                        DATE       : 25.JULY, 2011.\n\n\n\n\n                                              \n    ORAL JUDGMENT.\n\n\n    01)       This   writ   petition   challenges   the   judgment \n\n\n\n\n                                    \n<\/pre>\n
    and   order   dated   16.7.2005,   passed   by   the   Industrial <\/p>\n
    Court, Bhandara, dismissing the Complaint (ULP) No.85 <\/p>\n
    of   2003,   filed   by   the   petitioner\/complainant   under <\/p>\n
    Section 28 read with Items 5, 6 and 9 of Schedule-IV <\/p>\n
    of   MRTU   and   PULP   Act,   1971.   The   claim   of   the <\/p>\n
    petitioner\/complainant   was   that   from   14.9.1989   to <\/p>\n
    16.10.1991   he   had   completed   more   than   240   days <\/p>\n
    continuous   service   and   hence,   as   per   the   provisions <\/p>\n
    of   Clause   4-C   of   the   Model   Standing   Orders   framed <\/p>\n
    under the Bombay Industrial Relations Act, 1946, the <\/p>\n
    complainant   is   entitled   for   the   status   of   deemed <\/p>\n
    permanency.\n<\/p>\n
    02)       It is not in dispute that on 16.10.1991, the <\/p>\n
    petitioner\/complainant   was   terminated   from   service <\/p>\n
    and he had filed the Complaint (ULP) No.121 of 1991, <\/p>\n

    the said complaint was dismissed on 21.10.1995 by the <\/p>\n
    Labour Court, Bhandara. The revision against it, was <\/p>\n
    allowed   by   the   Industrial   Court,   Bhandara,   on <\/p>\n
    8.3.2001.   The   employer   preferred   Writ   Petition <\/p>\n
    No.2175 of 2001, in which an interim order was passed <\/p>\n
    by this Court, that the regularization and the status <\/p>\n
    of   the   present   petitioner\/complainant   shall   be <\/p>\n
    subject to the outcome of the writ petition.\n<\/p>\n
    03)       Shri   M.P.Jaiswal,   the   learned   Counsel <\/p>\n
    appearing   for   the   petitioner,   informs   that   the <\/p>\n
    petition   was   decided   subsequently   on   19.8.2009   and <\/p>\n
    the   mater   was   remanded   back   to   the   Labour   Court, <\/p>\n
    Bhandara,   for   decision   afresh.   He   further   submits <\/p>\n
    that   on   28.3.2001   the   said   complaint   was   allowed <\/p>\n
    directing   the   reinstatement   with   continuity   in <\/p>\n
    service   and   full   back   wages   to   the <\/p>\n
    petitioner\/complainant.   He   further   submits   that   the <\/p>\n
    finding  was  recorded   that  the  petitioner\/complainant <\/p>\n
    had   completed   240   days   continuous   service   preceding <\/p>\n
    the date   of his  termination  on  16.10.1991   and  there <\/p>\n

    was   non-compliance   of   Sections   25F   and   25G   of   the <\/p>\n
    Industrial   Disputes   Act,   1947   and   hence,   the <\/p>\n
    complaint was allowed.\n<\/p>\n
    04)       The   Industrial   Court,   Bhandara,     has,     by <\/p>\n
    impugned   order,   dismissed   the   complaint   only   on   the <\/p>\n
    ground,   that   the   Writ   Petition   No.2175   of   2001   was <\/p>\n
    admitted by this Court and it was pending for final <\/p>\n
    hearing.   The   Industrial   Court,   Bhandara,     has   also <\/p>\n
    noted,   that   the   regularization   was   subject   to   the <\/p>\n
    outcome of the writ petition and hence, the complaint <\/p>\n
    has   been   dismissed   without   considering   the   other <\/p>\n
    issues,   involved   in   the   complaint.   The <\/p>\n
    petitioner\/complainant   has   been   saddled   with   the <\/p>\n
    costs of Rs.10,000\/- to be recovered from his salary <\/p>\n
    by the employer.\n<\/p>\n
    05)       The Industrial Court, Bhandara, has committed <\/p>\n
    an   error   in   dismissing   the   complaint   on   the   sole <\/p>\n
    ground,   that   the   matter   was   subjudiced   in   Writ <\/p>\n
    Petition   No.2175   of 2001.  No doubt,  that  this   Court <\/p>\n

    had   observed   in   the   order   dated   1.8.2001   passed   in <\/p>\n
    the   said   writ   petition,   that   the   regularization   and <\/p>\n
    the   status   of   the   petitioner\/complainant,   shall   be <\/p>\n
    subject to the outcome of the writ petition. In view <\/p>\n
    of   this,   the   Industrial   Court,   Bhandara,   could   not <\/p>\n
    have   dismissed   the   complaint   without   entering   into <\/p>\n
    the merits of the matter. The said writ petition has <\/p>\n
    been   decided   and   the   complaint   against   termination, <\/p>\n
    has   also   been   decided.   The   Industrial   Court, <\/p>\n
    Bhandara, has framed issues, however, no findings are <\/p>\n
    recorded   on those  issues   and the  complaint  has  been <\/p>\n
    dismissed.   Though   there   is   a   passing   reference   in <\/p>\n
    para-13        of       the       judgment,          that            the <\/p>\n
    petitioner\/complainant   did   not   complete   five   years <\/p>\n
    continuous service prior to 15.10.1991, the question <\/p>\n
    of   applicability   of   the   Model   Standing   Orders   under <\/p>\n
    the   Bombay   Industrial   Relations   Act,   1946,   has   not <\/p>\n
    been considered.\n<\/p>\n
    06)       In   view   of   this,   the   order   passed   by   the <\/p>\n
    Industrial   Court,   Bhandara,   cannot   be   sustained   and <\/p>\n

    the   matter   will   have   to   be   sent   back   to   the <\/p>\n
    Industrial Court, Bhandara, to consider it afresh.\n<\/p>\n
    07)       In   result,   the   petition   is   allowed.   The <\/p>\n
    judgment   and   order   dated   16.7.2005,   passed   by   the <\/p>\n
    Industrial Court, Bhandara, in Complaint (ULP) No.85 <\/p>\n
    of 2003, is hereby quashed and set aside. The matter <\/p>\n
    is   remitted   back   to   the   Industrial   Court,   Bhandara, <\/p>\n
    to decide the said complaint afresh, by recoding the <\/p>\n
    finding   on   all   the   issues.   The   Industrial   Court, <\/p>\n
    Bhandara,   shall   make   an   endeavour   to   decide   the <\/p>\n
    complaint as expeditiously as possible.\n<\/p>\n
    08)       Rule is made absolute in this terms. No order <\/p>\n
    as to costs.\n<\/p>\n
