Case No. 277<\/p>\n<p>                  of 2011 registered for the offence under<\/p>\n<p>                  sections 420 and 406 of the Indian                  Penal<\/p>\n<p>                  Code, the petitioners have prayed for grant<\/p>\n<p>                  of bail.\n<\/p>\n<p>                             Learned counsel for the petitioner<\/p>\n<p>                  submits that from the perusal of the F.I.R.<\/p>\n<p>                  itself, it would transpire that the case<\/p>\n<p>                  appears     essentially    to     be     of   a     civil<\/p>\n<p>                  nature. He further submits that ingredients<\/p>\n<p>                  of offence under sections 406 and 420, he<\/p>\n<p>                  is   completely      missing    in     this   case.    He<br \/>\n         further submits that at best it would be a<\/p>\n<p>        case of breach of agreement for which the<\/p>\n<p>        aggrieved party may seek proper remedy in<\/p>\n<p>        accordance with law. Without expressing any<\/p>\n<p>        opinion on the merit of the case for the<\/p>\n<p>        purposes     of   bail,    I        am    convinced     that<\/p>\n<p>        petitioners deserve to be enlarged on bail.<\/p>\n<p>                   Taking into consideration the facts<\/p>\n<p>        and   submissions     made      on        behalf   of    the<\/p>\n<p>        parties, let the petitioners, namely M.K.<\/p>\n<p>        Srivastava @ Mritunjay Kumar Srivastava and<\/p>\n<p>        Prakash Mani Gaurav, in the event of their<\/p>\n<p>        arrest or surrender before the court below<\/p>\n<p>        within a period of four weeks from the date<\/p>\n<p>        of communication of this order, be released<\/p>\n<p>        on bail      on furnishing bail bonds of Rs.<\/p>\n<p>        5,000\/-     (five   thousand)             each   with    two<\/p>\n<p>        sureties of the like amount each to the<\/p>\n<p>        satisfaction of the learned Chief Judicial<\/p>\n<p>        Magistrate,       Patna,       in        connection     with<\/p>\n<p>        Kotwali P.S.
