PATTANAIK (J)\n\nCITATION:\n JT 1996 (1)   631\t  1996 SCALE  (1)625\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>      We have heard the counsel on both sides.\n<\/p>\n<p>      This  appeal by special leave arises from the order of<br \/>\nthe High  Court of  Karnataka made  on February\t 15, 1991 in<br \/>\nW.P. No.9544\/86. Notification under Section 4(1) of the Land<br \/>\nAcquisition Act\t was initially\tc on  December 6,  1973. The<br \/>\ndeclaration under  Section 6  was published  on February  3,<br \/>\n1975. Writ  Petition No.  10402\/77 was\tfiled in  High Court<br \/>\nchallenging  the  notification\tunder  Section\t4(1)and\t the<br \/>\ndeclaration under  Section 6  questioning  the\tact  of\t the<br \/>\nGovernment in dispensing with the enquiry under Section 5-A.<br \/>\nThe Writ  Petition was allowed by the High Court on July 27,<br \/>\n1984 directing\tthe appellant  to conduct  an enquiry  under<br \/>\nSection 5-A  from the  stage where the objections were filed<br \/>\nby the\trespondent. Thereafter,\t the copy  of the recite was<br \/>\nreceived by  the Land  Acquisition Officer  of\tJanuary\t 19,<br \/>\n1985. Notice  under Section  5-A was  given on\tFebruary 20,<br \/>\n1985.  and   after  giving  reasonable\topportunity  to\t the<br \/>\nrespondent, enquiry  was concluded  and the Land Acquisition<br \/>\nOfficer, submitted  his report to the Government on July 31,<br \/>\n1985, The  respondent again  filed the\twrit petition in the<br \/>\nHigh Court  on June  7, 1986 challenging the validity of the<br \/>\nnotification under  Section 4(1)  and the  declaration under<br \/>\nSection 6.\n<\/p>\n<p>      The  High Court in the impugned judgment has held that<br \/>\nfrom December  6, 1973\ttill October  11, 1977, there was on<br \/>\norder of  Court staying\t the proceedings  by which  date the<br \/>\nthree year&#8217;s  period prescribed\t under Section\t6(1) of time<br \/>\nand the\t declaration under Section 6 come to be published on<br \/>\nApril 10. 1986. Consequently, the notification under Section<br \/>\n4(1) and  the declaration  under Section  6 stood  lapsed by<br \/>\noperation of  Section 11-A  of the Act, amended by Act 68 of<br \/>\n1984.\n<\/p>\n<p>      It is contended by the counsel for the appellants that<br \/>\nthe view  of the  high court  is clearly illegal. In view of<br \/>\nthe fact  that the  notification under Section 6 was quashed<br \/>\ngiving\tliberty\t  the  Government   to\tproceed\t  with\t the<br \/>\nacquisition from  that stage  and  consider  the  objections<br \/>\nraised by  the respondent,  the declaration  under Section 6<br \/>\ncame to be published within two years thereafter. Therefore,<br \/>\nthe  declaration   under   Section   6\t had   not   lapsed.<br \/>\nConsequently,  section\t 11-A  has  no\tapplication.  it  is<br \/>\ncontended for the respondent that as pointed out by the High<br \/>\nCourt from  1973 to  1977, there  was no  impediment for the<br \/>\nappellants to have the declaration published under Section 6<br \/>\nwithin three  years since the declaration was not published,<br \/>\nthe  High   Court  was\t fight\tin  holding  that  the\tland<br \/>\nacquisition proceedings shall stand lapsed.\n<\/p>\n<p>      Having  considered  the  respective  contentions,\t the<br \/>\nquestion arises\t whether the view taken by the High Court is<br \/>\ncorrect in  law. It  is true  that  from  the  date  of\t the<br \/>\nnotification published\tunder Section  4(1) till October 11,<br \/>\n1977 there  was no  stay granted  by the Court and the three<br \/>\nyears period  had lapsed.  But, unfortunately, the point was<br \/>\nnot  convassed\t before\t the   High  Court   in\t the   first<br \/>\nproceedings. Consequently,  by operation of explanation (iv)<br \/>\nto Section  11,it was  open to\tthe respondent to raise that<br \/>\ncontention.  But  since\t that  point  was  not\tpressed\t for<br \/>\nconsideration by  constructive res judicata, the question is<br \/>\nno longer to be considered by the High Court.\n<\/p>\n<p>      It  is seen that the Land Acquisition Officer received<br \/>\nthe record  on January\t19, 1985. He issued the notice under<br \/>\nSection\t 5-A   to  consider  the  objections  filed  by\t the<br \/>\nrespondent on February 20, 1995. Thereby there is a delay of<br \/>\none month  between the\tdate of receiving the record and the<br \/>\ndate of\t issuing the notice. Thereafter the proceedings went<br \/>\non from\t time to  time\tat  the\t instance  of  the  parties.<br \/>\nUltimately,the arguments  were concluded  on July  31, 1985.<br \/>\nTherefore, the limitation, again begin to run from August 1,<br \/>\n1985.  The  declaration\t was  published\t on  April  10,1986.<br \/>\ntherefore, the\tdeclaration, after  the order was set aside,<br \/>\nin the\tproceedings of the first writ petition was published<br \/>\nwithin three  years from the date of the order. By operation<br \/>\nof  Clause  (1)\t of  section  6\t the  declaration  has\tbeen<br \/>\npublished within  three years  from the\t date of  the  order<br \/>\npassed by  the High  Court. Consequently,  the operation  of<br \/>\nsection 11-A  is not attracted to the facts of this case. As<br \/>\na result,  neither the\tnotification under  Section 6  shall<br \/>\nstand lapsed.  The appellants  are directed  to conduct\t and<br \/>\nconclude the  award enquiry  as expeditiously  as  possible,<br \/>\npreferably within  a period  of six  months from the date of<br \/>\nthe receipt of this order.\n<\/p>\n<p>     The appeal is accordingly allowed.
