SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/08\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent petition under Article 226 of the Constitution of India read<br \/>\nwith with Section 482 of the Code of Criminal Procedure has been<br \/>\npreferred by the petitioner-original accused, who is now the husband<br \/>\nof the daughter of the original complainant, to quash and set aside<br \/>\nthe impugned Complaint\/FIR, being CR No. I 93\/2011 registered with<br \/>\nKapodara Police Station, Surat for the offences punishable under<br \/>\nSections 363 and 366 of the Indian Penal Code.\n<\/p>\n<p>2.\tRespondent<br \/>\nno. 2-original complainant-mother of Madhu @ Madhuri has lodged  the<br \/>\nFIR with Kapodara Police Station, Surat against the petitioner for<br \/>\nthe offences punishable under Sections 363 and 366 of the Indian<br \/>\nPenal Code alleging interalia that<br \/>\nthe petitioner has kidnapped and\/or abducted her daughter Madhu @<br \/>\nMadhuri aged 17 years 4 months and 15 days and thereby has committed<br \/>\nthe offence under Sections 363 and 366 of the Indian Penal Code.<br \/>\nBeing aggrieved and dissatisfied with the same, the petitioner, who<br \/>\nis now the husband of the daughter of the original complainant, has<br \/>\npreferred the present Special Criminal Application  under Article 226<br \/>\nof the Constitution of India  read with Section 482 of the Code of<br \/>\nCriminal Procedure to quash and set aside the impugned FIR.\n<\/p>\n<p>3.\tShri<br \/>\nViral Shah, learned advocate appearing on behalf of the petitioner<br \/>\nhas vehemently submitted that as such the petitioner has not<br \/>\ncommitted any offence as alleged under Sections 363 and 366 of the<br \/>\nIndian Penal Code.  It is submitted that as such the petitioner and<br \/>\nthe daughter of the original complainant-Madhu @ Madhuri  were<br \/>\nserving together in a diamond factory and they were in love with each<br \/>\nother and, therefore, she has gone voluntarily with the petitioner<br \/>\nand both of them married on 20\/04\/2011 and their marriage has also<br \/>\nbeen registered with the office of the Sub Registrar, Marriage<br \/>\nRegistration Office, Surat<br \/>\nMunicipal Corporation, Surat on 25\/04\/2011.  It is submitted that<br \/>\nboth the petitioner and the daughter of the original complainant are<br \/>\nstaying happily and, therefore, it is requested to quash and set<br \/>\naside the impugned FIR.\n<\/p>\n<p>4.\tIn<br \/>\nresponse to the notice issued by this Court, respondent no.<br \/>\n2-original complainant-mother of Madhu @ Madhuri is personally<br \/>\npresent in the Court and she has requested to pass an appropriate<br \/>\norder considering the statement of her daughter recorded by the<br \/>\nInvestigating Officer leaving the fate of her daughter on destiny and<br \/>\nher statement is that she has voluntarily gone with the petitioner<br \/>\nand they got married.\n<\/p>\n<p>5.\tShri<br \/>\nL.B. Dabhi, learned APP has requested to pass an appropriate order<br \/>\nconsidering the statement of the girl Madhu @ Madhuri.  He has<br \/>\nproduced on record the statement of the girl Madhu @ Madhuri recorded<br \/>\nby the Investigating Officer dated 02\/06\/2011, which is directed to<br \/>\nbe taken on record.\n<\/p>\n<p>6.\tHeard<br \/>\nShri Viral Shah, learned advocate appearing on behalf of the<br \/>\npetitioner, Shri L.B. Dabhi, learned APP appearing on behalf of the<br \/>\nrespondent-State and respondent no. 2-original<br \/>\ncomplainant-party-in-person and considered the statement of the girl<br \/>\nMadhu @ Madhuri, daughter of respondent no. 2-original complainant,<br \/>\nwho is reported to be now the wife of the petitioner.  The daughter<br \/>\nof respondent no. 2- original complainant-Madhu @ Madhuri has<br \/>\ncategorically stated that she has voluntarily gone with petitioner<br \/>\nand they have married on 20\/04\/2011 and their marriage is registered<br \/>\nwith  the office of the Sub Registrar, Marriage Registration Office,<br \/>\nSurat Municipal Corporation,<br \/>\nSurat on 25\/04\/2011.  She has also categorically stated before the<br \/>\nCourt that she wants to go with the petitioner, who is her husband.<br \/>\nConsidering the above, it cannot be said that the petitioner has<br \/>\ncommitted any offence, as alleged, under Sections 363 and 366 of the<br \/>\nIndian Penal Code and, therefore, to continue the criminal<br \/>\nproceedings against the petitioner would be abuse of process of Court<br \/>\nand law and, therefore, this Court is of the opinion that this is a<br \/>\nfit case to exercise powers under Section 482 of the Code of Criminal<br \/>\nProcedure and to quash and set aside the impugned FIR.\n<\/p>\n<p>7.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the present<br \/>\npetition is allowed and the impugned FIR, being CR No. I 93\/2011<br \/>\nregistered with Kapodara Police Station, Surat against the petitioner<br \/>\nfor the offences punishable under Sections 363 and 366 of the Indian<br \/>\nPenal Code is hereby quashed and set aside so far as the petitioner<br \/>\nis concerned.
