Urban Building (Regulation of letting, rent and  evic-\ntion) Act, 1972 for eviction of the tenant on the ground  of\nbona  fide  requirement- The prescribed\t authority  and\t the\nAppellate  Tribunal  found as a fact  that  the\t appellant's\nrequirement  was  bona fide and decreed the suit.  But,\t the\nHigh  Court set aside the order on the sole ground that\t the\nmarried\t daughters  of\tthe original tenant,  who  were\t the\nnecessary  parties, were not impleaded and,  therefore,\t the\nnon-joinder of the necessary parties disentitled the  appel-\nlant-landlady to have the ejectment of the tenants,  namely,\nthe sons and the widow of the deceased tenant.\nAllowing the appeal of the landlady, this Court,\n    HELD:  1.1\tSection 3(a)(2) of the U.P.  Urban  Building\n(Regulation,\tof  letting, rent and  eviction)  Act,\t1972\npostulates  that  tenant in relation to a building  means  a\nperson\tby whom rent is payable, and on the tenant's  death,\nin the case of a non-residential building, his heirs. There-\nfore, as defined under s3(a)(2) all heirs of the tenants are\nthe tenants who succeeded intestate as per the Hindu Succes-\nsion  Act,  1956. Consequently, the  married  daughters\t are\ntenants\t within the meaning of s. 3(a)(2), and\tentitled  to\nsucceed\t to  the tenant's lease-hold rights under  the\tAct,\nincluding not merely to the liabilities to pay rent but also\nto  continue  the  business until duly ejected\tas  per\t the\nprovisions of the Act. [537 B-C]\n    1.2\t However, in the instant case, the  original  tenant\ndied in 1965.\n536\nThereafter,  the  proceedings were initiated in\t 1974.\tTill\nthen,  one of the sons of the deceased tenant.\tnamely,\t the\nfirst  respondent was in occupation of the premises and\t did\ncarry on business. The married daughters never participated,\nnor claimed interest in the business conducted by the  first\nrespondent  and\t even before the death of the  father,\tthey\nwere married and they were living with their husbands  else-\nwhere. The Rent Appellate Tribunal has found that by  neces-\nsary  implication, the married daughters  surrendered  their\ntenancy\t rights\t inherited under the Act,  since  after\t the\ndemise\tof  the original tenant, the  daughters\t evinced  no\ninterest  to  assert their rights. In view  of\tthis,  their\nnon-impleadment\t as respondents does not vitiate the  action\nfor  non-joinder of them as necessary parties nor  maintain-\nability of the proceedings for ejectment itself. [S36 H, 537\nAB, D-E]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CIVIL APPELLATE JURISDICTION: Civil Appeal No. 129 of<br \/>\n1986.\n<\/p>\n<p>    From  the  Judgment\t and Order dated  12.5.1982  of\t the<br \/>\nAllahabad High Court in Civil Misc. Writ Petition No.  13431<br \/>\nof 1981.\n<\/p>\n<p>B.D. Agarwal and Indeever Goodwill for the appellant.<br \/>\nA.K. Srivastava for the Respondents.\n<\/p>\n<p>The following Order of the Court was delivered:\n<\/p>\n<p>      This  appeal  by special leave has been filed  by\t the<br \/>\nlandlady.  She\tlaid  action under s.21 of  the\t U.P.  Urban<br \/>\nBuilding  (Regulation  of letting, rent and  eviction)\tAct,<br \/>\n1972 (for short &#8216;the Act&#8217;) for eviction of the tenant on the<br \/>\nground\tof  bona fide requirement to start business  by\t her<br \/>\nson.  The  prescribed authority and the\t Appellate  Tribunal<br \/>\nfound  as  a fact that the appellant required  the  premises<br \/>\nbona fide to start the business. But the High Court  allowed<br \/>\nthe  writ petition, set aside the order on the\tsole  ground<br \/>\nthat the married daughters of the original tenant, Lalu were<br \/>\nnot impleaded who are the necessary parties and,  therefore,<br \/>\nthe  non-joinder  of the  necessary-parties  disentitle\t the<br \/>\nlandlady  to  have the ejectment of the tenants\t namely\t the<br \/>\nsons and the widow of the deceased tenant Lalu.