1 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nHL\nPATEL ADVOCATES for\nPetitioner(s) : 1, \nGOVERNMENT PLEADER for Respondent(s) :\n1, \nNOTICE SERVED for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Advocate appearing for HL Patel Advocates for petitioner and<br \/>\n\tlearned AGP Mr. Maulik Nanavati for respondent No.1.\n<\/p>\n<p>According<br \/>\n\tto petitioner, he was appointed as Sanitary Mukadam in Health and<br \/>\n\tFamily Department, Gandhinagar on 27.8.1970 and petitioner retired<br \/>\n\ton 30.6.2009 but no entry has been made in service book of<br \/>\n\tpetitioner by respondent no.2, therefore, communication has been<br \/>\n\tmade by petitioner to respondent no.1  on 12.10.2009 and also<br \/>\n\trequested respondent authority to consider case of petitioner for<br \/>\n\tpensionary benefits as petitioner has not been paid  any amount till<br \/>\n\tdate after getting retirement from service.\n<\/p>\n<p>Learned<br \/>\n\tAGP Mr. Maulik Nanavati submitted that now, respondent no.2 Notified<br \/>\n\tArea being Chief Officer has become Municipal Corporation and<br \/>\n\tCommissioner, Gandhinagar Municipal Corporation is the authority<br \/>\n\twhich can consider such application of petitioner for pensionary<br \/>\n\tbenefits.\n<\/p>\n<p>Therefore,<br \/>\n\tlet petitioner may approach Municipal Commissioner, Gandhinagar<br \/>\n\tMunicipal Corporation, Gandhinagar for getting pensionary benefits<br \/>\n\ton the basis of date of retirement 30.6.2009 within period of<br \/>\n\tfifteen days from date of receipt of copy of present order.\n<\/p>\n<p>As<br \/>\n\tand when Municipal Commissioner, Gandhinagar Municipal Corporation,<br \/>\n\tGandhinagar receives such representation from petitioner claiming<br \/>\n\tpensaionry benefits, it is directed to  Municipal Commissioner,<br \/>\n\tGandhinagar Municipal Corporation, Gandhinagar to consider such<br \/>\n\trepresentation, examine grievance of petitioner and as early as<br \/>\n\tpossible to decide it within period of one month from date of<br \/>\n\treceiving such representation from petitioner and then to<br \/>\n\tcommunicate decision to petitioner immediately   thereafter.\n<\/p>\n<p>In<br \/>\n\tview of these observations and directions, present petition is<br \/>\n\tdisposed of by this Court without expressing any opinion on merits.<br \/>\n\tDirect Service is Permitted.\n<\/p>\n<p>(H.K.\n<\/p>\n<p>Rathod,J.)<\/p>\n<p>Vyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vasangji vs State on 20 July, 2011 Author: H.K.Rathod, Gujarat High Court Case Information System Print SCA\/421\/2011 2\/ 2 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SPECIAL CIVIL APPLICATION No. 421 of 2011 ========================================================= VASANGJI HARIJI THAKOR &#8211;
