Justice ANTONY DOMINIC\n\n Dated :03\/03\/2009\n\n O R D E R\n                          ANTONY DOMINIC, J.\n                          ==============\n                     W.P.(C) NO. 6064 OF 2009 (C)\n                    ====================\n\n                 Dated this the 3rd day of March, 2009\n\n                              J U D G M E N T\n<\/pre>\n<p>       Petitioner wants a passport and initially his application was rejected.<\/p>\n<p>The aforesaid order was challenged before this Court in WP(C)<\/p>\n<p>No.30125\/08. The writ petition was disposed of by Ext.P1 judgment,<\/p>\n<p>recording that the rejection was on account of the fact that the petitioner<\/p>\n<p>had not disclosed the pendency of Crl.Appeal No.1440\/05 before this Court<\/p>\n<p>and directing that it will be open to the petitioner to make a fresh<\/p>\n<p>application. Subsequently, petitioner made an application and still passport<\/p>\n<p>was not issued. It is in these circumstances, the writ petition has been<\/p>\n<p>filed praying for orders for the issue of passport.<\/p>\n<p>       2.    Learned counsel appearing the respondent on instruction<\/p>\n<p>submits that on receipt of the second application from the petitioner, the<\/p>\n<p>matter was forwarded to the Superintendent of Police for verification. It is<\/p>\n<p>stated that report was received stating that the criminal appeal referred to<\/p>\n<p>above is pending consideration of the High Court and therefore passport<\/p>\n<p>cannot be issued in view of Section 6(2)(f) of the Passport&#8217;s Act. It is also<\/p>\n<p>pointed out that in terms of the procedure followed by them, if the<\/p>\n<p>petitioner obtains a no objection certificate from the court where the case<\/p>\n<p>WPC 6064\/09<br \/>\n<span class=\"hidden_text\">                                      :2 :<\/span><\/p>\n<p>is pending, the application will be considered.<\/p>\n<p>      3.    True as contended by the counsel for the respondents, in view<\/p>\n<p>of the provisions of Section 6(2)(f) of the Act, a person involved in a<\/p>\n<p>criminal case is ineligible to be issued a passport, and the only exception is<\/p>\n<p>a case where a no objection certificate from the Court where the case is<\/p>\n<p>pending is produced.\n<\/p>\n<p>      Therefore, I dispose of this writ petition leaving it open to the<\/p>\n<p>petitioner to pursue the matter as submitted by the standing counsel<\/p>\n<p>appearing for the respondents.\n<\/p>\n<\/p>\n<p>                                               ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Girish.R vs The Regional Passport Officer on 3 March, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 6064 of 2009(C) 1.
