Mr. K.M<br \/>\nSheth, learned advocate waives service of rule on behalf of the<br \/>\nrespondents.  Heard learned Advocates for the Applicants and the<br \/>\nOpponents.  Interim relief in terms of para 5 (B) on condition that<br \/>\nthe applicants shall deposit the  decretal amount  within six  weeks<br \/>\nfrom today. On such amount being deposited, the original claimants<br \/>\nshall  be at liberty to  withdraw 40% of the  amount. The remaining<br \/>\namount being the amount of 60% shall be  invested  by  the Registry<br \/>\nby way of a fixed deposit with a nationalised bank initially for a<br \/>\nperiod of three  years, and  on  maturity shall be renewed by one<br \/>\nyear at a time   without any  further  orders  in this regard  till<br \/>\nthe  disposal of   the   appeal.  The interest accruing  on the said<br \/>\ndeposit shall be paid quarterly to the original claimants. Rule is<br \/>\nmade absolute accordingly with no order as to costs.??\n<\/p>\n<p>This<br \/>\n\tCourt has granted relief in terms of para 5(B) on condition that<br \/>\n\tapplicant shall have to deposit decretal amount within six weeks<br \/>\n\tfrom the date of order and liberty was granted to claimants for 40%<br \/>\n\twithdrawal.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid order passed by this Court and after considering<br \/>\n\tsubmissions made by both learned advocates, Rule is made absolute in<br \/>\n\tterms of order dated 10\/9\/2008.\n<\/p>\n<p>The<br \/>\n\tRegistry of this Court is directed to notify group of appeals being<br \/>\n\tFA No. 4251\/2008 and allied matters on 18\/12\/2008 on separate board.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(H.K.RATHOD,<br \/>\nJ)<\/p>\n<p>asma<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court State vs Gangaben on 6 May, 2011 Author: H.K.Rathod,&amp;Nbsp;
