Justice S.S.SATHEESACHANDRAN\n\n Dated :28\/10\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.30512 OF 2009\n           --------------------------\n     Dated this the 28th day of October 2009\n     -------------------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<p>        i)  Issue appropriate direction to the  3rd<\/p>\n<p>Additional  District  Court,  Ernakulam   to  issue<\/p>\n<p>certified  copy  of  the  judgment  in  O.P (Arb.)<\/p>\n<p>No.282\/2009  and   also   the   order   in   Ext.P5<\/p>\n<p>application.\n<\/p>\n<p>        ii)   Issue appropriate order or direction<\/p>\n<p>directing the 1st respondent not to alienate or<\/p>\n<p>encumber the property having an extent of 35 cents<\/p>\n<p>in   Sy.   No.386\/8-1   of    Naranganam   Village,<\/p>\n<p>Kozhencherry Taluk till the certified copy in O.P<\/p>\n<p>(Arb.) 282\/2009 is issued to the petitioner.<\/p>\n<p>        iii)   Grant such other reliefs as this<\/p>\n<p>Hon&#8217;ble Court may deem fit and proper in the facts<\/p>\n<p>and circumstances of the case.\n<\/p>\n<p>W.P.(C).No.30512 OF 2009     Page numbers<\/p>\n<p>          2.     Petitioner had moved an application<\/p>\n<p>under Section 9 of the Arbitration and Conciliation<\/p>\n<p>Act 1996 hereinafter referred to as the Act against<\/p>\n<p>the   respondents      before the    Principal   District<\/p>\n<p>Court,    Ernakulam.       The   above   proceeding   was<\/p>\n<p>numbered as O.P (Arb.) No.282 of 2009 on the file<\/p>\n<p>of that court in which on an application moved by<\/p>\n<p>the petitioner an immovable property belonging to<\/p>\n<p>the     first      respondent   situate     within   the<\/p>\n<p>jurisdiction of another court was ordered to be<\/p>\n<p>attached.     Respondents entered appearance and filed<\/p>\n<p>objections to the application.        Since the property<\/p>\n<p>ordered to be attached was beyond the jurisdiction<\/p>\n<p>of the court in which the application in the above<\/p>\n<p>O.P was filed, it is submitted, the court below has<\/p>\n<p>dismissed the O.P holding it has no jurisdiction to<\/p>\n<p>entertain the proceeding under Section 9 of the<\/p>\n<p>Act.    Petitioner has applied for getting a copy of<\/p>\n<p>the order passed by the court below, but, till date<\/p>\n<p>it   has   not    been  furnished.      Petitioner seeks<\/p>\n<p>directions\/orders to court below for issue of copy<\/p>\n<p>of order at the earliest and also to keep alive the<\/p>\n<p>W.P.(C).No.30512 OF 2009     Page numbers<\/p>\n<p>order of attachment for a grace period till an<\/p>\n<p>appeal is preferred against the order dismissing<\/p>\n<p>his O.P.\n<\/p>\n<p>          3.    Having regard to the submissions made<\/p>\n<p>and taking note of the facts and circumstances<\/p>\n<p>presented, I find no notice to the respondents is<\/p>\n<p>necessary and hence it is dispensed with.       I direct<\/p>\n<p>the   court    below    to  issue   copy  of  the  order<\/p>\n<p>dismissing      O.P     (Arb.)   No.282\/2009    to   the<\/p>\n<p>petitioner, if applied for, within a period of<\/p>\n<p>three weeks from the date of receipt\/production of<\/p>\n<p>a copy of this judgment.           Order of attachment<\/p>\n<p>passed by the court below in the above O.P shall<\/p>\n<p>remain effective to and alive for a period of one<\/p>\n<p>month from the date of this judgment.         Subject to<\/p>\n<p>the above orders\/directions the writ petition is<\/p>\n<p>closed.
