The present<br \/>\napplicant-accused is allegedly involved in  chain snatching and  also<br \/>\nof the theft of Nokia Mobile, as per the FIR given on 14.11.2010.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr.G.A.Pathan appearing for the applicant strenuously argued<br \/>\nfor and on behalf of the applicant-accused that though other offences<br \/>\nare shown in the police record of similar nature, connecting this<br \/>\naccused, the fact remain that the accused is falsely involved by the<br \/>\npolice in each of them. Emphasizing on panchnama drawn at Vejalpur<br \/>\nPolice Station an attempt is made to point out that the present<br \/>\napplicant and his friends have had a row with police in connection<br \/>\nwith the papers of vehicles during the vehicle checking. He has been<br \/>\nfalsely implicated in all the matters which are pending before the<br \/>\ndifferent police stations undetected. He also pointed out that, in<br \/>\nrest of the three offences, the accused has been already enlarged on<br \/>\nbail. He urged  the court that the accused is a young boy of  22<br \/>\nyears old age and he has been per force arraigned in the alleged<br \/>\noffence. Charge-sheet  is already prepared by the police and the same<br \/>\nhas been filed before the Trial Court and there is no ground raised<br \/>\nof tampering  with the evidence. Therefore, it is urged that  the<br \/>\naccused be enlarged on bail on appropriate   conditions.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP points out to the Court that incidence of chain snatching in the<br \/>\nCity are on increase and present applicant is a  habitual offender.<br \/>\n The Court  may grant bail if it deems fit with strict conditions.\n<\/p>\n<p>4.<br \/>\nWhile allowing the Application, the aforementioned submissions and<br \/>\nthe facts that the charge-sheet has already been filed are to be kept<br \/>\nin mind and the accused is already in jail for the past more than 6<br \/>\nmonths; trial of this case is likely  to take a very long time, the<br \/>\naccused is required to be  ordered to be enlarged on bail with<br \/>\nfollowing conditions :-\n<\/p>\n<p>\t\tUnder<br \/>\nthe circumstances, the applicant is ordered to be released on bail in<br \/>\nconnection with C.R. No. I-CR No.323\/2010 on his furnishing surety of<br \/>\nRs. 20,000\/-(Rupees Twenty Thousands)  to the satisfaction of the<br \/>\nlower Court and subject to following conditions :\n<\/p>\n<p>Petitioner shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the Maninagar  Police Station on every 1st<br \/>\n\t &amp; 3rd Monday  of English Calendar month between<br \/>\n\t10:00 am to 11:00 am:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>in<br \/>\n\tno manner tamper with the evidence of the prosecution.\n<\/p>\n<p>not<br \/>\n\tact contrary to the law.\n<\/p>\n<p>\tIf<br \/>\nbreach of  any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nshall be given before the Lower Court having jurisdiction to try the<br \/>\ncase.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
