    Petitioners are accused 2 and 3 in Crime<\/p>\n
438\/2010 of Pattambi Police Station registered<\/p>\n
for the offence under section 420 read with<\/p>\n
section 34 of Indian Penal Code under Annexure<\/p>\n
A1 F.I.R.   The F.I.R was registered based on<\/p>\n
the complaint filed by the first respondent<\/p>\n
before  the  Judicial  First  Class  Magistrate<\/p>\n
Court-I, Pattambi and sent for investigation<\/p>\n
under  section  156(3)  of  Code   of  Criminal<\/p>\n
Procedure. Petition is filed under section 482<\/p>\n
of Code of Criminal Procedure to quash the<\/p>\n
proceedings against the petitioners who are<\/p>\n
accused 2 and 3 contending that even if the<\/p>\n
allegations  against   them  in   Annexure  A1<\/p>\n
complaint is accepted, no offence as against<\/p>\n
them is attracted and therefore continuation of<\/p>\n

the proceedings is only an abuse of process of<\/p>\n
court.\n<\/p>\n
      2.         Learned  counsel   appearing  for   the<\/p>\n
petitioners, first respondent and learned Public<\/p>\n
Prosecutor were heard.\n<\/p>\n
      3.      First respondent instituted O.S.176\/2008<\/p>\n
and O.S.177\/2008 before Munsiff’s Court, Pattambi.<\/p>\n
Advocate Bhaskaran Nair was appearing for the first<\/p>\n
respondent in both the suits.         In both the suits<\/p>\n
petitions        attachment    before judgment, of the<\/p>\n
moveables        of Veeramani  Textiles  owned   by  the<\/p>\n
fourth       accused, for realization of the amount of<\/p>\n
Rs.1,60,000\/- claimed in the suit were filed.         An<\/p>\n
order of attachment was passed on 16.12.2008.        The<\/p>\n
case in       Annexure A1 complaint is that before the<\/p>\n
attachment could         be effected, on 18.12.2008 as<\/p>\n
sent by the first accused, the counsel appearing<\/p>\n
for the fourth         accused for the defendants in the<\/p>\n
suit,     first    petitioner  the  junior  counsel and<\/p>\n
second petitioner the document writer along with<\/p>\n
the fourth accused went to the house of Advocate<\/p>\n

Bhaskaran Nair representing that first accused sent<\/p>\n
them praying that the order of attachment is to be<\/p>\n
withdrawn promising that Rs.50,000\/- will be paid<\/p>\n
and the balance will be paid within three months.<\/p>\n
It    is      alleged  that   Advocate  Bhaskaran  Nair<\/p>\n
contacted the first accused who also assured that<\/p>\n
payment will be made and thereafter accepting the<\/p>\n
promise       the  counsel   appearing for   the  first<\/p>\n
respondent       had  withdrawn  the  applications  for<\/p>\n
attachment.        Subsequently defendants did not pay<\/p>\n
the amount.         It is alleged that though first<\/p>\n
respondent contacted the accused, he refused to pay<\/p>\n
the amount and represented that he cannot pay the<\/p>\n
amount and thereby all the accused        committed the<\/p>\n
offence.\n<\/p>\n
      4.      Learned senior counsel appearing for the<\/p>\n
petitioners and first respondent and learned Public<\/p>\n
Prosecutor were heard.\n<\/p>\n
      5.     To attract an offence under section 420 of<\/p>\n
Indian Penal Code, there should be materials to<\/p>\n
show that petitioners induced the first respondent<\/p>\n

to part with money or to omit the act,          with a<\/p>\n
dishonest intention to cheat.      Even if Annexure A1<\/p>\n
complaint is accepted, there is no allegation that<\/p>\n
there was a dishonest intention on the part of the<\/p>\n
petitioners to cheat at the inception.        The only<\/p>\n
case is that though petitioners met the counsel<\/p>\n
appearing for the first respondent before the civil<\/p>\n
courts      and   sought to  withdraw  the   attachment<\/p>\n
promising to        pay the balance amount due, after<\/p>\n
paying Rs.50,000\/-, and the amount was not paid.<\/p>\n
It is the case that the order of attachment would<\/p>\n
not have been withdrawn but for the promise and the<\/p>\n
inducement made that it will be paid.        It is the<\/p>\n
case that on the failure to pay the amount as<\/p>\n
promised, an offence under section 420 of Indian<\/p>\n
Penal Code is committed.\n<\/p>\n
      6.    Even if the case as stated in the complaint<\/p>\n
is accepted, first petitioner who is respectively<\/p>\n
the junior of the first accused advocate appearing<\/p>\n
for the defendants and second petitioner a document<\/p>\n
writer, met Advocate Bhaskaran Nair on the morning<\/p>\n

of    18.12.2008    representing  that they  will  pay<\/p>\n
Rs.50,000\/- and the balance will be paid within<\/p>\n
thirty days. As far as petitioners are concerned,<\/p>\n
they have no liability to discharge any debt.       At<\/p>\n
best, it could be said that as instructed by the<\/p>\n
counsel appearing for the fourth accused in the<\/p>\n
suits,      first  petitioner  junior along  with  the<\/p>\n
second       petitioner  document  writer  and  fourth<\/p>\n
accused the defendant met the counsel appearing for<\/p>\n
the     first    respondent,and represented  that  the<\/p>\n
fourth accused would pay the entire amount and<\/p>\n
Rs.50,000\/- will be paid on that day.     The question<\/p>\n
is    whether     by   conveying  the  willingness  or<\/p>\n
undertaking of the fourth accused, first petitioner<\/p>\n
junior counsel to the Advocate appearing for the<\/p>\n
fourth accused and the document writer would be<\/p>\n
guilty of an offence under section 420 of Indian<\/p>\n
Penal Code.       On the admitted facts, it cannot be<\/p>\n
said that petitioners made any inducement to the<\/p>\n
first respondent and persuaded her to withdraw the<\/p>\n
petition with a dishonest intention.       At best it<\/p>\n

could be said that petitioners joined with       the<\/p>\n
fourth accused, when they met the counsel appearing<\/p>\n
for the first respondent and promised to pay the<\/p>\n
amount within a period.      If the fourth accused<\/p>\n
did not pay the amount as promised, petitioners<\/p>\n
cannot be prosecuted for the offence under section<\/p>\n
420 of Indian Penal Code.    In such circumstances,<\/p>\n
continuation      of the  proceedings  against  the<\/p>\n
petitioners is only an abuse of process of court.<\/p>\n
To secure the justice it is to be quashed.<\/p>\n
      Petition is allowed. C.C. 438\/2010 of Pattambi<\/p>\n
Police Station against the petitioners accused 2<\/p>\n
and 3 registered under Annexure I F.I.R is quashed.<\/p>\n
