Ram Siya Kanojia vs The State Of Madhya Pradesh on 21 June, 2010<\/div>\n
                                    1\n\n\n\n\n                         W.P No.6036\/2010 (S)\n21.06.2010\n\n         Heard Shri S. K. Pathak, learned counsel for the petitioner,\n\non the question of admission and interim relief.\n\n         The petitioner, who is an Executive engineer, has filed this\n\npetition praying for a direction that the departmental proceedings\n\npending against him be directed to be completed by the respondent<\/pre>\n
authorities within a stipulated period of time as he is going to retire.<\/p>\n
         From a perusal of the petition it is clear that the petitioner<\/p>\n
has already retired on 31.1.2010 and that the departmental enquiry,<\/p>\n
after service of charge-sheet, is proceeding against him. There is<\/p>\n
no allegation of deliberate procrastination by the respondent<\/p>\n
authorities in the enquiry.\n<\/p>\n
         In such circumstances, no case for issuing any direction to<\/p>\n
the respondent authorities is made out.            The petition being<\/p>\n
meritless is, accordingly, dismissed. It needs no emphasis to state<\/p>\n
that the respondent authorities         shall decide the departmental<\/p>\n
enquiry pending against the petitioner in accordance with the<\/p>\n
Rules.\n<\/p>\n
         With   the   aforesaid   observation,   the   petition    stands<\/p>\n
dismissed.\n<\/p>\n
