The said<br \/>\npremises was let out to the original defendants at a monthly rent of<br \/>\nRs. 12\/- per month since 1.1.1960. On 23.1.1974, the plaintiffs<br \/>\nserved Notice to the defendants, seeking possession of the said suit<br \/>\npremises. Thereafter, Rent Suit No. 1217 of 1975 filed by the<br \/>\nplaintiffs for possession on the ground that the  defendants had<br \/>\nacquired suitable accommodation. The said suit came to be dismissed<br \/>\nby the judgment and order dated 29.6.1978. Against said judgment and<br \/>\norder the plaintiffs preferred Civil application No. 218 of 1978,<br \/>\nwhich also came to be dismissed. Thereafter, the plaintiffs preferred<br \/>\nCivil Revision Application No. 806 of 1990, before this Court, which<br \/>\ncame to be allowed and this Court has remanded the said matter for a<br \/>\nfresh trial only on the issue of alternative suitable accommodation.\n<\/p>\n<p>2.1.\t\tThereafter,<br \/>\nthe said suit again came to be tried by the Trial court, Small Causes<br \/>\nCourt, Baroda.  On 16.7.1996, the learned Judge after hearing the<br \/>\nparties has passed the decree of eviction. Being aggrieved with the<br \/>\nsaid judgment and decree dated 16.7.1996, the plaintiffs preferred<br \/>\nRegular Civil Appeal No. 95 of 1996. Vide order dated 06.08.1999, the<br \/>\nsaid appeal also came to be rejected. Hence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned Advocates for both the parties.\n<\/p>\n<p>4.\t\tMr.\n<\/p>\n<p>H.T.M. Hakim, learned Advocate for the applicant has contested only<br \/>\non the point that the both Courts below have failed to appreciate<br \/>\nthat the applicants formerly original defendant No. 1\/1 and 1\/2 have<br \/>\nnot acquired suitable accommodation. The allotment which was alleged<br \/>\nwas not on record to show that the possession was taken and whether<br \/>\nthe suitable  accommodation which was acquired was suitable or not<br \/>\nwas also not considered. He also contended that the Trial court has<br \/>\ncommitted an error in granting Eviction decree.\n<\/p>\n<p>5.\t\tLearned<br \/>\nAdvocate for the respondents supported the order of the Courts below<br \/>\nand contended that the Trial Court while deciding the suit has framed<br \/>\nfollowing issues.\n<\/p>\n<p>&#8220;1.\twhether the<br \/>\nplaintiff bonafide and reasonable requires the possession of the suit<br \/>\npremises for his own personal use and occupation ?\n<\/p>\n<p>2.\tIf so, to whom the<br \/>\ngreater hardship would be caused to the defendant by passing a decree<br \/>\nfor eviction or to the plaintiff by refusing to pass it ?\n<\/p>\n<p>3.\tWhether the<br \/>\ndefendant after coming in to force of the Bombay Rent Act, built or<br \/>\nacquired vacant possession of or  has been alloted a suitable<br \/>\nresident ?\n<\/p>\n<p>4.\tWhat was the<br \/>\nprincipal purpose of letting ?\n<\/p>\n<p>5.\tWhether the<br \/>\ndefendant has unlawfully sublet the suit premises or has assigned or<br \/>\ntransferred his interest therein to defendant NO.2 ?\n<\/p>\n<p>6.\tWhether defendant<br \/>\nNo.2 has changed the user ?\n<\/p>\n<p>7.\tWhether the<br \/>\ndefendants have committed breach of the terms of the tenancy ?\n<\/p>\n<p>8.\tWhether the notice<br \/>\nis legal and valid ?\n<\/p>\n<p>8.A. What should be the<br \/>\nstandard rent of the suit premises ?\n<\/p>\n<p>9. Whether the<br \/>\nplaintiff is entitled to recover possession of the suit premises ?\n<\/p>\n<p>10.\tWhat order and<br \/>\ndecree.&#8221;\n<\/p>\n<p>6.\t\tAfter<br \/>\nconsidering the issues between the parties and after remand from this<br \/>\nCourt, the Court below has reconsidered the evidence and in paragraph<br \/>\nNos. 11 and 12 has observed as under:-\n<\/p>\n<p>&#8220;11. Now, at this<br \/>\nstage the question arise that whether the defendant No.2\/1 to 2\/4 who<br \/>\nare the heirs of the deceased defendant No.2 are in possession of the<br \/>\nsuit premises and are liable to be evicted from the suit premises ?