2.   26.04.2011.              Heard the learned counsels for the<\/p>\n
                   petitioner and the State.\n<\/p>\n
                              The    petitioner     is   apprehending       his<\/p>\n
                   arrest in a case registered under Section<\/p>\n
                   302\/34 of the Indian Penal Code.<\/p>\n
                              The case was instituted in 1998 and<\/p>\n
                   in 1999 final form was submitted as the case<\/p>\n
                   true but no clue which gets reflected from<\/p>\n
                   Annexure-2. The final form was accepted in<\/p>\n
                   2000 by the learned court below. After eight<\/p>\n
                   years of the same, in 2008 an application<\/p>\n
                   was filed by the police for permission to<\/p>\n
                   reinvestigate       the   matter.      The      matter    is<\/p>\n
                   still under investigation.               The order was<\/p>\n
                   for reinvestigation was made in 2008.                    The<\/p>\n
                   order        of       reinvestigation              created<\/p>\n
                   apprehension in the mind of the petitioner.<\/p>\n
                   Though it is submitted that reinvestigation<\/p>\n
                   is   not   permissible     but    this     Court   is    not<\/p>\n
                   inclined    to     deal   with   the     said    issue    at<\/p>\n
                   present.\n<\/p>\n
                              Since     after       several        years    of
\n                             2<\/span><\/p>\n
        submission of the final form reinvestigation<\/p>\n
        has been permitted and a statement has been<\/p>\n
        made in paragraph no.20 of the petition that<\/p>\n
        the petitioner has no criminal antecedent,<\/p>\n
        let the petitioner, above named, be released<\/p>\n
        on bail in the event of arrest or surrender<\/p>\n
        before   the    learned      court   below    within       a<\/p>\n
        period   of     twelve      weeks    from     today    in<\/p>\n
        connection with Siwan Town P.S. Case No. 102<\/p>\n
        of   1998      on       furnishing   bail     bond     of<\/p>\n
        Rs.10,000\/-(Ten Thousand) with two sureties<\/p>\n
        of the like amount each to the satisfaction<\/p>\n
        of the learned C.J.M. Siwan, subject to the<\/p>\n
        conditions as laid down under Section 438(2)<\/p>\n
        of the Code of Criminal Procedure.<\/p>\n
