ADVOCATE WITH MR SATYEN B RAWAL\nfor Petitioner None for\nRespondents : 1,3 - 4. \nBHARGAV KARIA &amp; ASSO for Respondents :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned advocate for the petitioner and Mr. Karia, learned advocate<br \/>\n\tfor respondent no.2 on caveat.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioner has taken this Court through various<br \/>\n\tdocuments indicating that way back in the year 1906, the land in<br \/>\n\tquestion was granted by the then rural of Dhrangadhra State to his<br \/>\n\tancestral. The record to this effect is shown. The grant was after<br \/>\n\trealizing the price fixed and entires to that effect have been<br \/>\n\tavailable on record. The application made under Section 37(2) was<br \/>\n\tdecided in favour of the petitioner. The order thereon was ordered<br \/>\n\tto be taken in review at the behest of the then Chief Minister and<br \/>\n\tthe concerned Collector, thus, had taken that order into review and<br \/>\n\trelied upon consideration, which did not reflect proper application<br \/>\n\tof mind.\n<\/p>\n<p>On<br \/>\n\tearlier occasion, there appears to be one petition being Special<br \/>\n\tCivil Application No. 7760 of 1998  is filed, wherein, this Court<br \/>\n\t(Coram: Y.B. Bhatt, J.)(as he then was) vide order dated 10.8.1999<br \/>\n\tadmitted the matter and granted an order of status quo.\n<\/p>\n<p>Shri<br \/>\n\tKaria, learned advocate appearing for the respondent no. 2 on caveat<br \/>\n\tsubmitted that case of the petitioner is based upon the absolute<br \/>\n\twrong premise in as much as, the pedigree relied upon by the<br \/>\n\tpetitioner does not disclose the person in whose favour the<br \/>\n\tDhrangadhra State has granted land. The intervening facts that in<br \/>\n\tthe year 1923 one Koli Jasa Hari was also granted said land and as<br \/>\n\tholder at the relevant time, had left for the territory, which is<br \/>\n\tnow be falling under Pakistan.\n<\/p>\n<p>This<br \/>\n\tcourt is of the view that as there is already matter being Special<br \/>\n\tCivil Application No. 7760 of 1998 pending, this matter is required<br \/>\n\tto be ordered to be heard along with said matter. Hence, Rule.<br \/>\n\tThis matter be heard along with Special Civil Application No. 7760<br \/>\n\tof 1998.\n<\/p>\n<p>At<br \/>\n\tthis stage, Shri Karia, learned advocate submitted that let there be<br \/>\n\ta permission to the respondent no.2 for filing note for fixing early<br \/>\n\tdate of hearing so far as Special Civil Application No. 7760 of 1998<br \/>\n\tis concerned. Liberty, as sought for is granted.
