1.  ‘bVrief.”facts, as alleged in the complaint<\/p>\n

 [a,3″  25.10.2004 at about 12.45 p.m., 1>w\u00ab3,
\nit it the Range Forest Officer went to Kyathara
\nCamp along with his staff namely PW-2.,<\/p>\n
Felix, Bhaskat Shetty, Manjunath and<\/p>\n
1\\\/I.R.Sadananda in the jeep belonging to the<\/p>\n
,:._….f’~\/”V<\/p>\n
Forest Department as he had information in<\/p>\n
the morning of that day that somertiwo<\/p>\n
persons were carrying sandal xvood—.’i:i}c_\u00a7g\u00e9;’}iy
\non a motor cycle from Thirthaha_:i}i_
\nShimoga. While they were <\/p>\n
said place, for sacid.__motor_ cjJcie,;’th’ey_not_;iced <\/p>\n
the accused 1 and ‘onVV:a’:movfr;or cycle
\nfrom Thirth\u00e9;hai.1i  seeing the<\/p>\n
compiainant-‘–~.andV’heist .s_t.af\u00a7.”‘Who were in<\/p>\n
u1j1ifori;frr1_1, acr:1isVed__.Njo,i who was riding the<\/p>\n
”  motorcycle towards
\niThirthnalha1l.i.:’in”_.order to escape from the

ffhe Viicompvlainant and his staff chased the<\/p>\n
‘M ‘vsaid_:..motorcycie. After covering a distance of<\/p>\n
.  kilometer, near 17’?! mile stone on the<\/p>\n
road towards Thirthahaili, one stage carriage
\nbus came from Thirthahalli side and the said
\nrnotorcycie dashed against. the said bus.
\nConsequently, the sandaiwood pieces that
\nwere being carried by the accused on the<\/p>\n

said motorcycle fell on the road and both the
\naccused sustained severe injuries as a result<\/p>\n
of the said accident,<\/p>\n
Thereafter. the complainant took
\ninjured \u00bb~ accused. to the  V’
\ntreatment. Then he retiirned  of;
\noffence and seized the   <\/p>\n
pieces, which had”‘vfa”iEen on the V<\/p>\n
mean time” he  ‘1\u00a7vejpt:d”wpatchlVon'”the said
\nsandalwood by  _1.Manj unath, a<\/p>\n
‘ “fQi%est\u00a7;11i’a.fd,and another person.<\/p>\n
   its case against the
\nacc1_tsed’.i’orl  otfence, the prosecution has got
\nH  to 3 and it has got marked the
\n to 12 and M.0.Nos.1 and 2. All the
\n H  are members of the staff of Forest
\n  I\ufb01epartrnent. CW\u00ab2, 4 and 5, the charge sheet witnesses
\n also members of the staff of the Forest Department
\nvivorking under PWI-3, the complainant. Therefore. the
\nlearned Counsel for the appellants —- accused strongly<\/p>\n
contended that the seizure of M.O.Nos.1 and 2, the<\/p>\n

signatures\ufb02oif _the_  CW2. Bhaskar Shetty and<\/p>\n
CW4}; Manjunatha, the forest guards, this fact is not<\/p>\n
 \u00bbst'ated .,in\u00ab.}:3x.P,2 seizure panchanama.<\/p>\n
it '  pertinent to note that none of CWs.2<\/p>\n
 andi\u00e9l. has been examined for the prosecution to prove<\/p>\n
A theseizure of the said sandal wood pieces.<\/p>\n
6. Besides this, PW1. I~i.R.SubraInanya, the<\/p>\n

Range Forest Officer claims to have examined the<\/p>\n
sandalwood pieces and issued EXP} to the effect that

vor”cond.1.Actor of –. V ”\n<\/p>\n
the said pieces were of sandalwood. Section 62 (c) of<\/p>\n
the Karnataka Forest Act, 1963 provides that aV.p.ejrs_on<\/p>\n
examining the forest produce shall be a <\/p>\n
not below the rank of a Range Forest Offic;er]an’d  *<\/p>\n
Forest Officer should have ur1d.erg_on.e’ ,trainilrig'”ir1\u00ab__tb,e<\/p>\n
examination of forest prodt!ce.._and'”ne–shouldlhave been <\/p>\n
authorised by the State  for”e2′;anivifning the
\nforest produce. if if .\n<\/p>\n
7. On pcareful-‘”i’eading_;=of”hfevviidence of PW}, it
\ncould be  a Range Forest
\nOfficer;  in his evidence that he had
\nundergone  of forest produce<\/p>\n
and\u00ab.{;hvat.~ he wnasavuthorised by the State Government for<\/p>\n
 \u00bbe\u00a7{aminirzg’the forest produce. This being so, it is quite<\/p>\n
provisions of Section 62 (C) of Karnataka<\/p>\n
 Forest Actiivhich_ are mandatory have not been complied<\/p>\n
  ‘l’herefore, the Very fact that iVI.O.1, the seized<\/p>\n
‘  forest produce were pieces of sandal wood, has not been<\/p>\n
it proved by the prosecution beyond reasonable doubt.<\/p>\n
