    The accused in a prosecution for an offence u\/s.138<\/p>\n
of Negotiable Instruments Act is the revision petitioner,<\/p>\n
as he is aggrieved by the order of conviction and<\/p>\n
sentence imposed by the courts below.<\/p>\n
    2. The complainant is a private enterprise engaged<\/p>\n
in the conduct of curies and the accused was one of<\/p>\n
their subscribers and the accused had auctioned the<\/p>\n
curie and accepted the curie amount and subsequently<\/p>\n
he made default and on settlement of account, the<\/p>\n
accused issued a cheque for Rs.34,445\/-(Rupees Thirty<\/p>\n
four thousand four hundred and forty five only), which<\/p>\n
when presented for encashment dishonoured as there<\/p>\n
was “no sufficient fund” in the account maintained by<\/p>\n
the accused and the cheque amount was not repaid<\/p>\n
inspite of a formal demand notice and thus the revision<\/p>\n

petitioner has committed the offence punishable u\/s.138<\/p>\n
of   Negotiable     Instruments Act.  With  the   same<\/p>\n
allegation, the complainant approached the     Judicial<\/p>\n
First Class Magistrate Court-III, Palakkad by filing a<\/p>\n
formal complaint, upon which cognizance was taken<\/p>\n
u\/s.138 of Negotiable Instruments Act and instituted<\/p>\n
S.T.No.4014\/2005. During the trial of the case, PW1<\/p>\n
was examined from the side of the complainant and<\/p>\n
Exts.P1 to P5 documents were produced. From the side<\/p>\n
of the defence, though no witness was examined,<\/p>\n
Ext.D1 was produced and marked. On the basis of the<\/p>\n
available materials and evidence, the trial court has<\/p>\n
found that the cheque in question was issued by the<\/p>\n
revision     petitioner\/accused for  the  purpose    of<\/p>\n
discharging his debt due to the complainant. Thus<\/p>\n
accordingly the court found that, the complainant has<\/p>\n
established the case against the accused\/revision<\/p>\n

petitioner and consequently found that the accused is<\/p>\n
guilty and thus convicted him u\/s.138 of Negotiable<\/p>\n
Instruments Act. On such conviction, the trial court<\/p>\n
sentenced the revision petitioner\/appellant to undergo<\/p>\n
simple imprisonment for 1 month and also ordered to<\/p>\n
pay a compensation of Rs.34,445\/- to the complainant<\/p>\n
u\/s.357(3) of Cr.P.C. No default sentence is fixed.<\/p>\n
     3. Aggrieved by the above order of conviction and<\/p>\n
sentence, the revision petitioner had approached the<\/p>\n
appellate court by filing an appeal, and by judgment<\/p>\n
dated 27.08.2009 in Crl.Appeal No.10\/2008, the Court<\/p>\n
of Addl. District and Sessions Judge (Adhoc-I), Palakkad<\/p>\n
dismissed the appeal confirming the conviction, but<\/p>\n
sentence of imprisonment was modified as till raising of<\/p>\n
the court. No interference was made with respect to<\/p>\n
the order for compensation. It is the above conviction<\/p>\n
and sentence challenged in this revision petition.<\/p>\n
     4.    I have heard the learned counsel appearing for<\/p>\n

the revision petitioner and also perused the judgments<\/p>\n
of the courts below.\n<\/p>\n
     5.     Reiterating the   stand    taken     by  the<\/p>\n
accused\/revision petitioner during the trial and appeal,<\/p>\n
submitted that the complainant has not established the<\/p>\n
transaction and also the execution and issuance of the<\/p>\n
cheque. But no case is made out to interfere with the<\/p>\n
concurrent findings of the trial court as well as the<\/p>\n
lower appellate court. Therefore, I find no merit in the<\/p>\n
revision    petition  and accordingly    the   conviction<\/p>\n
recorded by the courts below against the revision<\/p>\n
petitioner u\/s.138 of Negotiable Instruments Act, is<\/p>\n
approved.\n<\/p>\n
     6. The counsel for the revision petitioner submitted<\/p>\n
that the sentence imposed by the courts below is highly<\/p>\n
exorbitant and unreasonable. It is also submitted that<\/p>\n
some breathing time may be granted to the revision<\/p>\n

petitioner to pay the amount.\n<\/p>\n
     7. Having regard to the facts and circumstances<\/p>\n
involved in the case, I am of the view that the said<\/p>\n
submission can be considered favorably but subject to<\/p>\n
the other relevant facts involved in the case. Going by<\/p>\n
the records and the findings of the court below, which<\/p>\n
approved by this court, a sum of Rs.34,445\/- which<\/p>\n
belonged to the complainant is with the revision<\/p>\n
petitioner for the last 5 years.   The apex court in a<\/p>\n
recent decision reported in Damodar S.Prabhu V.<\/p>\n
Sayed Babalal H. (JT<\/a> 2010(4) SC 457) has held that,<\/p>\n
in the case of dishonour of cheques, the compensatory<\/p>\n
aspect of the remedy should be given priority over the<\/p>\n
punitive aspects. Considering the above facts and legal<\/p>\n
position, I am of the view that, while granting time to<\/p>\n
pay the compensation, the amount can be enhanced<\/p>\n
slightly.\n<\/p>\n
     In the result, this revision petition is disposed of<\/p>\n

confirming the conviction against the revision petitioner<\/p>\n
u\/s.138 of Negotiable Instruments Act as recorded by<\/p>\n
the trial court as well as the lower appellate court.<\/p>\n
Accordingly,      while confirming   the   sentence     of<\/p>\n
imprisonment as ordered by the lower appellate court,<\/p>\n
the revision petitioner is directed to pay a sum of<\/p>\n
Rs.37,000\/- (Rupees Thirty seven thousand only) to the<\/p>\n
complainant as compensation u\/s.357(3) of Cr.P.C<\/p>\n
within 3 months from today and in default he is directed<\/p>\n
to undergo simple imprisonment for a period of 1<\/p>\n
month.      The revision petitioner is free to pay the<\/p>\n
compensation amount as ordered by this court either<\/p>\n
directly to the complainant or by remitting the same in<\/p>\n
the trial court, whichever subjected to the satisfaction<\/p>\n
of the trial court. The revision petitioner is directed to<\/p>\n
appear before the trial court on 30.10.2010 to receive<\/p>\n
the sentence and to pay the compensation. Execution<\/p>\n

\n                            7<\/span><\/p>\n
of warrant if any shall be differed till 30.10.2010. In<\/p>\n
case, of failure on the part of the revision petitioner in<\/p>\n
appearing before the court below, the trial court is free<\/p>\n
to take coercive steps to secure the presence of the<\/p>\n
revision petitioner and to execute the sentence awarded<\/p>\n
against the revision petitioner.\n<\/p>\n
     Criminal      revision petition  is   disposed       of<\/p>\n
accordingly.\n<\/p>\n<\/p>\n