<br \/>\nNow, let see the evidence of the plaintiff in this respect, it is an<br \/>\nadmitted fact that the deceased Megharaj Keshumal the father of the<br \/>\ndefendants-original tenant of the suit premises and after his death<br \/>\nboth the defendants have got tenancy right U\/d 5(11)(C) of the Bombay<br \/>\nRent act. Under these circumstances, I can say that if the defendant<br \/>\nNo.1 has acquired the suitable alternative accommodation in Savad<br \/>\ncolony even though the defendant No.2 cannot be liable to evict from<br \/>\nthe suit premises on this ground as they become the tenant by virtue<br \/>\nof Sec. 5(11)(C) of the Bombay Rent Act.\n<\/p>\n<p>12. Now, I would like<br \/>\nto discuss about the acquisition of the premises by the defendant No.<br \/>\n2\/1 Mayaben in Gokulnagar, Gotri, Vadodara. In this case the<br \/>\ndefendant No.2\/1 Mayaben has specifically admitted in her deposition<br \/>\nthat block No. 806 in Gokulnagar was allotted to her by Gujarat<br \/>\nHousing Board in the month of April, 1990. The allotment letter is<br \/>\nproduced at Exh.116 on record. It further reveals from the deposition<br \/>\nof the plaintiff witness No.3 Lakshmanbhai who is serving in Gujarat<br \/>\nHousing Board as a Rent Collector that this block is consisted of one<br \/>\nroom, kitchen, bath-room, latrin and with the facility of water,<br \/>\ndrainage and electricity. In view of this fact, I can safely say that<br \/>\nthe plaintiff has proved that the defendant No.2\/1 Mayaben has<br \/>\nacquired alternative accommodation in Gokulnagar, in the locality of<br \/>\nGotri Vadodara. Now, let us see the further evidence of the defendant<br \/>\nNo.2 in this respect the defendant No.2\/1 Mayaben has also<br \/>\nspecifically admitted in her deposition that she has disposed of the<br \/>\nsaid block of Gokulnagar and now, she is not the possession of the<br \/>\nsaid block. She has further stated that after the death of her<br \/>\nhusband, she is unable to pay the installment of the said block to<br \/>\nGujarat Housing Board and therefore, she has disposed of the said<br \/>\nblock. In view of this fact, I come to conclusion that the defendant<br \/>\nNo. 2\/1 tenant Mayaben has acquired alternative accommodation in<br \/>\nGokulnagar, Gorti. As I have discussed earlier that it is well<br \/>\nestablished position of law that once the plaintiff has proved that<br \/>\nthe defendant-tenant has acquired alternative suitable accommodation<br \/>\nthen the burden lies on the tenant to prove that it is not suitable<br \/>\naccommodation. In the present case, It is an admitted fact that the<br \/>\ndefendant No.2\/1 Mayaben has acquired alternative suitable<br \/>\naccommodation in Gotri and it is proved by the plaintiff. But in this<br \/>\ncase the defendant No.2\/1 has not lead any sufficient evidence to<br \/>\nshow that the premises of Gokulnagar was not sufficient for herself<br \/>\nand her family members and she has not produced any documentary<br \/>\nevidence in support thereof. Under these circumstances, I can safely<br \/>\nsay that the defendant No.2\/1 has acquired alternative suitable<br \/>\naccommodation.&#8221;\n<\/p>\n<p>7.\t\tIt<br \/>\nappears from the record that the Trial Court has specifically found<br \/>\nthat defendant No.2\/1- Mayaben, has also acquired the premises, in<br \/>\nview of the family requirement, the landlord has clearly established<br \/>\nthat the defendant No.2\/1 has also acquired suitable accommodation.\n<\/p>\n<p>8.<br \/>\nIn view of the concurrent findings and limited jurisdiction, I am in<br \/>\ncomplete agreement with the findings arrived at and conclusion<br \/>\nreached by the Courts below. No substantial question of law involved<br \/>\nin this application. Therefore this application deserves to be<br \/>\ndismissed.
