The petitioner has sought for setting aside the<\/p>\n

\nIPC and under Section 4 of the DowrygProhihitionuhct_T

\nto quash the proceedings thereon)<\/p>\n
2. The facts rele\ufb01ant for the purpose of this<\/p>\n
petition are as under:\n<\/p>\n
The yetitionere herein are accused Nos.1 to 6<\/span>
\nbefore the Court aside Efhe respondent has filed a<\/p>\n
complaint Beforex’the”.\ufb01agistrate, udupi alleging<\/p>\n
cruelty; and harassment at the hands of the<\/p>\n
Apetitionersl i e,, the accused. Ir: para_ 8 of ‘the<\/p>\n
complaint” she :states that the 1″ accused i.e.,<\/p>\n
lpetitionereNof6 herein left India after the marriage<\/p>\n
*\u00abjfofl2 months and after 2 weeks thereafter, accused 2<\/p>\n
‘and,3.have taken the complainant to Bangalore to one<\/p>\n
l”of the relatives house and started quarrelling and<\/p>\n
‘H’\u00bb\u00bb.al3using in filthy language and also threatened to<\/p>\n
bring more gold and sent her to her parental house.<\/p>\n
After 2 weeks, the complainant went to her<\/p>\n
Mi<\/p>\n
matrimonial house at Madras and stayed there. It is<\/p>\n
alleged that accused 2 to 6 have harassed her 55;”;<\/p>\n
months and thrown the complainant to street: Havi\ufb019;”_<\/p>\n
no other way, she is residing with her parents.in’<\/p>\n
Udupi. In this context, she has alleged}theHgrounds_}<\/p>\n
against the petitioners for the offence punishahle
\nunder Sections 493-22., 504, S’G\u00a7'(2) I15’c,_”r.’\u00ab;.r..\u00b0,34 19::<\/p>\n
and under Section 4 of the Act.n~’<\/p>\n
The learneds.Magistrate darts; rrecording the
\nstatement of _\ufb01\ufb01e gcomplainanti has “taken cognizance
\nand registered the criminal complaint. Aggrieved by
\nthe same\u00e9v this .p\u00a7\u00a7iti\u00a7nH is triled by the accused<\/p>\n
seeking quashing of the proceedings.<\/p>\n
Bli uiThe learnedv counsel for the petitioners<\/p>\n
Asubmits that the learned Magistrate at Udupi has no<\/p>\n
jurisdiction, to* entertain the complaint as the<\/p>\n
Voffences garei alleged to have taken place at<\/p>\n
4”?iEangalore\u00a5and Madras and that there is no allegation<\/p>\n
“a5\u00a2ut._ commission of the offence within the<\/p>\n
d”jurisdiction of the Court at Udupi. On these<\/p>\n
H* grounds, he has sought for quashing the proceedings.<\/p>\n

submits that there are no allegations with regard te_<\/p>\n
commission of the offence within the jurisdiction ofi\ufb01i<\/p>\n
the Magistrate Court at Udupl.,__anc:”””t’ha\u00e9g-a; <\/p>\n

\nIn the circumstances, he snhnits to \ufb01\ufb01hash the
\nproceedings with liberty’ to ‘file ithe conplaint
\nbefore the Courtp within xwhose ljnrisdiction the<\/p>\n

\npetitioners and also tne respondent.
\n6;%’A$ Gould be seen from the decision cited<\/p>\n
snprap wherein it is held that in view of Section<\/p>\n

l, ordinarily} be inquired into and ‘tried. by a Court<\/p>\n
\u00bb_\ufb01ithin whose local jurisdiction it was committed and<\/p>\n
“,’ze.”sueh circumstance, the Hon’ble Apex Court<\/p>\n
directed to transfer the case by exercising<\/p>\n
jlzrisdiction vested with Article 142 of the<\/p>\n

\nConstitution. As could be seen from the principle<\/p>\n
laid~down. by the Hon’ble Apex Court and also the<\/p>\n
allegations in ‘the complaint, nowhere it has pbeen<\/p>\n
stated by the complainant that the cause or action ,<\/p>\n
has arisen within the jurisdiction of the Qourt at f<\/p>\n
Udupi. So, taking into consideration_uc and under Section 4 of the Act<\/p>\n
are hereby”\ufb01uashed with liberty to the respondent to<\/p>\n
file the co\ufb01plaint before appropriate Court in whose<\/p>\n
