        The writ petition is filed seeking the<\/p>\n
following reliefs.\n<\/p>\n<\/p>\n
        i)   To set aside the impugned orders at<\/p>\n
Exts.P7 to P9 orders dated 02\/09\/2008 of the court<\/p>\n
of the Munsiff, Payyannur in O.S No.355\/01.<\/p>\n
        ii)    To direct   the  Court of Munsiff,<\/p>\n
Payyannur  to  restore   the  I.A   No.  1119\/2008,<\/p>\n
1087\/2008 and 1088\/2008 on the file and to allow<\/p>\n
the same.\n<\/p>\n

          iii)     To declare that unless the resurvey<\/p>\n
is conducted in the matter based on the title deeds<\/p>\n
and   accordingly      resurvey   boundaries   are  fixed<\/p>\n
substantial     injustice    shall    be  caused  to  the<\/p>\n
parties to the suit, O.S No.355\/2001.<\/p>\n
          iv)    To declare that in view of the well<\/p>\n
settled     position     in   law,    in  petitions   for<\/p>\n
impleading      and     amendment    no   limitation   is<\/p>\n
applicable and liberal approach is necessary with a<\/p>\n
view to secure ends of justice.\n<\/p>\n<\/p>\n
          v)      To   grant  such    other  and  further<\/p>\n
reliefs as this Hon’ble Court may consider just and<\/p>\n
proper in the facts and circumstances of the case.<\/p>\n
          2.     Petitioner is the plaintiff in O.S<\/p>\n
No.355 on the file of the Munsiff Court, Payyannur.<\/p>\n
Suit   is    for   fixation   of   boundaries,   and  the<\/p>\n

respondents      are   the  defendants    in  the  suit.<\/p>\n
Respondents filed their written statement resisting<\/p>\n
the suit claim.      Plaintiff moved three applications<\/p>\n
seeking     impleadment    of    survey    officials  as<\/p>\n
additional     defendants   8   and    9  in  the  suit,<\/p>\n
consequential amendment on such impleadment in the<\/p>\n
plaint, and also for dispensing the notice under<\/p>\n
Section 80 of the Code of Civil Procedure on<\/p>\n
impleading     of   survey  officials.      The  learned<\/p>\n
Munsiff passed separate orders on the respective<\/p>\n
applications, dismissing all of them.        Exts.P7, P8<\/p>\n
and P9 are the copies of the orders passed on the<\/p>\n
respective applications by the learned Munsiff.<\/p>\n
Propriety     and   correctness  of    those orders  are<\/p>\n
challenged     in   the  writ   petition   invoking  the<\/p>\n
supervisory jurisdiction vested with this court<\/p>\n
under Article 227 of the Constitution of India.<\/p>\n

          3.     I heard the counsel on both sides.<\/p>\n
The learned counsel for the petitioner submitted<\/p>\n
that    impleadment     of  the   survey   officials   as<\/p>\n
additional defendants 8 and 9 in the suit is<\/p>\n
essential     for   an  adjudication    of  the  disputes<\/p>\n
involved and fair disposal of the suit.        Since the<\/p>\n
survey officials are sought to be impleaded as<\/p>\n
Government      officials,    it    is    submitted,  an<\/p>\n
application was filed to dispense notice under<\/p>\n
Section 80 of the Code of Civil Procedure. I find<\/p>\n
no impropriety or illegality in the order passed by<\/p>\n
the court below dismissing the application moved by<\/p>\n
the   petitioner      for impleadment    of  the   survey<\/p>\n
officials dispensing with the notice under Section<\/p>\n
80 of Code of Civil Procedure.         Section 80 of the<\/p>\n
Code of Civil Procedure is based on public purpose<\/p>\n
which mandates issue of a notice to the Government<\/p>\n
in advance, stating the particulars of the suit<\/p>\n
claim,    before    any  suit   is   filed  against  the<\/p>\n

Government or public officer.         The object of the<\/p>\n
Section is to avoid unnecessary litigation.          When<\/p>\n
the mandate of the Section is to give notice before<\/p>\n
institution     of   a  suit,  after    filing  the  suit<\/p>\n
seeking dispensation of that notice by filing a<\/p>\n
petition before the court cannot be entertained. In<\/p>\n
“Bihari Chowchary and others v State of Bihar and<\/p>\n
others” (AIR 1984 SC 1043) the apex court has<\/p>\n
considered the scope of Section 80 of Code of Civil<\/p>\n
Procedure and it has been held that any suit filed<\/p>\n
against    the    Government  or    public  officer   not<\/p>\n
complying with the mandate of Section 80 of Code of<\/p>\n
Civil Procedure is not maintainable.        Further more,<\/p>\n
survey officials are sought to be impleaded without<\/p>\n
bringing the Government as an additional defendant.<\/p>\n
That    is   also    against  the    provisions   covered<\/p>\n
by   Order    27    Rule  5  of    the   Code  of   Civil<\/p>\n
Procedure.       Whatever be the case of plaintiff,<\/p>\n
for     impleadment     of   the     survey    officials,<\/p>\n

in view of the statutory bar, I find the orders<\/p>\n
passed by the learned Munsiff under Exts.P7, P8 and<\/p>\n
P9 are unassailable, but, I make it clear that none<\/p>\n
of the observations made in      this orders shall have<\/p>\n
any bearing in disposal of the suit on merits.<\/p>\n
Writ petition lacks merit, and it is dismissed.<\/p>\n
