BASANT, J.\n\n           ````````````````````````````````````````````````````\n                 W.P.(C) No. 6162 OF 2008 H\n           ````````````````````````````````````````````````````\n          Dated this the 21st day of February, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>           Petitioner is the sole accused in a crime registered<\/p>\n<p>alleging offences punishable, inter alia, under section 506(1)<\/p>\n<p>IPC.    The crime was registered as early as in 2004.<\/p>\n<p>Investigation is in progress. But, despite the elapse of about<\/p>\n<p>four years, final report has not been filed. The petitioner has<\/p>\n<p>come before this Court with this writ petition with a prayer that<\/p>\n<p>the powers under Article 226 of the Constitution may be<\/p>\n<p>invoked to issue proper directions.\n<\/p>\n<p>      2.   The learned counsel for the petitioner was<\/p>\n<p>requested to explain how in the light of the decision in Sakri<\/p>\n<p>Vasu Vs. State of U.P. [ 2008 AIR SCW 309] the petitioner is<\/p>\n<p>entitled to request this Court to issue directions without and<\/p>\n<p>before exhausting the efficacious alternative remedies which<\/p>\n<p>are available to him. Admittedly, the petitioner has not moved<\/p>\n<p>WPC.6162\/08<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>the Magistrate. I do not find any circumstances in this case to<\/p>\n<p>take this case out of the sweep of the dictum in Sakri Vasu.<\/p>\n<p>The petitioner must approach the learned Magistrate        and<\/p>\n<p>seek appropriate directions to get his grievance remedied.<\/p>\n<p>     3.
