To give proof of receipt and dispatch of the RTI Photocopy of a letter showing movement of<br \/>\n     application while in the custody of the above the same is annexed further.<br \/>\n     officials.\n<\/p>\n<p>4.   According to office rules or citizens charter, what is Copy of the citizens charter is unavailable. A<br \/>\n     the period within which such application should be reply was given within 8 days of reception of<br \/>\n     disposed off, and enclose a copy of the same.           the application.\n<\/p>\n<p>5.   Having sent a late reply these officials have failed to Does not come under the RTI Act, 2005.\n<\/p>\n<p>     adhere to the rules and therefore will they be held<br \/>\n     guilty of misconduct under these rules? Kumar, Public Information Officer &amp; Veterinary Officer(HQ);\n<\/p>\n<p>        The appellant admits that the information has been provided to him. The appellant had filed the<br \/>\nRTI application because his application for the allotment of dairy plot has been rejected though he believe<br \/>\nthat he was eligible to such a plot. The PIO states that the application for allotment of dairy plot has been<br \/>\nrejected since the SDM has given a report that the dairy of the applicant was located in rural area.<br \/>\nSubsequently the PIO states that MCD realized that some other dairies in the same area had been certified<br \/>\nby SDM (Shahdara) Mr. D. Balaiah in urban area. Hence they sought clarification from him and the<br \/>\npresent SDM(Shahdara) has certified that the dairy of the applicant false in the urban area vide letter no.<br \/>\nF.no.SDM\/S.PUR\/2009-1071395 dated 04 August 2010. Hence the PIO has initiated the process to allot a<br \/>\ndairy plot to the appellant.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is disposed.\n<\/p>\n<p>       The Commission recommends to the Divisional Commissioner, 5, Shyam Nath<br \/>\nMarg, Delhi to inquire into how Mr. D. Balaiah, SDM(Shahdara) had stated that the<br \/>\napplicant&#8217;s dairy was in the rural area.
