Commissioner, NW District, Food\n                                            Supplies and Consumer Affairs, CSC, CC\n                                            Block, Shalimar Bagh, Delhi - 110088\n\nFacts<\/pre>\n<p> arising from the Complaint:\n<\/p>\n<p>The Complainant had requested for renewal of his BPL card but had not received a<br \/>\nresponse. The Complainant filed an Application with the Food and Supplies Officer<br \/>\nCircle No.22 on 15\/09\/2009 in which he requested the following:\n<\/p>\n<blockquote><p>    1. Rejection letter in response to his renewal application in accordance with the PDS<br \/>\n       Control Order 2001\n<\/p><\/blockquote>\n<blockquote><p>    2. Display of list of BPL\/AAY card holders in the Circle\n<\/p><\/blockquote>\n<blockquote><p>    3. Action should be taken against FSO and Assistant Commissioner who are<br \/>\n       responsible for not implementing the order of the Supreme Court by not<br \/>\n       displaying the list of BPL\/AAY card holders\n<\/p><\/blockquote>\n<blockquote><p>    4. In accordance with Section 4(1) of the RTI Act, reasons in writing why the<br \/>\n       Complainant&#8217;s renewal application has not been accepted.\n<\/p><\/blockquote>\n<p>However, no list was put up in the offices of the Bawana Circle.\n<\/p>\n<p>Vide order dated 16\/06\/2009, the Commission had directed the Department to fulfill its<br \/>\nobligations under Section 4 of the RTI Act and make the following information available<br \/>\nin every circle by 20 July 2009:\n<\/p>\n<p>    1. List of BPL\/AAY ration card holders.\n<\/p>\n<p>   2. List of applicants for renewal of BPL\/AAY ration cards with the dates on which<br \/>\n      such applications were made.\n<\/p>\n<p>   3. List of persons whose BPL\/AAY ration cards have been renewed and the dates on<br \/>\n      which the cards have been renewed.\n<\/p>\n<p>   4. List of applications for renewal of BPL\/AAY ration cards which have been<br \/>\n      rejected and the reasons for such rejection.\n<\/p>\n<p><span class=\"hidden_text\">                                                                             Page 1 of 2<\/span><\/p>\n<p> The Complainant was told by the FSO that he was not aware of the Commission&#8217;s<br \/>\naforementioned order.\n<\/p>\n<p>The Complainant has approached the Commission with the following prayer:<br \/>\n \u2022 To order the Respondent to provide him the rejection letter along with reason for<br \/>\n     rejection of BPL\/AAY card<br \/>\n \u2022 To recommend disciplinary action against the responsible officers<br \/>\n \u2022 To provide compensation of Rs. 5,000<br \/>\n \u2022 To impose penalty on the FSO and the AC for not implementing the order of the<br \/>\n     Commission<\/p>\n<p>Decision:\n<\/p>\n<p>The Complaint is allowed.\n<\/p>\n<p>Section 4(1)(d) of the RTI Act provides that every public authority shall provide reasons<br \/>\nfor its administrative or quasi-judicial decisions to affected persons. In view of this, the<br \/>\nRespondent is directed to provide the Complainant a copy of the rejection letter with<br \/>\nreasons for rejection of the Complainant&#8217;s application for renewal of BPL card before 20<br \/>\nJanuary 2010.\n<\/p>\n<p>With regard to disclosure of information in compliance of Section 4, RTI Act, the<br \/>\nCommission has issued directions to the Food Commissioner and Assistant<br \/>\nCommissioner vide Decision No. CIC\/SG\/C\/2009\/001621; 001622 and 1623\/6047 dated<br \/>\n22 December 2010 asking for compliance of Section 4 by 31 January 2010.
