SALAUDDIN, ASSISTANT TEACHER NEW PRIMARY SCHOOL,\n    MARUAHA, MUKHIYA TOLA, SAKARA, MUZAFFARPUR              .....Respondents\n                         ----------------------------------\n<\/pre>\n<p>2   05-08-2011               Heard learned counsel for the appellant.<\/p>\n<p>                             The writ court has placed reliance upon<\/p>\n<p>                   findings given by the Appellate Tribunal, particularly,<\/p>\n<p>                   those in paragraphs 27, 36 and 44 for forming a<\/p>\n<p>                   conclusion that the appointment process relating to the<\/p>\n<p>                   writ petitioners on the post of Panchayat Teacher was<\/p>\n<p>                   against the rules governing such appointment and the<\/p>\n<p>                   Panchayat Secretary alone created the list of selected<\/p>\n<p>                   candidates without paying heed to the requirement of<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        rules.\n<\/p>\n<p>                   An attempt was made by learned counsel for<\/p>\n<p>        the appellants to show that the Tribunal has not come<\/p>\n<p>        to correct conclusions.\n<\/p>\n<p>                   The Tribunal had the opportunity of going<\/p>\n<p>        into the documents and registers of the Panchayat and<\/p>\n<p>        after considering the relevant materials it has come to a<\/p>\n<p>        relevant finding of facts.\n<\/p>\n<p>                   We cannot act as an appellate forum for<\/p>\n<p>        reappraising the evidence for the purpose of reversing<\/p>\n<p>        the finding of facts.\n<\/p>\n<p>                   We have also looked into some paragraphs<\/p>\n<p>        of the order of the Appellate Tribunal, particularly,<\/p>\n<p>        those in paragraphs 44 and 45. They clearly held the<\/p>\n<p>        entire selection process to be vitiated including the<\/p>\n<p>        process under which these appellants were appointed.<\/p>\n<p>                   We find no good reasons to interfere in the<\/p>\n<p>        matter.
