Justice ANTONY DOMINIC\n\n Dated :02\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                 W.P.(C) NO.27202 OF 2010(A)\n              --------------------------------------------------\n         Dated this the 2nd day of September, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioner was an applicant for ARD.No.58 for Kunnathur<\/p>\n<p>Taluk in Kollam District, along with respondents 4 to 6. On<\/p>\n<p>conclusion of the selection process,            the 4th respondent was<\/p>\n<p>appointed. Against that appointment, petitioner and others filed<\/p>\n<p>appeal which was disposed of by the District Collector setting<\/p>\n<p>aside the appointment and ordering re-notification. This order was<\/p>\n<p>confirmed by the Commissioner and the Government. Now the<\/p>\n<p>petitioner contends that since the order appointing the 4th<\/p>\n<p>respondent has been set aside, instead of re- notification, his<\/p>\n<p>candidature ought to have been considered for appointment.<\/p>\n<p>      2.  Against the appointment of the 4th               respondent, the<\/p>\n<p>petitioner filed an appeal before the District Collector and had<\/p>\n<p>secured an order for re-notification and petitioner did not pursue<\/p>\n<p>the matter thereafter. Therefore, as far as the petitioner is<\/p>\n<p>concerned, with the order of the District Collector, the<\/p>\n<p>proceedings have become final. This order requires re-notification<\/p>\n<p>and therefore the petitioner cannot now seek an order from this<\/p>\n<p>WPC.No. 27202\/2010<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>court requiring the respondents to consider his candidature for<\/p>\n<p>appointment. In that view of the matter the relief sought for<\/p>\n<p>cannot be granted.\n<\/p>\n<p>      3.
