She was appointed to the headquarters<\/p>\n<p>vacancy in the Regional Office of the PSC at Ernakulam. She was<\/p>\n<p>thereafter transferred to Thrissur. After two years of service there, she<\/p>\n<p>was transferred to Thiruvananthapuram. Since the petitioner could not<\/p>\n<p>make both ends meet if posted at Thiruvananthapuram, the petitioner<\/p>\n<p>obtained   an    inter-departmental        transfer    to   Local     Fund    Audit<\/p>\n<p>Department at Thrisusr, itself. Consequently, the petitioner was posted<\/p>\n<p>at Thrissur. Now the petitioner submits that since her posting was at<\/p>\n<p>headquarters vacancy, the petitioner can stake a claim for service<\/p>\n<p>benefits taking into account the service in the PSC as well for the<\/p>\n<p>purpose seniority in the Local Fund Audit Department. The petitioner<\/p>\n<p>seeks the following reliefs:\n<\/p>\n<blockquote><p>     &#8220;(i)   To issue a Writ of Mandamus or any other appropriate Writ,<br \/>\n            order of direction, directing the respondents to grant seniority<br \/>\n            to the petitioner taking into account the service put in by her as<br \/>\n            last grade servant under the Kerala Public Service Commission<br \/>\n            and pass appropriate orders:\n<\/p><\/blockquote>\n<blockquote><p>      (ii)  To issue a Writ of Mandamus or any other appearance Writ,<br \/>\n            order or direction, directing the respondents to consider Ext.P3<br \/>\n            representation submitted by the petitioner in accordance with<br \/>\n            law.&#8221;<\/p><\/blockquote>\n<p>      2.    The learned standing counsel for the Public Service<\/p>\n<p><span class=\"hidden_text\">w.p.c.28009\/10                      2<\/span><\/p>\n<p>Commission would contend that there is no district-wise appointment<\/p>\n<p>in the PSC and all appointments are State-wise.\n<\/p>\n<p>      3.     Whatever that be, the petitioner&#8217;s claim in respect of her<\/p>\n<p>appointment in the PSC cannot now govern the seniority in the Local<\/p>\n<p>Fund Audit Department, since the petitioner has requested for an<\/p>\n<p>inter-departmental transfer to the Local Fund Audit Department and<\/p>\n<p>consequentially, as per the conditions prescribed inter-departmental<\/p>\n<p>transfer, the petitioner can join in the Local Fund Audit Department<\/p>\n<p>only as the junior-most since that is the specific condition under which,<\/p>\n<p>inter-departmental transfer has been given to the petitioner. There is<\/p>\n<p>no way the petitioner can now seek seniority based on the period of<\/p>\n<p>service put in in the PSC Department.
