As a result of which the mun.tax of the appeal premises is very<br \/>\nhigh. However, there is no any satisfactory explanation or<br \/>\nclarification on part of the respondent corporation as to previously<br \/>\nthe usage factor has been assessed as Rs.2\/- whereas for the period<br \/>\n2008-09, it has been assessed at Rs.6\/- then after for the period<br \/>\n2009-10, once again it has been reduced to Rs.2\/- in place of Rs.6\/-<br \/>\nand on the basis of this, the corporation has also issued bill to the<br \/>\nappellant for Rs.14,853\/- in place of Rs.44,558\/-. I have gone<br \/>\nthrough the circular of Ahmedabad Mun. Corporation, The Assessment<br \/>\nand Tax Collection Department bearing No.17\/2009-10 dated 24.8.2009<br \/>\nand as per the circular, the respondent corporation has also reduced<br \/>\nthe tax of the application premises for the year 2009-10, but for the<br \/>\nperiod 2008-09, the appellant has preferred this appeal and on<br \/>\nperusal of the documentary evidence, there is no satisfactory<br \/>\nclarification on the part of the respondent corporation as to how the<br \/>\nappellant has often and often uses more and more space of the<br \/>\npremises and though the application premises is used exclusively for<br \/>\nthe purpose of the godown, how it can be assessed as shop from the<br \/>\ngodown and how the retable factor F3 has been increased from 2 to 6<br \/>\nand here, in this appeal, the respondent corporation failed to prove<br \/>\nthe facts of para.7 of the reply i.e. the amenities and new<br \/>\nconstruction and area of construction and, therefore, the act of the<br \/>\ncorporation to assess the tax on the basis of F3 at Rs.6 in stead of<br \/>\n2 is illegal and not proper and, therefore, here in this appeal, the<br \/>\nappellant is entitled to get the benefit of factor F3 i.e. usage<br \/>\nfactor at the rate of Rs.2\/- per sq.mtr. in stead of 6 as the usage<br \/>\ntype or rate of the appeal premises is godown and, therefore, it<br \/>\nshould be assessed at the rate of Rs.2\/- of the appellant deserves to<br \/>\nbe allowed and hence, I pass the following order in the interest of<br \/>\njustice:-\n<\/p>\n<p>-:  ORDER<br \/>\n:-\n<\/p>\n<p>\tThe<br \/>\n\tpresent Appeal of the appellant is hereby allowed.\n<\/p>\n<p>\tThe<br \/>\n\tassessment made by the respondent corporation for the usage factor<br \/>\n\ti.e. F3 at Rs.6\/- in place of 2 for the year 2008-09 is hereby set<br \/>\n\taside.\n<\/p>\n<p>\tFurther<br \/>\n\tthe respondent corporation is hereby directed to issue fresh bill<br \/>\n\tfor tax on the basis of factor F3 i.e. usage factor at Rs.2\/- in<br \/>\n\tplace of 6 for the year 2008-09.\n<\/p>\n<p>\tNo order<br \/>\n\tas to cost of this appeal.&#8221;\n<\/p>\n<p>\tThe<br \/>\n\taforesaid shows that there was no satisfactory clarification shown<br \/>\n\tbefore the learned Judge for making change of the use from godown to<br \/>\n\tshop by the Corporation or its officers. Even during course<br \/>\n\tof\u00a0hearing, learned counsel for the appellant has not been able<br \/>\n\tto show any material to us on the basis of which it can be said that<br \/>\n\tthe assessment of the premises from godown to shop or even<br \/>\n\tshop-cum-godown was on the basis of the report of any officers or<br \/>\n\totherwise. Under these circumstances, we find that if the learned<br \/>\n\tJudge has gone by the evidence produced on record, it cannot be said<br \/>\n\tthat there is any error committed by the learned Judge when the<br \/>\n\tCorporation failed to establish the actual use of the premises was<br \/>\n\tfor shop and not godown. We may record that it is not a matter where<br \/>\n\tthe assessment came to be made for the first time as shop or<br \/>\n\tshop-cum-godown but is a matter where initially the premises was<br \/>\n\ttaxed as godown and thereafter the assessment is changed from godown<br \/>\n\tto shop or shop-cum-godown.
