairnl,pe.titi.on<\/p>\n<p>for compensation and seeking enhancement of comp\u00a2e_n&#8217;sation.i&#8217;~ V<\/p>\n<p>This appeal coming on for further orders,&#8217;l&#8217;t&#8217;riisjd.ajk,ltthe <\/p>\n<p>court delivered the following:\n<\/p>\n<p>Jvoema\ufb01rli<\/p>\n<p>Heard the learned cotzriseh for the part_ies.:&#8217;ii.inally in-_&#8221;<\/p>\n<p>respect of the appeal preferret-la by lclairrlant for<br \/>\nenhancement of compensation.&#8217;\n<\/p>\n<p>2. Sri.Sanjay  the appellant<\/p>\n<p>submits that__    _Vtal&lt;eni&#039;lesselrl income and lower<\/p>\n<p>percentage of awarding amount towards future<br \/>\nloss of earnj_ng_and_itha&#8211;t l_n&#8211;o_i&quot;a;&#039;ri1ount has been given towards<\/p>\n<p>loss of; amenities of&#039; &#039;l&#039;ifei.l&quot;  this regard, appellant&#039;s counsel<\/p>\n<p> .referre&#039;ditol&#039;ithe&#039; evidencemon record and to that of the doctor who<\/p>\n<p>   certificate.\n<\/p>\n<p>.3. iiOn t&#8217;ne&#8217;other hand, Sri.Soudagar, learned counsel for the<\/p>\n<p>all&#8217;.&#8221;&#8221;I3ft:SL1I&#8217;8,l&#8217;1C\u00e9Hi Company submitted that the quantum of<\/p>\n<p>__&amp;tcoinpensation requires no enhancement under any of the<\/p>\n<p>&#8220;riii i tdheads. wig&#8221;\n<\/p>\n<p>Ln)<\/p>\n<p>4. Taking note of the evidence on record, income could have<\/p>\n<p>been taken at 1333.100\/H\u00bb and disability at E5% to the xv%_1e1e'&lt;&#8211;hG&#8211;dy<\/p>\n<p>and consequently towards loss of future \u20acaI&quot;I1i1&#039;1gS_,&#039;\\:&#039;1I&quot;1&#039;1dL1\ufb01i;&#039;u\\fX}iii, =<\/p>\n<p>new work out to Rs.97,200\/&#8211; as against\u00bb_Rs.2_&#8211;9.;50&#039;Gi[f&#039;:\u00bb~. given&#039; by ii<\/p>\n<p>the Tribunal. Therefore, under this, he-_jad,i the <\/p>\n<p>increased by Rs.67,&#039;700\/&#8211;~.