<br \/>\n    The\t only question that arises in this case\t is  whether<br \/>\nthe  married daughters of the deceased tenant are  necessary<br \/>\nparties\t and that non-impleading them would  disentitle\t the<br \/>\nlandlady  to maintain the action for ejectment.\t Admittedly,<br \/>\nLalu  the original tenant died in 1%5. Thereafter, the\tpro-<br \/>\nceedings were initiated in 1974. Till then, one of the\tsons<br \/>\nof Lalu,<br \/>\n<span class=\"hidden_text\">537<\/span><br \/>\nnamely, Bhole Nath was in occupation of the premises and did<br \/>\ncarry  on business as admitted by him in  affidavit  Exhibit<br \/>\nSA-II &#8220;that the deponent is the tenant of a portion of house<br \/>\nNo. 55, Thatheri Bazar, Allahabad on payment of Rs. 40\/- per<br \/>\nmonth as rent including electric charges&#8221;. It is also not in<br \/>\ndispute\t that the married daughters never participated,\t nor<br \/>\nclaimed interest in the business conducted by Bhole Nath. It<br \/>\nis  also an admitted fact that even before the death of\t the<br \/>\nfather\tthey  were married and they are\t living\t with  their<br \/>\nhusbands elsewhere. Indisputably s.3 (a)(2) postulates\tthat<br \/>\n&#8220;In  this  Act, unless the context  otherwise  requires\t (a)<br \/>\ntenant in relation to a building means a person by whom\t its<br \/>\nrent  is payable, and on the tenant&#8217;s death (2) in the\tcase<br \/>\nof  a  non-residential building, his heirs.&#8221;  Therefore,  as<br \/>\ndefined\t under\ts.3(a)(2) all heirs of the tenants  are\t the<br \/>\ntenants who succeeded intestate as per the Hindu  Succession<br \/>\nAct, 1956. Certainly, therefore, they are tenants within the<br \/>\nmeaning\t of s.3(a)(2). They are entitled to succeed  to\t the<br \/>\ntenant&#8217;s  lease-hold  rights under the\tAct,  including\t not<br \/>\nmerely\tto the liabilities to pay rent as contended  by\t the<br \/>\nappellant  but\talso  to continue the  business\t until\tduly<br \/>\nejected\t as per the provisions of the Act.  Whether  non-im-<br \/>\npleadment  of the married daughters would vitiate  maintain-<br \/>\nability\t of the proceedings for ejectment. The\tfinding\t re-<br \/>\ncorded\tby  the Rent Appellate Tribunal\t that  by  necessary<br \/>\nimplication, the married daughters surrendered their tenancy<br \/>\nrights\tinherited under the Act. After the demise  of  Lalu,<br \/>\nthe daughters evinced no interest to assert their rights, is<br \/>\nwell  justified. Once that is found to be so,  their  nonim-<br \/>\npleadment  as  respondents does not vitiate the\t action\t for<br \/>\nnon-joinder of them as necessary parties nor maintainability<br \/>\nof  the\t proceedings for ejectment itself.  The\t High  Court<br \/>\ncommitted grave errors of law in allowing the writ  petition<br \/>\nand  dismissing the application for ejectment. The order  of<br \/>\nthe  High  Court  is set aside and that\t of  the  Prescribed<br \/>\nAuthority  and the Tribunal are restored. It is not in\tdis-<br \/>\npute  that the landlady offered a reasonable portion of\t the<br \/>\npremises to the respondent to an extent of 3-1\/2&#8217;x 6&#8242; in the<br \/>\nVaranda but respondent had refused to accept that offer\t but<br \/>\nin  this Court the learned counsel for the  respondents\t re-<br \/>\nquested\t to allow the tenant to retain the portion  offered.<br \/>\nIn  fairness,  Mr. Agarwal, learned senior counsel  for\t the<br \/>\nappellant, has not objected to it. Accordingly it is open to<br \/>\nthe  tenant to occupy the portion offered by  the  appellant<br \/>\nand vacate the other portion which is required by the  peti-<br \/>\ntioner\tfor starting the business of her son. The  appellant<br \/>\nwould  carve  out the portion in a suitable  and  convenient<br \/>\nmanner to run the business by the respondent.
