HANSARIA\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>1995 (3) SCR 634<\/p>\n<p>The following Order of the Court was delivered:\n<\/p>\n<p>The petitioners working under the Directorate General of Quality Assurance<br \/>\nand holding the post of Junior Scientific Officers, a Class-II post on the<br \/>\ndate the petition was filed, seek a direction that the amendment in the<br \/>\nRules which provide that Junior Scientific Officer (Promotees) in order to<br \/>\nhold the post of Senior Scientific Officers-II should have a Master&#8217;s<br \/>\nDegree, be declared ultra vires. In the alternative it is claimed that<br \/>\nsince the petitioners were empanelled as Junior Scientific Officers Grade-<br \/>\nII they were entitled to same benefit under the Rules framed by the<br \/>\nGovernment as was extended to those promotees who were working on the post<br \/>\nof Senior Scientific Officers Grade-II.\n<\/p>\n<p>Relevant Rules framed by Ministry of Defence are known as Defence Quality<br \/>\nAssurance Rules, 1979. Rule 8 of it provides that 50% of the posts of<br \/>\nSenior Scientific Officers are to be filled by promotion on basis of<br \/>\nselection on merit from the grade of Junior Scientific Officers. The number<br \/>\nof posts, designation, pay and eligibility are provided by Schedule I to<br \/>\nthe Rules. The post of Senior Scientific Officer Grade II is mentioned at<br \/>\nserial no. 6. The entry is reproduced below :\n<\/p>\n<p>\t\t\t\t        Grade      from     which<br \/>\nSl.\tDesignation\tScale of\tNo. of\tpromotion is permissible<br \/>\nNo.\tof post\tpay\tposts\t            and the minimum eligibility<br \/>\n \t\t\t\t            period prescribed\n<\/p>\n<p>1.<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>6.\tSenior\tRs. 700-40-\t200\tJunior Scientific Officer<br \/>\n\tScientific\t900EB-40-\twith  3  years&#8217;  regular<br \/>\n\tOfficer\t1100-50-130C\t\tservice in the grade and<br \/>\n\tGrade-II\t\t\tpossessing degree in Engineering<br \/>\n                                        \/Masters degree in Science  or<br \/>\n  \t\t\t                equivalent qualification. The<br \/>\n\t\t\t\t        requirement of educational<br \/>\n\t\t\t\t        qualification shall not<br \/>\n\t\t\t\t        apply to those holding the<br \/>\n\t\t\t\t        post of Junior Scientific<br \/>\n\t\t\t\t        Officer on regular basis on<br \/>\n\t\t\t\t        the date of promulgation<br \/>\n\t\t\t\t        of these rules.\n<\/p>\n<p>A Junior Scientific Officer thus could be promoted as Senior Scientific<br \/>\nOfficer only if he had put in three years regular service and possessed a<br \/>\nDegree in Engineering. The petitioners did not satisfy either condition.<br \/>\nThey were not working as Junior Scientific Officer on the date on which<br \/>\nthese Rules were enforced. They were only Diploma holders. What is urged on<br \/>\nbehalf of the petitioners is that the requirement of being possessed of a<br \/>\ndegree was applicable for direct appointments and not to promotees. The<br \/>\nlearned counsel vehemently urged that once a person holding diploma was<br \/>\nselected as a Junior Scientific Officer then for purposes of promotion to<br \/>\nthe post of Senior Scientific Officer the eligibility criteria of higher<br \/>\nqualification could not be applied to him. The learned counsel further<br \/>\nurged that the petitioners having worked for quite long time they were<br \/>\nentitled to be promoted on basis of their experience. And the requirement<br \/>\nof degree should not be adhered to. The Rules came into force in September<br \/>\n1979. The feeder post for Senior Scientific Officer Grade. II under<br \/>\nSchedule I to the Rules is Junior Scientific Officer. Therefore, no one<br \/>\ncould be promoted unless he satisfied the eligibility criteria as laid down<br \/>\nin the Rules. The petitioners had no doubt been empanelled on the earlier<br \/>\nRules, for being promoted to the post of Junior Scientific Officers, but<br \/>\nthat did not confer any right on them to be considered for higher post.<br \/>\nThey were not Junior Scientific Officers. They had not even acquired any<br \/>\nexperience of Junior Scientific Officer. Mere entitlement to be appointed<br \/>\nas Junior Scientific Officer did not make them a Junior Scientific Officer.<br \/>\nSince the petitioners were not working as Junior Scientific Officers they<br \/>\ncould not be said to have undergone three years&#8217; regular service as such.<br \/>\nFurther they are only diploma holders. Neither of the eligibility criteria<br \/>\nwas satisfied. Since on the date when Rules came into force they were not<br \/>\neven Junior Scientific Officers they cannot successfully claim to have been<br \/>\naffected by the rule. Even the submission that the requirement of<br \/>\npossessing a degree for being appointed to the post of Senior Scientific<br \/>\nOfficer Grade II applied only to direct appointments and not to the<br \/>\npromotion is not made out by Schedule I to 1979 Rules. The submission of<br \/>\nthe learned counsel that this provision should be read by bifurcating into<br \/>\ntwo and the requirement of three years should be taken for promotion and<br \/>\nengineering for the direct recruitment is without any substance.\n<\/p>\n<p>The submission of the learned counsel that the petitioners who were<br \/>\nempanelled should be extended the same benefit as those who were working on<br \/>\nregular basis too cannot be accepted as those who were empanelled could not<br \/>\nbe treated alike to those who were working and holding the post of Junior<br \/>\nScientific Officer.\n<\/p>\n<p>In the result, this petition fails and is dismissed.\n<\/p>\n<p>Petition dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Scheduled Caste Uplift Union And &#8230; vs Union Of India And Ors on 20 April, 1995 Bench: R.M.
